THE EAST SUSSEX COUNTY COUNCIL (LEWES DISTRICT) (OFF-STREET PARKING PLACES) ORDER 2004 East Sussex County Council (hereinafter referred to as "the Council") in exercise of their powers under sections 35, 39(6) and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 (hereinafter referred to as "the Act of 1984"), as amended by the Parking Act 1989 and the Road Traffic Regulation Act 1991, and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 of the Act of 1984, hereby makes the following Order: Citation and revocation PART I - GENERAL 1. (1) This Order may be cited as the East Sussex County Council (Off-Street Parking Places) Order 2004 and shall come into operation on the twentieth day of September 2004. (2) Without prejudice to the validity of anything done or to any liability incurred in respect of any act or omission before the coming into operation of this Order, The Lewes District Council (Off-Street Parking Places) (No 2) Order 2003 is hereby revoked. Interpretation 2. (1) In this Order, except where the context otherwise requires, the following expressions have the meanings hereby respectively assigned to them: (a) car share membership card means a permit issued by the Council stating that the holder is a member of the car share club; (b) charging hours means Monday to Saturday 8am to 6pm (c) disabled person s badge have the same meanings as in Regulation 3(1) of the Local Authorities Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 and relevant position has the same meaning as in Regulation 4 of those Regulations; (d) "driver", in relation to a vehicle waiting in a parking place, means the person driving the vehicle at the time it was left in the parking place; (e) (f) ESCC User permit means a permit issued by the Council with the wording ESCC User on it; ESCC Priority User permit means a permit issued by the Council with the wording ESCC Priority User on it; (g) initial charge means the charge payable in respect of the charging band tariff, as referred to in column 6 of Schedule 1 and set out in relation to that charging band in column 3 of Schedule 2; (h) (i) initial period means the maximum time period a vehicle may wait as set out in column 5 of Schedule 1; LDC User permit means a permit issued by Lewes District Council with the wording LDC User on it; (j) motor vehicle means a motor car, a motor cycle or an invalid carriage as defined by section 136(2)(4) or (5) of the Act 1984; (k) owner in relation to a vehicle means the person by whom the vehicles is kept and used and unless the contrary is proved, the person shown by the appropriate registration authority to have been the registered keeper or owner on the date on which a vehicle was left in the parking place shall be deemed to be the owner for such purposes of this Order and in relation to a vehicle which is subject to a hiring agreement or hire purchase agreement means the person in possession of the vehicle under that agreement; 2

(l) parking attendant means a person authorised by or on behalf of the Council to supervise any parking place; (m) parking bay means an area in a parking place which is provided for the leaving of a vehicle; (n) parking device means either a ticket, card, disc, token, permit, stamp or other similar device, whether used in a vehicle or not (subject to the subsequent provisions of this Order); (o) "parking place" means any area of land specified by name in column 1 of Schedule1 to this Order provided by the Council under Section 32(1) of the Act of 1984 for use as a parking place; (p) parking ticket means a ticket issued by a ticket machine; (q) (r) (s) penalty charge means the charge set under the provisions of the Road Traffic Act 1991, with the approval of the Secretary of State for Transport, Local Government and the Regions, which is to be paid to the Council following the issue of a penalty charge notice; penalty charge notice means a notice issued or served by a parking attendant pursuant to the provisions of section 66 of the Road Traffic Act 1991; "registered keeper", in relation to a vehicle, means the person in whose name the vehicle is registered under the provisions of the Vehicle Excise and Registration Act 1994; (t) "relevant position", notwithstanding expression (c) above, means - (i) in the case of a vehicle fitted with a front windscreen, the near side of and immediately behind the windscreen; and; (ii) in the case of a vehicle not fitted with a front windscreen, a conspicuous position on the vehicle; (u) season ticket means a season ticket issued by the Council under the provisions of Article 6(4). (v) "ticket machine" means an apparatus of a type and design approved by the Secretary of State for Transport for the purposes of this Order being apparatus designed to issue a parking ticket indicating the payment of a charge and the date and time by which the parking period will expire; (w) trailer means a trailer as defined by section 136(1) of the 1984 Act. (2) The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament, and as if for the purposes of sections 16 and 17 of that Act this Order were an Act of Parliament and the Order revoked by Article 1 of this Order were an Act of Parliament thereby repealed. Vehicles for which parking places are provided PART II USE OF PARKING PLACES 3. Each area of land specified by name in column 1 of Schedule 1 to this Order (hereinafter referred to as "Schedule 1") may be used, subject to the following provisions of this Order, as a parking place for such classes of vehicles, on such days and during such hours, at such times and periods and on payment of such charges or by display of a valid season ticket, as are specified in relation to that area in Schedule 1 or as otherwise specified by this Order. Certain other vehicles for which parking places are provided 4. Where in column 2 of Schedule 1 a vehicle displays in a prominent position one of the specified parking permits on such days and during such hours as are specified in relation to that area, or where, within a parking place, there is a sign or surface marking which indicates that a parking place is stated as available for vehicles of a specified class or classes, the driver of a vehicle shall not permit it to wait in that parking place unless it is of the specified class or one of the specified classes, or in a position other than that specified in that parking place. (1) The driver of a vehicle shall not permit it to wait in a parking place for longer than the maximum period permitted for waiting specified in column 5 of Schedule 1 in relation to that parking place. (2) The driver of a vehicle shall not permit it to re-enter a parking place if that vehicle has been left in that parking place at any time during the preceding two hours. Payment of charge and display of parking tickets and season tickets 6. (1) The driver of a vehicle using a parking place shall, subject to paragraph (2) below, on leaving the vehicle in the parking place, pay either the appropriate charge in accordance with the scale of charges referred to in column 6 of Schedule 1 in relation to those set out in column 3 of Schedule 2 or, if available for that parking place, display a valid season ticket for which a fee as set out in column 7 of Schedule 1 has been paid. (2) the driver of a vehicle using a parking place where payment for parking is made on exit, shall pay the appropriate charge as specified in paragraph (1) above, on exiting that car park. (3) Payment for the band tariff referred to in column 6 of Schedule 1 and charge as set out in relation to that charging band in column 3 of Schedule 2 shall be made by the insertion of an appropriate coin or coins into the apparatus or device provided, being an apparatus or device approved in accordance with Section 35(3) of the Act of 1984. (4) Any parking ticket issued on payment of the said charge shall be valid for a parking place if and so long as the following conditions are satisfied: (a) the parking ticket is exhibited on the vehicle in the relevant position; (b) the period applicable to the parking ticket, calculated from the date and time of purchase indicated on the ticket, has not expired; (c) the parking ticket shall be non transferable between the vehicle in respect of which it was issued and any other vehicle and shall be valid only in the parking place in which it is issued. (5) Any person may on application to the Council and subject to availability, purchase a season ticket in respect of a vehicle for the fee specified in column 7 of Schedule 1 and that season ticket shall be valid in such parking places as are specified thereon during the period for which it is issued and during the times which may be stated thereon. Any season ticket issued shall be displayed in the relevant position on the vehicle subject to conditions of use as may be specified at the time of issue when that vehicle is parked in one of the parking places specified on the season ticket. (6) The driver of a vehicle shall not permit it to wait in a parking place reserved for season ticket holders without displaying a valid season ticket. Contraventions in a parking place and penalty charges 7. If a vehicle is left in a parking place during the charging hours (1) after the parking period for which payment was made by the parking charge has expired; or (2) without displaying a valid ticket in accordance with Article 6(4)(a) or a valid season ticket in accordance with Article 6(5), as the case may be and if appropriate; or (3) in a parking bay or part of a parking place reserved for a specific class of vehicle unless it is of the specified class; or (4) in a position so as not to be wholly within a marked parking bay or a parking place, as the case may be a penalty charge shall be payable in respect of that vehicle on each occurrence. 8. If a vehicle is left in a parking place at any time (1) contrary to the classes of vehicles permitted to wait in the parking place as specified in column 2 of Schedule 1; or 4

(2) in a position so as to obstruct access to the parking place or to any premises adjoining the parking place or to obstruct an access way within a parking place; or (3) in a position so as to be not wholly within a marked bay or parking place, as the case may be a penalty charge shall be payable in respect of that vehicle on each occurrence. 9. In the case of a vehicle in respect of which a penalty charge has been incurred, a parking attendant may attach to the vehicle in a conspicuous position or, at their discretion, hand to a person whom they have reason to believe has incurred a penalty charge, a notice which shall include the following particulars: (1) the registration mark of the vehicle or, where the vehicle is being used under a trade licence, the number of the trade plate carried by the vehicle; (2) the time at which the parking attendant first noticed or had reason to believe that a penalty charge had been incurred; (3) a statement that a penalty charge of sixty pounds (VAT exempt) is required to be paid; (4) the manner in which, and the time within which, the penalty charge should be paid; (5) a statement that a reduced penalty charge of thirty pounds (VAT exempt) shall be payable if payment is made within fourteen days of the penalty charge being incurred; (6) a statement that it is an offence under this Order and Section 35A of the Act of 1984 for the driver of the vehicle who has left the vehicle in a parking place to duly fail to pay the penalty charge. 10. The driver of a vehicle in respect of which a penalty charge has been incurred shall pay the penalty charge to the Council either by: (1) bankers draft or money order or postal order, Bank Giro Credit, National Girobank Inpayment or Transfer at any Post Office, cheque or direct transfer delivered or sent by post to the Parking Shop; or (2) in person at the Parking Shop by cash, cheque or postal order. Provided nevertheless, that if the penalty charge referred to in Article 9(3) above is paid to the Bank or Post Office so as to enable it to reach the Council's Bank not later than 3.30pm on the seventh day following the day on which the penalty charge was incurred or is sent or delivered so as to reach the Finance Department of the Council not later than 3.30pm on such seventh day, the said penalty charge shall be discounted so that the driver will then only be required to pay to the Council the reduced penalty charge referred to in Article 9(5) above. Provided that if the seventh day is a day on which the Banks, Post Offices and the said Finance Department of the Council are generally closed the period within which the payment of the excess charge shall be made to the Council to enable the aforementioned discount to apply shall be extended until 3.30pm on the next working day when the Banks, Post Offices and the said Finance Department of the Council are generally open. 11. Where a notice has been attached to a vehicle in accordance with the provisions of Article 9 of this Order neither the driver nor owner of the vehicle to which the notice has been attached nor any other person not being a person duly authorised by the Council shall remove the notice from the vehicle until immediately prior to the vehicle being removed from the parking place. Conditions applying to the use of a parking place 12. The driver of a vehicle using a parking place shall (i) stop the engine as soon as the vehicle is parked in the parking place in accordance with the provisions of Article 19 of this Order and shall not start the engine except when about to depart from the parking place; (ii) not permit that vehicle to wait in a parking place unless the vehicle is licensed in pursuance of the provisions of the Vehicle (Excise) Act 1971 and unless there is in relation to the use of the vehicle by the driver such a policy of insurance as complies with the requirements of Part VI of the Road Traffic Act 1988; and 5

(iii) not permit a vehicle drawing a trailer to wait in a parking place unless the trailer has been disconnected and for the purpose of this Order, the vehicle and the trailer shall be deemed to be separate vehicles and the driver, shall be deemed to be the driver of each of the vehicles. 13. No person shall use a vehicle, while it is in a parking place, in connection: (1) with the sale of any article to persons in or near the parking place, or (2) with the selling or offering for hire of his skill or services, or (3) with any other business or professional purposes except with the prior written consent of the Council. 14. No person shall use any part of a parking place for any purpose other than parking of vehicles except with the prior written consent of the Council. 15. No person shall use any part of a parking place or any vehicle left in a parking place: (1) for sleeping, camping, cooking or eating purposes; (2) for the purposes of servicing, repairing or washing any vehicle or part thereof other than is reasonably necessary to enable that vehicle to depart from the parking place; 16. In a parking place no person shall: (1) erect or cause or permit to be erected any tent, booth, stand, building or other structure without the written consent of the Council; (2) light or cause or permit to be lit any fire (3) display or distribute or cause to be displayed or distributed any notice, leaflet, handbill, booklet, book or other item; (4) use any threatening, abusive or insulting language, gesture or conduct with intent to put any person in fear so as to occasion a breach of the peace or whereby a breach of the peace is likely to be occasioned; (5) shout or make or permit any other noise, music or otherwise behave in a manner to cause disturbance or annoyance to users of the parking place, occupants of neighbouring premises or passers by; or (6) use any part of the parking place (i) (ii) for skating (using in-line or roller skates), for skateboarding; (iii) for playing or taking part in any game; (iv) for cycling; or (v) to race, drive or permit to be driven or ridden and vehicle in a manner which is a danger to other users of the parking place, to the public, or is a nuisance or disturbance to nearby residents. 17. When a vehicle is left in a parking place in contravention of any of the provisions of this Order, a person authorised in that behalf by the Council may remove the vehicle or arrange for it to be removed from that parking place; and when a vehicle is waiting in a parking place in contravention of the provisions of Article 22 of this Order, a person authorised in that behalf by the Council may alter or cause to be altered the position of the vehicle in order that its position shall comply with that provision. 18. The driver of a motor vehicle using a parking place shall not sound any horn or other similar instrument except when about to change the position of the vehicle in or to depart from the parking place. 6

19. No person shall, except with the permission of any person duly authorised by the Council, drive any vehicle in a parking place other than for the purpose of leaving that vehicle in the parking place in accordance with the provisions of this Order or for the purpose of departing from the parking place, and without prejudice to the generality of this Article the driver of a vehicle entering a parking place shall park that vehicle in a position appropriate to the parking place in question (and having regard to the provisions of Article 22 hereof) as soon as reasonably practicable. 20. No person shall, except with the prior written consent of the Council, drive a vehicle within or through a parking place as a means of gaining passage for such vehicle proceeding from one road to another road or from a road to land or premises abutting a parking place or from such land or premises to a road. 21. Where in a parking place signs are erected or surface markings are laid for the purpose of: (1) indicating the entrance to or exit from the parking place, or (2) indicating that a vehicle using the parking place shall proceed in a specified direction within the parking place; no person shall drive or cause or permit to be driven any vehicle: (a) (b) so that it enters the parking place otherwise than by an entrance or leaves the parking place otherwise than by an exit so indicated, or in a direction other than that specified as the case may be. 22. Where a parking place has been marked out with white lines to indicate parking bays a driver shall park his vehicle in the position so indicated by the said white lines and in the event of a parking place not being so marked with white lines to indicate parking bays a driver of a vehicle shall park the vehicle in an orderly manner and so as not to cause obstruction to other vehicles and the absence of such white lines shall not invalidate any of the provisions contained in this Order. Areas may be marked with yellow lines indicating that vehicles may not be parked there and in such cases a driver shall not cause his vehicle to park in the position so indicated. Vehicles exempt from payment of any charge 23. The following types of vehicle left in a parking place (other than such places as may from time to time be prescribed by resolution by the Council) shall be exempt from the payment of any charge referred to in column 6 of Schedule 1 in relation to that specified in column 3 of Schedule 2 but must abide with the maximum length of stay specified in column 5 of Schedule 1: (1) an invalid carriage; (2) a vehicle issued to a disabled person by the Department of Health and Social Security in lieu of an invalid carriage; (3) a vehicle left by the driver thereof, who is a person who on account of his severe physical disability has been given a notice in writing by the Council that he is exempt from any such charge if the notice is displayed on the vehicle in a conspicuous position; (4) a vehicle which displays in the relevant position a disabled person's badge: (5) an authorised user's vehicle which displays in the relevant position an authorised user's badge issued by the Council pursuant to an application by the authorised user to the Council. Provided that, in the case of (1), (2) and (4), an invalid carriage or vehicle has been left by a driver who is a person suffering a severe disability and in the case of (5), the vehicle has been left by an authorised user in the course of the authorised use. 24. If at the time when a vehicle is left in a parking place during the hours referred to in column 4 of Schedule 1 there is no ticket machine at that parking place or all the ticket machines at that parking place carry notices placed upon them by a person duly authorised by the Council indicating that they are out of order the driver of that vehicle shall be exempt from payment of the charge. 7

Removal or alteration of the position of a vehicle 25. Any person removing or altering the position of a vehicle by virtue of Article 17 of this Order may do so by towing or driving the vehicle or in such other manner as he may think necessary and may take such measures in relation to the vehicle as he may think necessary to enable him to remove it or alter its position, as the case may be. 26. When a person removes or makes arrangements for the removal of a vehicle from a parking place by virtue of Article 17 of this Order, he shall make such arrangements as may be reasonably necessary for the safe custody of the vehicle. Closure of car parks or parts thereof and setting aside of parts of car parks for specific use 27. Notwithstanding the provisions of this Order or any part or parts thereof the Council may: (1) close any parking place referred to in Schedule 1 or any part or parts thereof as and when it so requires for the purpose of County Council meetings or similar, or other events deemed by the Council to be valid reasons for closure and in such case the Council will not be required to provide a holder of a valid season ticket with a refund of any part of the season ticket charge paid in advance for the period of closure Provided nevertheless that the Council may at its discretion provide a holder of a valid season ticket with a refund of the said charge relating to any period of closure which shall exceed a period of seven days in any one quarterly period; (2) set aside permanently or for such period or periods of time as it thinks fit any part or parts of the parking places referred to in Schedule 1 for use by such persons or organisations as the Council may at its dis cretion from time to time designate so that during such periods those persons or organisations so designated may be granted exclusive rights of use for parking and may be relieved of any charges or time limits otherwise applicable by this Order; (3) set aside permanently or for such periods of time as it thinks fit any part or parts of the parking places referred to in Schedule 1 for the use by vehicles or classes of vehicles specified by the Council, including (but without prejudice to the generality of the foregoing), coaches, lorries and taxis or any particular types or descriptions thereof. During such periods vehicles so designated may be granted exclusive rights of use for parking and may be relieved of any charges or time limits otherwise applicable by this Order. (4) from time to time issue the following categories of permit: (a) Annual - restricted to a particular parking place or places (b) Quarterly - restricted to a particular parking place or places (c) Daily - restricted to a particular parking place or places - to use one or more of the parking places referred to in Schedule 1.
