Forsyth County Planning and Community Development January 3, 2014 Legacy Senior Services, LLC 2232 Candies Lane, NE Cleveland, TN 37312 RE: ZA #3651 Rezone from: Agricultural (A1) to Office and Institutional (O&I) Tax Map: 037 Parcel Number(s): 008 & 012 Acres: 5.47 To Whom It May Concern: This is to confirm that at their regular meeting on December 19, 2013, the Forsyth County Board of Commissioners approved the rezoning request to rezone from Agricultural (A1) to Office and Institutional (O&I) with a Conditional Use Permit (CUP) for the purpose of a senior housing, assisted living facility with the following variance and conditions. VARIANCE: 1. Increase the maximum gross square footage per business establishment to 59,000 square feet (UDC Chapter 12-7.3, Table 12.2). CONDITIONS: 1. Developer to connect to Forsyth system by gravity sewer. 2. It would be the responsibility of the developer to acquire any necessary easements to connect to public sewer. 3. Sewer access must be provided to all upstream properties. 4. Sewer capacity is not guaranteed for this property. All sewer capacity agreements must be approved by the Forsyth County Board of Commissioners. 5. Developer shall design and construct left turn lanes on Post Road (S.R. 371) for the proposed full access entrance to the subject property and for the southernmost entrance to Dressage Way. Lanes must be completed before any building permits are issued. 6. Exteriors of the buildings constructed on the subject property must be of brick, stone, hard-coat stucco, or a cement-based material such as, but not limited to, hardi-board, and may have accents such as, but not limited to, hardi-board, copper roofing, cement or cedar shakes, not to exceed 25 percent (25%) of the respective façade. For purposes of calculating façade area and required building materials, windows, doors, openings, and roofing will be excluded from such calculations. No commercial deliveries or garbage pick-up will occur between the hours of 9:00 PM and 7:00 AM. 10. Outside construction shall be limited to the hours of 7:00 AM to 7:00 PM Monday to Friday; 8:00 AM to 6:00 PM Saturday; and there will be no outside construction on Sunday. 11. Street lights, amenity area lighting, and lighting for non-residential uses shall be designed so as to minimize light spillage along the exterior of the development to not more than one (1) foot-candle along any residential or agricultural property line and two (2) foot-candles at any public street rightof-way, commercial, or industrial property line. 12. The subject property must be used as a senior housing facility, with no more than 63 units, with no more than 100 beds. 13. If requested within one year following the issuance of a certificate of occupancy for the project, in writing to the developer, by the owner of Tax Parcel 037-011 (currently owned by Harold Pruitt) or by the owner of Tax Parcel 037-242 (currently owned by Henry L. Williams), the developer will install a row of evergreen trees along the requesting property owner s road frontage on Post Road, in a location that does not conflict with utilities. Such evergreen trees will be selected by the requesting property owner from the overstory or understory trees listed in the Forsyth County Buffer Standards, and such plantings will be installed in accordance with the Forsyth County Buffer Standards.
