11 ك Abstract I addressed in my research that guarantees discipline the public employee, where I studied these guarantees in the light of all of the Law on Civil Service Kuwait No 5 of 979 and the civil service system Jordanian No 0 of 007, has preface this study the first chapter, which dealt with the background issue of guarantees for the disciplining of an employee of the year The second chapter came under the title of the year and its relationship to the employee in the administration, the establishment on this subject has been at odds in the jurisprudence and the judiciary on the nature of the relationship between employee and management, where the view was expressed that the relationship between employee and management contractual relationship governed by private law While he went second opinion that the relationship between employee and management contract governed by public law There is the opinion of a last resort went to the relationship between employee and management organizational relationship, based on those views have been studied to this chapter through the statement of the definition of public employee input to determine the truth of what is the nature of relationship with the public employee in the Department a detailed capricious around ideas about the theory of ideological and organizational theory to answer the question that we raised to indicate the nature of the relationship with the public employee in the administration and update of that came in this chapter to study the duties of the public employee, where we found the need to find out what is contrary to such duties as those offenses are grounds to subject the public employee to disciplinary action leading to the rhythm of a disciplinary penalty on it The third chapter is titled elements of discipline, I have the text of the legislature of Kuwait and Jordan on a set of obligations incumbent on the employee as the text of a set of measures that would ensure that the employee in his or her duties to the fullest, which is to be met, but the presence of these duties without associate sanctions means the transformation of the legal obligations to only the duties of a literary and moral does not exceed a penalty violates remorse for failure to do duty, as a penalty is necessary for a public employee work it is necessary to have a variety of means that are committed to apply the public authority in terms of followers of the disciplinary procedures of each in order to achieve orderly functioning of the facility year and therefore has been the study of this chapter from several directions the first statement of the violation of the disciplinary terms of its definition and the statement of its elements and types of all of this came as decided by the legislatures of Kuwait and Jordan in the center of the second was a statement by the competent
12 ل authorities to follow the disciplinary punishment which systems were somewhat different between legislatures and in place of the study showed about a third axis is the disciplinary punishment and the principles that govern the rhythm The fourth chapter came under the title guarantees disciplinary principles stable it is that the disciplinary authority has the power to choose disciplinary action to be harming the public employee of the disciplinary sanctions set forth now the legislature and the judiciary may be accorded a public official with a number of guarantees during tough questions disciplinary order to show the truth and to achieve justice in the absence of availability of the disciplinary decision of the signing of disciplinary action is subject to appeal and given the differences authorities the appropriate disciplinary discipline in Jordan and Kuwait, we found that there are some differences in the Adoption of guarantees disciplinary, which came on the following division in proportion to the actions taken by the authorities of discipline leading to of punishment and therefore guarantees that our search by Division the following: Guarantees of the previous rhythm of discipline and disciplinary punishment was the most important safeguards in the investigation stage, the guarantee against the employee of what is attributed to him, the right to defend himself, and impartial disciplinary authority, and there are guarantees of sync and rhythm of disciplinary punishment was as follows: Sentence in the text of legislation, and no duplication of disciplinary punishment, the disciplinary cause, proportionality between the punishment and guilt management, and rhythm forthcoming guarantees the punishment puts his administrative appeal and judicial appeal And finally to the fifth chapter, which provided conclusion and my conclusions and recommendations that I hope the legislature introduced and May God have helped me and in the provision of this humble research
