2 (1) Food Trucks, Trailers and Carts Vending from Private Property Permits: A Food Vending Permit is required from the Planning and Zoning Division, in addition to permits from Alameda County and Oakland Business Tax Division. Location: Food vending is allowed on private property in selected commercial and industrial areas, as shown on the permitted program areas map. Areas in West Oakland, North Oakland and downtown Oakland are now permitted for food vending, with certain limitations. Regular Hours of Operation: 7 a.m. to 10 p.m., daily. Late night vending: Permission for late night vending (past the regular permitted 10 p.m. limit to a time as determined by the City, not to exceed 3 a.m.) will be considered in the following areas: Downtown (including Jack London); Eastlake; Uptown; Fruitvale; and Central and east Oakland streets formerly in the permitted food vending area. Duration at site: Any duration during regular hours of operation. Required distance between two vendors:300 feet 1 Required distance from schools: 300 feet. Allowed with permission from OUSD Nutrition Services for selling healthy food.

3 Required distance from restaurants: 300 feet, measured to the restaurant entrance (with exception allowed if vendor receives written consent from restaurant owner) Fire Department Inspections: Fire Department permit and annual inspection required, if using liquid gas. Number of permits per operator: Up to four permits can be issued to one operator. Number of permits overall: Limited to 75 permits for private property locations and group sites, in first year. Fees: Fees in : Truck / Trailer Application Fee $200 Enforcement $700 Fire Inspection $339 TOTAL: $1,589 2

4 (2) Push Carts and Stationary Carts Vending From Sidewalks Permit: A Food Vending Permit is required from the Planning and Zoning Division Location: Food vending is allowed on sidewalks on selected commercial and industrial areas, as shown on the permitted program areas map Areas in West Oakland, North Oakland and downtown Oakland are now permitted for food vending, with certain limitations. Sidewalk Width: Preference for streets with at least 10 sidewalk width. Stationary/Roaming: Stationary and roaming Hours of Operation: 7 a.m. to 10 p.m., daily Late night vending: Permission for pushcarts and stationary carts for late night vending (past the regular permitted 10 p.m. limit to a time as determined by the City, not to exceed 3 a.m.) will be considered only in Downtown locations. Distance between vendors including food trucks: 300 feet. Distance from schools: 300 feet. Allowed with permission from OUSD Nutrition Services for selling healthy food. 3 Distance from restaurants: 300 feet, measured to the restaurant entrance (with exception allowed if vendor receives written consent from restaurant owner)

5 Clearances: See Administrative Guidelines 3b for clearance distances. Number of permits per operator: Up to four permits can be issued to one operator. Vending Types: New definition for Stationary Carts : Stationary cart means a type of non-motorized food vending facility that is typically larger than pushcarts; pulled or delivered by a vehicle into position; and stationary at a specific site during hours of operation. Pushcart is a type of non-motorized food vending facility that, because of its small size and operable wheels, can be easily moved by a single person during operation. This definition may also include a food vending facility integrated into, or pulled by a bicycle or tricycle. Insurance: Commercial General Liability (naming the City of Oakland as an insured). (Administrative Guideline 4e) Fire Department Inspections: Fire Department permit and annual inspection required if using liquid gas. Fees: Fees in : Application Fee $150 Pushcart Enforcement $500 TOTAL: $1,000 4

6 (3) Group Sites (i.e. Food Pods ) Permit: A Food Vending Permit is required from the Planning and Zoning Division. Location: Food vending is allowed on selected commercial and industrial areas, as shown on the permitted program areas map. Areas in West Oakland, North Oakland and downtown Oakland are now permitted for food vending, with certain limitations. Hours of Operation: Limited to five (5) hours of vending a day; Between 7:00am 10:00pm on any day of the week, when on public street right-of-way. No limit to number of hours when on private property. Minimum Number of Food Vending Facilities: Two (2) or more trucks, trailers, or other movable wheeled equipment or vehicles clustered together on a single site. Distance between two vendors/group Sites: 300 feet from another group site or individual food vendor, during hours of operation. Distance from schools: 300 feet. Allowed with permission from OUSD Nutrition Services for selling healthy food. 5 Public Street Right of Way: Parking meters will be paid during the event by the organizer (no pre-payment). If a street closure is required, an encroachment permit from the Oakland Police Department will be necessary.

7 Distance from restaurants: 300 feet, measured to the restaurant entrance (with exception allowed if vendor receives written consent from restaurant owner) Insurance: Evidence of: Worker s compensation (if vending facility owner has employees); Automobile liability (if the vending facility is a motorized vehicle); and/or Commercial General Liability (naming the City of Oakland as an insured). Maximum Number of Events, Per Organizer: Five locations; a separate permit is required for each location. Days of Operation: Limited to two days per week on public right-of-way. No limit to days of operation on private property. Proof of Consent from CBD/BID: Not Required. Fees: Fees in : Group Sites Application Fee $150 Enforcement $500 Fire Inspection $339 TOTAL: $1,339* *Encroachment (Right of Way), if necessary: $50 per event. 6

8 (4) Food Trucks and Trailers Vending from Street Right-Of-Way 7 Location: Food vending from trucks and trailers in the street right-of -way is alowed at 25 parking spaces citywide, pre-selected by the City. Each selected parking space would be signed and striped for food vending activities only during allowed days and hours of operation. Hours of Operation: Days and hours allowed at each parking space to be determined, based on input from the Dept. of Transportation, proximity to residences, and other factors. Duration at site: Limited to hours of operation; vendor applies for a permit to operate either: 5 days a week; 3 days a week, 2 days a week, or 1 day a week. Vendors will pay parking meters. Vehicles / Facilities: Motorized vehicles or towed trailers only. Distance from restaurants: Reserved vending spaces will be selected in areas that are generally under-served by existing restaurants. Insurance: Naming the City as an Insured. Fire Department Inspections: Fire Department permit and annual inspection required, if using liquid gas.
