3 (Consolidated up to 104/2016) ALBERTA REGULATION 95/2004 Environmental Protection and Enhancement Act TIRE DESIGNATION REGULATION Table of Contents 1 Definitions 2 Tires as designated material 3 Advance disposal surcharge 4 Lloydminster exemption 5 Expiry 6 Coming into force Schedule Definitions 1 In this Regulation, (a) Act means the Environmental Protection and Enhancement Act; (b) Association means the Association referred to in section 2 of the Designated Material Recycling and Management Regulation; (c) Bylaw means a Bylaw of the Association made under section 12 of the Designated Material Recycling and Management Regulation; (d) Minister means the Minister responsible for the Act; (e) supply means supply as defined in the Designated Material Recycling and Management Regulation; (f) tires means tires manufactured for the purpose of being used on the wheels of motor vehicles, trailers, tractors, implements of husbandry, off-highway vehicles, equipment or machinery.

4 Section 2 TIRE DESIGNATION REGULATION AR 95/2004 Tires as designated material 2 Tires are a designated material for the purposes of Part 9, Division 1 of the Act and the Designated Material Recycling and Management Regulation (AR 93/2004). AR 95/2004 s2;230/2010 Advance disposal surcharge 3 The maximum advance disposal surcharge that may be prescribed for tires under the Designated Material Recycling and Management Regulation (AR 93/2004) is the relevant amount prescribed in the Schedule. AR 95/2004 s3;230/2010 Lloydminster exemption 4 This Regulation does not apply with respect to the supply of tires in the City of Lloydminster. AR 95/2004 s4;140/2014 Expiry 5 For the purpose of ensuring that this Regulation is reviewed for ongoing relevancy and necessity, with the option that it may be repassed in its present or an amended form following a review, this Regulation expires on June 30, AR 95/2004 s5;64/2014;97/2015;104/2016 Coming into force 6 This Regulation comes into force on June 1, Schedule Maximum Advance Disposal Surcharges For Tires CATEGORY OF TIRE MAXIMUM SURCHARGE 1. Medium Truck Tires: Tires with rim sizes greater than 19.5 inches for use on larger vehicles licensed for highway use (including semi-trailer transport trucks, buses and trailers) $9 2. Industrial/Off-the-Road (OTR) Tires: Tires used on industrial (non-agricultural) vehicles or industrial non-agricultural equipment that are not licensed for highway use (including excavation, hauling, loading, logging and 2

5 Schedule TIRE DESIGNATION REGULATION AR 95/2004 materials handling equipment): (a) small OTR Tires, with rim sizes up to 24 inches $40 (b) medium OTR Tires, with rim sizes greater than 24 inches but not greater than 33 inches $100 (c) large OTR Tires, with rim sizes greater than 33 inches $ All other tires (including passenger car and light truck tires, all other tires for vehicles licensed for highway use, all-terrain vehicles tires, forklift tires and skid-steer (Bobcat) tires) except farm tires used on agricultural vehicles, agricultural implements and agricultural equipment that are not licensed for highway use $4 AR 230/2010 s4 3
