ATS Diesel Performance warrants to the original purchaser that any items purchased shall be covered for defects in material and/or workmanship. ATS reserves the right to determine the course of action regarding repair and/or replacement of any and all warrantable products. Entering into this contract, the purchaser accepts there will be no refunds for products installed or used in any way. Any refund or compensation for unused product is at the sole discretion of ATS. All decisions made by ATS are final. In the event of a warranty claim, all warrantable products must be returned, prepaid, with a complete service history and proof of purchase (date/invoice). ATS must have on file a completed Warranty Registration Card for the product in question. A valid proof of purchase is a dated bill of sale. Repaired or replaced product will be returned to the customer freight collect. Accepted warranty units, which have been replaced, become the sole property of ATS. In the event of a Warranty repair or replacement, product warranty period continues from the original date and vehicle mileage of the original purchase of the product. Warranty is not extended or renewed on repaired or replaced products. This Warranty shall be nullified and ATS shall be relieved from any responsibility or liability under this warranty on any product for which required cores have not been returned to ATS within the allotted time (most items are 20 days). This Warranty shall be nullified and ATS shall be relieved from any responsibility or liability under this warranty on any product for which invoices carry an open balance; i.e.: all bills must be paid in full and all cores must have been returned before warranty replacement or repair will even be considered by ATS. ATS Automatic Transmissions ATS automatic transmissions carry a 3-year/150,000 mile warranty. All labor, shipping or any other charges associated with the transmission and the transmission failure are not covered under warranty. Labor and/or shipping charges will not be refunded under any circumstance. After the one-year anniversary date of the original purchase, there is a limited parts replacement warranty only. In the event of a transmission failure, the defective transmission must be returned to ATS for inspection before any replacement transmission is sent to the customer. After the transmission is inspected by ATS and the failure analysis is completed, the inspection officer at ATS will provide written documentation stating the condition of the transmission and determine, to the best of his or her ability, what caused the malfunction or complaint. Based on the findings of the inspection report, a decision will be made as to the validity of the warranty claim. In the event of clutch pack failure, see Clutch Pack Failures below. In the event the customer requires immediate service and chooses not to wait for their transmission to be returned to ATS for inspection, service, and potential repair or replacement, a replacement transmission can be purchased for the full current MSRP of the transmission, plus applicable core charge, and bi-directional shipping. When the defective transmission arrives at ATS, the core charge will be refunded to the customer, and the transmission will be inspected. During inspection, the transmission will be assessed for warrantable damage. If the transmission has failed under the terms of the original warranty contract, ATS will refund the full purchase price paid by the customer for the replacement transmission. In the event the transmission has failed due to any issue not covered under the original warranty contract, charges will be assessed based on parts required to return the transmission to nominal ATS standards. The total cost of required parts is deducted from the purchase price paid for the replacement transmission, and the customer will be refunded the difference (if any) between the purchase price paid for the replacement transmission and the cost of parts required for repair. In the event of clutch pack failure, see Clutch Pack Failures below. In the event the customer can wait for their transmission to be returned to ATS for inspection, service, and potential repair or replacement, the customer pays bi-directional shipping of the transmission. When the defective transmission arrives at ATS, the transmission will be inspected. During inspection, the transmission will be assessed for warrantable damage. If the transmission has failed under the terms of the original warranty contract, ATS will repair or replace the transmission, at ATS s discretion. In the event the transmission has failed due to any issue not covered under the original warranty contract, charges will be assessed based on parts required to return the transmission to nominal ATS standards. The total cost of parts required for repair of the transmission, and bi-directional shipping, will be billed to the customer prior to the repaired/replaced transmission being sent to the customer. In the event of clutch pack failure, see Clutch Pack Failures below. Clutch Pack Failures Non-Extreme Transmission clutch pack warranty: Any clutch pack failure resulting from abuse or over torque will not be covered under this warranty policy regardless of warranty term period coverage. Shipping, labor or any other damage occurring is not covered. The product/service warranty shall terminate at the end of the 3-year anniversary date from the time of original purchase, or 150,000 original miles (whichever occurs first). The first anniversary date is defined as one year after the original date of purchase or at 50,000 miles (whichever occurs first); the second anniversary is defined as two years after the original date of purchase or 100,000 miles (whichever occurs first); the third anniversary is defined as three years after the original date of purchase or 150,000 miles (whichever occurs first). Every year or 15,000 miles (whichever occurs first), routine service must be performed and documented (using forms attached to the end of this document) by a qualified automotive repair shop. How the ATS product was installed and serviced will determine the warranty criteria: 1. If the ATS product was installed by an ATS Authorized Dealer (go to http://www.atsdiesel.com/ ATSWebsite/ FeaturedDealers/ATSDealerMap.asp for a current listing of ATS Authorized Dealers), labor (up to $50 an hour, using the warranty repair line from the Mitchell Labor and Repair Estimating Guide), normal ground shipping, and parts costs incurred during the removal, repair, and/or replacement of an ATS product while undergoing warranty work, will be covered through the first anniversary of warranty only, based on ATS discretion, at an ATS Authorized Dealer with prior ATS written approval containing an ATS RMA (Return Merchandise Authorization) number. If the ATS product was not installed by an authorized dealer, ATS will cover parts costs only for a total of 3 years or 150,000 miles (whichever occurs first) from the original date of purchase.
