ASSOCIATION RULES Revised 8/08/15 In the interest of safety and well being of each member of the Pocono Ranch Lands Property Owners Association, the following Rules have been set down and are to be observed by every member of the Association, their guests and renters. Each member is responsible for the activities and conduct of his/her household, guests and renters, and any infractions of rules with subsequent assessments, if any, will be charged to the member subject to a hearing of the Grievance Committee, if requested. The Association reserves the right to refuse admittance to or to eject from any common property any person or persons failing to comply with any of the Rules. These Rules are for the health and safety of all. Pocono Ranch Lands Board of Directors has delegated the authority to enforce Association rules to the Public Safety Department and the Construction Administrator. Assessments for violations of these Rules are contained in Schedule S. RECREATIONAL FACILITIES: RULE 1 No one is permitted to use any of the recreational facilities without current recreational badges. It is not permissible for members in good standing to give their passes to those not in good standing and their guest. RULES FOR THE CLUBHOUSE: RULE 2 a. The Clubhouse hours will be posted. b. The Clubhouse Rules will be posted c. Everyone using the Clubhouse and the grounds is expected to clean up after themselves. d. No pets will be allowed inside the Clubhouse grounds at all. e. Smoking is not permitted. RULE 3 RULES FOR THE TENNIS/HOCKEY/ALL PURPOSE & BASKETBALL COURTS: a. Playing time will be one hour. If no one is waiting, play may continue until someone comes; players then must finish game as soon as possible. b. Courts will be kept neat and clean by players. RULES FOR THE SKI AREA: RULE 4 a. Ski hours will be from 9AM 4PM. Ski Patrol will be in charge during these hours. b. Ski Area rules will be posted. c. Smoking is not permitted in the Chalet. 1

RULES FOR THE POOL AREA: RULE 5 a. Pool hours will be posted. b. Pool rules will be posted. c. The lifeguards are in charge of the pool area at all times. d. No food or drink will be allowed outside the designated areas. e. No one under the age of 12 is permitted without adult supervision or a guardian at least 16 years of age. (revised August 2005) RULES FOR THE STABLE AREA: RULE 6 a. Stable hours will be posted. b. Stable Rules will be posted. c. Stable personnel are in charge of the Stable Area at all times. d. Trail rides will be booked ONLY ON THE DAY OF THE TRAIL RIDE, and will be on a first come, first served basis. e. Smoking is not permitted. VANDALISM: RULE 7 Vandalism or misuse of facilities is prohibited PETS: RULE 8 Must have a current Pocono Ranch Lands tag and be kept under control at all times. DOGS: Must have a current State license and Pocono Ranch Lands tag. Dogs must be leashed at all times on common property. Unattended dogs will be turned over to the Dog Warden and owner will be subject to assessment. Excessive barking or yelping will not be tolerated and owner will be subject to assessment. HUNTING: RULE 9 (Amended effective 08/08/09) NO HUNTING OR TRAPPING of any kind is permitted anywhere in Pocono Ranch Lands. RULE 10 DRINKING: Consumption of alcoholic beverages by minors on common use properties is prohibited. 2

FIRES: RULE 11 (Amended 8/23/14) All fires within PRL must follow Lehman Township Burning Ordinance with the exception of camp fires, which will be permitted, but which will fall under the following rules: Area designated for the fire must be cleared of all leaves & brush. Fire must be enclosed by a non-combustible substance (i.e.: rocks, blocks, or other nonflammable material). All camp fires require a responsible adult be present at all times. Homeowner is solely responsible for all campfires that take place on their property. There must be a garden hose, fire extinguisher, or other water supply with sufficient quantity to control the fire, readily available. There are to be no camp fires if an active Burn Ban is in effect. There are to be no camp fires during periods of extreme wind. MOTOR VEHICLES: RULE 12 A. Any conduct that would constitute a violation under the PA State Motor Vehicle Code would be considered a violation here in Ranch Lands, including but not limited to the following: Exceeding the posted speed limit <> The posted speed limit on all Pocono Ranch Lands roads is twenty-five (25) miles per hour. <> The Pocono Ranch Lands Public Safety Department is authorized to use mechanical, electrical or electronic devices to measure the speed of motor vehicles (including ATVs) for the purpose of enforcing the speed limit. failure to stop at stop signs failure to yield at yield signs careless driving failure to yield to emergency vehicles endangering the safety of working crews failure to show proof of insurance to a Public Safety Officer failure to show proof of registration to a Public Safety Officer failure to show a valid drivers license to the Public Safety Officer parking in handicapped space following too closely reckless driving improper passing passing a school bus failure to use turn signals operating an unregistered vehicle operating without a current inspection unlicensed driver. B. No vehicle shall be parked on any road or street within Ranch Lands so as to impede traffic flow and/or snow removal. 3

RULE 13 USE OF MOTORIZED RECREATIONAL VEHICLES: a. All ATV s, Go Carts, Dirt Bikes/Mopeds, Golf Carts, snowmobiles and scooters must have a current title, registration, proof of insurance and Pocono Ranch Lands license plate displayed. b. Pennsylvania Vehicle code chapter 77, subchapter C; prohibits the operation of ATV s by persons under 10 years of age. No one under 10 years of age can operate Go Carts, Dirt Bikes/Mopeds, Golf Carts, Snowmobiles or Scooters. Additionally, for those persons between the ages of 10 and 16, the operator must have taken the prescribed safetytraining course and be in possession of a valid safety course certificate approved by Public Safety that is mandated by federal law, which the operator must produce upon request. c. Operation of any vehicle upon the lands of another person without permission is prohibited. All individual lots in Ranch Lands are lands of another person. d. Hours of operation are 10:00 AM UNTIL 10:00 PM. e. All vehicles will abide by all posted speed limits and rules pertaining to motor vehicles. f. Vehicles may be used after dusk as long as the vehicles are fully equipped for night driving, which includes working headlights, taillights and brake lights. g. All recreational vehicles will be equipped with properly operating mufflers. h. Anyone operating an ATV, Go Cart, Dirt Bike/Moped, Motorcycle, Snowmobile or Scooter must have a securely fastened helmet on the driver and passenger. Street legal motorcycles must comply with Pennsylvania State Law. i. Any of the above vehicles that are not equipped or designed by the manufacturer to ride two people are prohibited to do so (this is to include personal or manufacturer nonauthorized modifications for multiple rider ship). j. An operator of a motorized recreational vehicle, who receives three (3) citations for moving violations within an eighteen (18) month period, shall be suspended from operating any motorized recreational vehicle of any type for a period of one (1) year. If an operator who is suspended under this Paragraph operates a motorized recreational vehicle of any type during the 12 month period of suspension, said operator shall be forever banned from operating a motorized recreational vehicle of any type within Pocono Ranch Lands. (Item # J added March 2007) k. All STV s, go-carts, dirt bikes/mopeds, golf carts, snowmobiles and scooters are to be used for driving from point A to point B. They are not intended to be used for going back and forth, up and down continuously, causing a public inconvenience or a nuisance throughout the community. (Item #K added August 2015) REFUSE: RULE 14 All members are responsible for disposing of their own household refuse in such a manner that there will be no pollution of our environment. a. Designated Association trash barrels are NOT to be used for private refuse. The compactor and recycle areas are for the use of the Ranch Lands Homeowners only. b. There is to be NO littering anywhere on the property. c. All Association facilities, e.g., pool, parking areas, roads, rest rooms, picnic areas are to be left clean. 4

d. There is no dumping of bulk items allowed. Property owners must make their own arrangements for bulk items. Anyone found illegally dumping bulk refuse (anything other than household trash) will be assessed a $100.00 assessment. CLOTHESLINES: RULE 15 Shall not be hung or erected in front of any property. STORAGE SHEDS: RULE 16 Shall be constructed of such material and erected in such a manner so as not to detract from the esthetic or natural setting of property. EXTERIOR LIGHTING: RULE 17 All exterior lighting, including but not limited to vapor and/or halogen lamps, must only illuminate the property owner s and/or homeowner s property and must not be intrusive to any other private or common property in any way. RENTAL OF HOMES: RULE 18 (Amended effective 9/13/14) A. Long term rentals: Homeowners who rent their homes for a period of more than a one-month term are required to notify the office of the term of the lease and the names of all persons who will reside thereat. The owner shall be responsible for the acts of its tenants, which violate the Rules of Pocono Ranch Lands Property Owners Association. In the event a tenant violates a rule or commits an act, which results in the expenditure of funds by the Property Owners Association, the owner shall be liable for such expense by way of a special assessment, which may be assessed by the Grievance Committee. All rentals for a period of more than one month will require the owner and tenant to agree in writing to the provisions of this section. B. Short-term rentals: All short term rentals (30 days or less) require registration at the office prior to the beginning date of the rental. Property owner shall be held responsible for all activity conducted at the property. Rentals must be contracted with a responsible tenant, who is at least 25 years of age. In compliance with the Association Rules, all vehicles must be parked within the confines of the rental property, as there is no parking allowed on the roads. During the rental period, if a party is being held on the property, the following procedures would be required: 5

Public Safety must be notified of the date, time and number of guests that will be in attendance. A special access gate code will be given for use by attendees of the event. Property Owner will be held responsible for all activities during the function. Party activities should not be disturbing to the neighbors. A yearly Rules Compliance Security Deposit, in the amount of $300, would have to be paid by the Property Owner by the 1 st of the year, and replenished as needed. RULE 19 (Amended effective 11/10/07) Construction, contractors and delivery of materials must conform to the following hours and dates: (amended Nov 10, 2007) New home construction is NOT allowed on Saturdays or Sundays. SPRING AND SUMMER: Weekdays <> Section 1, 2, 3, & 5: from 8 AM to 6 PM Section 4: from 9 AM to 6 PM *Saturdays <> 10 AM 5 PM (No new home construction) ** Sundays <> 10 AM 5 PM (Homeowners only No contractors) Holidays <> NONE (See Rule #11 for list of holidays * None on the second Saturday of July Annual Picnic FALL AND WINTER: Same as above but Construction Hours end at 4:30 PM (Amended Nov. 10, 2007) The Association office must be notified at least 24 hours prior to delivery of modular homes. Special arrangements must be made for gate entrance. Delivery hours are 8 AM 6 PM, (Section 4 9am 6 pm) Monday through Friday only RULE 20 A) Removal of living trees or disturbance of any other vegetation or rocks in the set back areas (front, sides and rear) is discouraged, except for driveway and water line crossings of the front set-back. Rotten trees may be removed. B) Landscaping shall emphasize the rural woodland character of the community. Maximum use of native trees and vegetation shall be made; removal of such shall be minimized. Native, rather than specimen trees or bushes, are encouraged. RULE 21 Bulk LP Gas tanks or fuel oil tanks must have landscaping so as to screen them from view from all road and neighboring properties. RULE 22 Painted rocks, painted trees and painted tires are to be discouraged because of their effect on the rustic ambiance of the community. 6

DISORDERLY CONDUCT: RULE 23 A. Definition: any act of disorderly conduct, when such act causes public inconvenience, annoyance or alarm or creates a risk thereof, or which delays or disrupts or threatens the orderly conduct of Association business, upon or in any place owned or maintained by the Pocono Ranch Lands Property Owners Association. B. Enforcement: 1. An offended individual shall make complaints to a Public Safety Officer. After an investigation a citation may be issued. 2. A Public Safety Officer upon personal observation of any offense of this rule may issue a citation. 3. Delivery of the citation shall be immediate where possible. In other cases, written notification shall be given within ten (10) days following the violation. In the event of an appeal, the complainant (if any) must also appear before the Grievance Committee. RULE 24 FLEEING OR ATTEMPTING TO ELUDE A PUBLIC SAFETY OFFICER: A. It is prohibited for any driver of a motor vehicle to willfully fail or refuse to bring his/her vehicle to a stop, or other wise flee or attempt to elude a signal to bring the vehicle to a stop. B. The signal given by the Public Safety Officer may be by hand, voice emergency lights or siren. BUILDING PERMITS AND APPROVALS: RULE 25 All construction in Pocono Ranch Lands, whether new construction or additions to existing structures, requires approval of the Association prior to the start of construction. All work requires this permit whether it is being done by a contractor, a homeowner, or property owner. Included in this requirement are: replacing or enlarging a deck, building a new deck, screen porches, sheds, gazebos, large satellite dishes installed on the ground, bulk LP tanks, fuel oil tanks, swimming pools, fences. This permit is to be displayed along with the Township permit, if applicable. Assessment for violating Rule 25 (see Schedule S) DEPOSIT REQUIREMENTS: The deposits are required, whether the work is being done by the homeowner or a contractor. RULE 26 TAMPERING WITH SIGNS: Anyone found tampering with or removing emergency signs, road signs, stop signs or emergency house locator signs will be assessed a $500.00 assessment per sign plus the cost to replace the sign. Anyone providing information, which leads to a final community resolution will receive a $100.00 reward. 7

RULE 27 OVERNIGHT USE OF FACILITIES: There shall be no overnight use of any PRL facilities or common areas unless sponsored by the Recreation Committee (added 9/07) RULE 28 (Added 08/08/09) FIREARMS: The discharge of firearms of any type is prohibited anywhere in Pocono Ranch Lands except in the event of an emergency. RULE 29 (Added 08/08/09) RESTRICTIVE COVENANTS: Failure to comply with violation of restricted covenant notification of five days to correct violation, and on the sixth day you will be assessed $100.00, and $25.00 per day thereafter until compliance is met DISCLAIMER: Rule headings are for information purposes only and are not to be taken literally. The Assessment for a third violation of a specific rule will be double the amount of the assessment for the second offense. The assessment for any subsequent violations of a specific rule will be determined by the Grievance Committee. A one-time written warning for a first violation may be issued at the discretion of the Security Department. A second violation of that specific rule would then result in a first offense assessment as specified above. Chronic offenders of the Rules and By-Laws, with the exception of disorderly conduct violations, will be suspended from using any of the amenities for forty-five (45) days, after

three (3) citations have been issued. A ninety (90) day suspension shall be instituted for subsequent offenders. (addition 11/07) **For disorderly conduct violations, suspension shall be as follows: (addition 11/07) 1 st offense 45 day suspension 2 nd Offense 90 day suspension 3 rd offense 365 day (1 year) suspension If a suspended offender is found utilizing the amenities during suspension, he/she will be charged with defiant trespass along with whatever additional violations and fines are deemed appropriate.
