French regulatory environment Annex III - Decree of 29 April 2009 laying down the procedures for implementing the provisions of the Highway Code concerning damaged vehicles for passenger cars and light trucks: «Assuming that second-hand parts will be used after agreement of the owner and the expert, the latter defines the methodology of bringing the parts into compliance and estimates the cost of the work required on the vehicle, jointly with the repairer.» It is a first step to «democratising» the use of secondhand parts in repairs following a car accident. 4

French regulatory environment Section 77 of Act No. 2015-992 of 17 August 2015 on the energetic transition for the green growth has amended the Consumer Code by including measures on secondhand parts: Article L. 121-117 of the French Consumer Code «All professionals who buy repairing performance of automotive vehicles let the consumers opt for the use of certain category of parts of circular economy in place of new parts» Obligation to communicate «A decree in Council of State lists the relevant categories of second-parts parts and gives the definition of circular economy automotive parts, for the purpose of this article. It also defines the conditions under which the professional is not required to offer these parts because of their unavailability or other legitimate reasons.» 5

French regulatory environment Article L. 121-119 of the French Consumer Code «Failure to comply (...) is punishable by a fine that should not be exceeding 3,000 for an individual and 15 000 for a corporation.» Second-hand parts from authorised dismantlers are considered as circular economy automotive parts. 6

What are circular economy parts? Art. R. 224-24 of consumer code * Circular economy parts are : Second hand parts produced by the ELVs ATF sites only The renovated parts 7

What is concerned? Art. R. 224-22 of consumer code* The decree is applied to every maintenance and repairing act of vehicles and small trucks under 3,5 tons Both repairing and salvage At this end, there is a compulsory communication that should be done to every consumer on the existence of circular economy parts. Nevertheless nothing prevents any professionals to propose circular economy parts to motorcycles and trucks. 8

What kind of parts are under the obligation of communication? Art. R. 224-25 of consumer code* Are concerned: Body parts ; Lining parts and saddlery; Glazing ; Optic parts; Mechanical and electronic parts, except the ones part of : - Wheel sets - steering parts - brake systems, - suspension, tyres, elements that are gathered, submitted to mechanical wear and that can not be dismantled.. Nevertheless, all the second hand parts can be proposed to consumers, if the garage think it technically and economically wise. There is no parts forbidden to be reused!!! 9

When is the garage not obliged to propose Circular economy parts? Art. R. 224-23 of consumer code* 3 situations : When the cars are repaired freely, under commercial warrenties, or in case of recall; When the Circular Economy Parts are not available in the compatible time for the repairing; When the garage think there is a risk for the environment, public safety end road security. 10

It is also in the air because The insurance companies have a leading process In the framework of its sustainable development liability, MAIF has decided to reduce their environmental footprint : The bodyworkers partners of the company are encouraged to repair first before to replace some parts like windscreens and bumpers. When there is no solution but to replace, the automotive experts and the repairers are sensibilised to the second hand parts Finally, Maif has concluded contracts with ELV ATFs to make a network to tace care of the strongly salvage cars and elvs fot their recycling. The repairing with second hand parts is now included in the insurance police contracted with the consumer. 12

Allianz Proposes a contract called «Solution Auto Durable» (sustainable car solution) that previews in your contract the use of second hand body parts to allow you to keep your vehicle instead of recycle it. 13

In total, this has meant a saving of just over 143 million euros in the past 15 years 14

One argument is that using brand new part to repair a car creates additional CO2 emissions that could otherwise be avoided. 15

Our next lobbying action The interdiction for private people and non ELVs sites to publish parts on commercial websites and oblige the ministers to make this obligation respected. We want the references of ELV sites on every offer for warranty. (cf. DGCCRF / service.public.fr). 17
