CONTRACT FOR MINNESOTA AGENCY TRACTOR RENTAL SUPPLIES AND SERVICES The undersigned AGENCY and VENDOR, the PARTIES to the CONTRACT, Agree to perform in accordance with the provisions of this CONTRACT, including those attached or incorporated by reference. The tractor shall include a manufactures standard all-weather cab, including heater, defroster, air conditioning and the capability to circulate fresh air or cab air only. The tractor may include a mechanical front wheel assist.
The tractor must have the capacity to operate 540 and/or 1000-RPM PTO. Vendor Service: Factory availability is listed below: 5 Series Tractors - 120-180 days after receipt of P.O. 6 Series Tractors - 180 days after receipt of P.O. 7 Series Tractors - 180 days after receipt of P.O. Rental term shall be for an 8 month rental. The tractor(s) will be used for no more that 400 engine hours during the 8 month rental period. All service or daily maintenance required by the operator s handbook shall be performed by the Agency. All repairs will be performed at the dealer s service facility with transportation to and from this location the responsibility of the successful bidder. When requested, the Agency may be asked to transport the tractor to the servicing dealer at no cost. Repairs requiring the tractor to be out of service five (5) or more working days will require a replacement tractor to be set up and delivered to the assigned location. The lessor shall maintain insurance to provide for the replacement or repair of the machine in the event of severe damage or total loss. All tractors included in this contract will be located in the geographic areas of the Agency to which they are assigned. The Agency will pay for and replace all tires, glass, and sheet metal, etc. that is damaged while the tractor is leased, if damages are beyond reasonable wear and tear (as determined by the Agency and John Deere Co.) The contract shall be for an 8 month rental term and all equipment shall be returned to the vendor or the vendor s representative after 8 months, unless prior arrangements have been made.

Pricing / Compensation Method and rate of compensation: Price quoted for annual lease for 300 engine hours of operation for an 8 month rental. $ 4,500.00 $ 5,100.00 $ 5,400.00 Price quoted for annual lease for 400 engine hours of operation for an 8 month rental. $ 6,000.00 $ 6,800.00 $ 7,200.00 Price quoted per engine hour exceeding 300 hours. $ 15.00 $17.00 $ 18.00 Price quoted for compatible loaders: $3.00 per hour Invoices for rental may be submitted June 30, 2013 or no later than December 15, 2013. All invoices for repairs including sheet metal, tire replacement, glass replacement, etc., shall be invoiced separately. All charges for hours or days and above the specified limits will be reviewed as stated above and invoiced separately. Miscellaneous Requirements John Deere Company reserves the right to substitute tractor models (if required) within a horsepower range to best fit trade area needs. John Deere Company requests 90-180 days notice of Agency rental requirements to ensure tractor availability. Rental tractors to be utilized for use with 3-pt. hitch rotary mowers, (i.e. not to be used with boom mowers, side mounted flail mowers, etc.) Agency to complete attached John Deere Rental Delivery and Return form.
Agency will use only Genuine John Deere Service Parts (engine oil, hydraulic oil, grease, filters, etc.) when servicing John Deere tractors. Agency to comply with daily/monthly service schedule during rental period. John Deere Company will work with Agency to determine delivery/servicing dealer. John Deere Company requests the right to cancel rental program upon mutual agreement with State of Minnesota.
