Background i) The Transport Department, Andaman & Nicobar Islands functions under the provisions of Section 213 of Motor Vehicles Act, 1988 and is established for enforcement of the provisions of Motor Vehicles Act, 1988 & Rules made there-under. In order to implement the Notification issued by Ministry of Road Transport and Highways vide Notification No. G.S.R. 290 (E) Dt. 15.04.2015 by way of amendment to Rule 118 of Central Motor Vehicles Rules 1989, and the guidelines dated 10 th Feb 2017 issued by MoRTH, Transport Department, Andaman & Nicobar Islands invites the manufactures/vendors from the Manufacturers of Speed Governors for short-listing of Agency(s)/Vendor(s) for exclusive Supply, Installation and Maintenance of Speed Governors conforming to the standards of AIS-018, AIS-037 as per Notification of MoRTH, GoI. ii) In exercise of the powers conferred by Sub-rule (2) of Rule 118 of the Central Motor Vehicles Rules, 1989 the Transport Department, Andaman & Nicobar Islands, hereby specify that the transport vehicles mentioned below which are registered prior to 1st October 2015 and which are not already fitted with speed governors (speed limiting devices or speed limiting function) shall be fitted with a speed governor ( speed limiting devices or speed limiting function) by the operator of these vehicles having maximum preset speed of not more than 60 K.Ms. per hour or maximum preset speed of not more than 45 K.Ms. per hour, as the case may be, conforming to the Standard AIS: 018/2001 : Sl. Type of vehicles Maximum speed limit No 1 Stage carriage buses. Not more than 60 Kms. per 2 hour. Contact carriages with seating capacity exceeding 8+1. 3 Goods vehicles exceeding 3500 kilograms gross vehicle weight (GVW) except dumpers, tankers and those carrying hazardous goods. 4 A motor vehicle used for carriage of passengers, comprising not more than eight Not more than 60 Kms. per hour. seats in addition to the driver s seat (M1 Category) 5 Dumpers, tankers and those carrying hazardous goods. 6 Buses / vans used for transporting students Not more than 45 Kms. per hour. iii) The Transport Department, Andaman & Nicobar Islands, now propose to issue for the Manufacturers/vendors of Speed Governors for fitment of SLDs in the UT of A & N Islands following guidelines specified by MoRTH: a) That adequate number of Speed Governors are made available uniformly all over the UT of A&N Islands. b) That the good quality product is available for the vehicle owners. c) That fly by night operators and sub-standard manufacturers are avoided. d) That consistent & un-interrupted supply is maintained e) That full system transparency is maintained by incorporation of efficient MIS system f) That the vendors so selected can be made obligatory to meet the requirements failing which a stiff penalty can be imposed on them which will safeguard the State Govt. obligations. g) That MIS data/reports can be generated for effective implementation of the speed governors through software to be provided by the selected vendors. h) Tampering issues are curtailed with proper technological developments & implementation i) The AMC is properly undertaken. 3. Scope of Work: The Agency(s)/Vendor(s) shall be responsible for carrying out the following activities with respect to Supply, Installation and Maintenance of Speed Governors on those types of vehicles notified by Transport Department, Andaman & Nicobar Islands. 1) Supply, Installation and Maintenance of Speed Governors on the notified Transport Vehicles in the UT of A&N Islands for a period of 5 years. 2) The Speed Governors shall conform to the Standard AIS 018/2001 and shall be as per the Type Approval Certificate, obtained by the successful bidder(s), from the Testing Agencies specified vide Rule-126 of CMV Rules, 1989. 3) The Registration Number of the vehicle should be engraved on the SLD to ensure that the same SLD is not used in another vehicle. 4) The operators of those notified types of Transport Vehicles shall approach the Vendor(s)/Agency(s) for necessary fitment of the Speed Governors and the Vendor(s)/Agency(s) shall supply, install & maintain those Speed Governors. 5) The Vendor(s)/Agency(s) shall carry out the sales, installation and maintenance of Speed Governors directly or through its authorized dealer network in the UT of A&N Islands. 6) The Vendor(s)/Agency(s) has to provide after-sale service during the warranty period as per the warranty clause and provide Annual Maintenance Contract (AMC) to ensure proper maintenance and working of the Speed Governors thereafter. 7) The Vendor(s)/Agency(s) has to provide a comprehensive and complete solution for implementation of MIS software to provide full transparency in the system. 8) The MIS software shall be capable of generating reports containing information pertaining to the fitment of Speed Governors such as, Serial No. & Batch No. of the Speed Governor, Registration No., Make and Model, Engine No. and Chassis No. of the Vehicle, Name of the Vehicle Owner and Date of fitment etc. The System should have the provision for integration of the Speed Governor data with the Vahan Database. 9) The system should be capable of providing Short Message Service (SMS) to Transport Department, Andaman & Nicobar Islands confirming the Installation of the Speed Governors mentioning the Vehicle Registration No., Chassis and Engine No., Speed Governor Sl. No. and Installation Certificate Serial No. 10) On fitment of the Speed Governor, the shortlisted Vendor(s)/Agency(s) has to issue a Fitment Certificate in triplicate (RTO Copy, Customer Copy and the Manufacturer Copy) to certify that the Speed Governors has been fitted, speed has been set as per the notified speed limit and proper sealing has been done. Every Fitment Certificate must have a hologram of the manufacturer approved by Secretary (Transport). 11) The Vendor(s)/Agency(s) would be required to maintain proper records of fitment and periodically tally the same with the records maintained at the RTO Offices. 12) The Vendor shall furnish working plan to carryout Sale/ Installation and maintenance of Speed Limiting Device in all the islands wherever motor vehicles ply. 4. Sequence of Activities and Responsibilities in connection with the installation of Speed Governor a. The Operators of the Transport Vehicles shall approach the Vendor(s) or their authorized dealer for fitment of Speed Governors. b. It shall be the responsibility of the Vendor(s) to ensure that the vehicle is fitted with the speed governor within 7 days directly or through their authorized dealer. c. The Registration Number of the vehicle should be engraved on the SLD to ensure that the same SLD is not used in another vehicle d. The Operator of the Vehicle shall produce the vehicle before the Vendor(s)/ Authorized Dealer for fitment of Speed Governors on the date and time intimated to him. e. After successful installation of the Speed Governors with prescribed speed limit and sealing the Speed Governors as required, the Vendor(s) or their authorized dealer must issue a Fitment Certificate in the format approved by the Secretary (Transport) duly signed by the Vendor(s)/Authorized Dealer(s). f. The Photograph of the vehicle fitted with Speed Governor is taken and uploaded in the MIS Software along with details of the vehicle, owner and the Speed Governor by the Vendor(s). g. The Copy of the Certificate shall be submitted to RTO through online by the Vendor(s). h. The Customer will produce the Fitment Certificate of Speed Governors to the RTO Office / Motor Vehicle Inspector along with the Vehicle in which the Speed Governor is fitted, for inspection and re-sealing by the RTO. i. The MVI will verify the Fitment of Speed Governors, sealing and after due verification and satisfaction affix the official seal. The MVI may take a trial of the vehicle to ensure that the speed is set to the specified speed limit. j. On a monthly basis, Vendor(s) has to submit to the Secretary (Transport) the details of fitment of the Speed Governors in the prescribed format. 5. Service Centre The Vendor(s) should have the functioning/infrastructure in each Districts of A&N Islands and shall have sufficient no. of trained manpower capable of trouble shooting the defective Speed Governors. 6. Quality Assurance & Warranty a) The Vendor(s) will ensure that all Speed Governors fitted strictly adhere to the Standards specified in the relevant sections b) The Vendor(s) has to ensure the quality of the Speed Governors supplied and installed. c) The Vendor(s) has to ensure fitment of Speed Governors models as per the approvals received from the Prescribed Testing Agencies mentioned in Rule-126 of CMV Rules, 1989. d) The Vendor(s) has to ensure that the fitment of Speed Governors is done by the trained technicians or their Authorized Dealer. e) The Vendor(s) has to agree to provide warranty of one year for the Speed Governors supplied and installed by them. The warranty has to be against any manufacturing defect. The warranty offered will be void under the following conditions. i. If the seals are found tampered or broken. ii. iii. iv. If any attempt is made to modify / repair / service the product other than by the fitting Agency or his Dealer. If the product is subject to any improper use or condition other than for what it is intended for. If any attempt is made by the customer / his representative / any third party to open the product, make additions, alterations or modifications. v. In case of the defects or damage or repair arising as a result of any accident or collusion or abnormal vehicle conditions. f. Components or accessories subject to normal wear and tear and accessories used for fitment and sealing of the device is not covered under the scope of warranty. g. The customer / operator of the vehicle will inform the bidder / authorized dealer of speed governors about the problems or defects observed in the speed governors. Based on the nature of complaint received from the operator, the bidder / his authorized dealer may decide on whether the Speed Governor can be repaired or replaced. Directorate of Transport Page 6

8. Format for Affidavit/ Undertaking by the Manufacturer of Speed Governors AFFIDAVIT / UNDERTAKING We,. having our office at.,a company Registered under the companies Act 1956 (which includes our heirs, successors legal representatives assigns agents etc., and persons and entities deriving title through us) involved in the business of manufacturing and supply of Speed Governors in India and intending to register ourselves as Vendor for Supply and Fitment of Speed Governors in the UT of A&N Islands, solemnly affirm and declare as under: 1. That we are in the business of manufacturing and supply of Speed Governor in India. 2. That we have not been prosecuted or convicted and that no investigation is pending against us for infringement of intellectual Property Rights of any third party or entity under the provisions of Patent Act, Copyright Act and/or Trademark Act, as the case may be with regard to Speed Governor being manufactured by us. 3. We undertake to maintain consistent and un-interrupted supply of Speed Governors throughout the UT of A&N Islands failing which, are liable for any penalty levied by Transport Department, A&N Islands. 4. We hereby declare that, we have not been prosecuted or convicted and no investigation is pending against us for infringement of Intellectual Property Rights of any third party or entity under the provisions of Patent Act, Copyright Act and / or Trademark Act, as the case may be with regards to Speed Governor, being manufactured by us. 5. This undertaking is binding on us. Our heirs successors legal representatives assigns agents etc. and persons and entities deriving title through us if the said undertaking turns out to be false or misleading our registration as vendors for supply and installation of Speed Governors shall be liable to be rejected at any stage of the grant of registration and any time after such grant of Registration. Kmph and the unit is sealed at. Points and functioning as per norms laid out in AIS 018. We are satisfied with the performance of the unit in all respects. We undertake not to raise any dispute or any legal claims against M/s. in the event that the above mentioned seals are found broken /torn / tampered and more specifically with the respect to any variance in the speed limit set at the time of delivery, after expiry of warranty period of 12 months from the date of installation.
