1 TERMS OF USE FOR THE ELECTRIC BIKE SHARING SYSTEM OF PUBLIC BIKE SYSTEM HUNGARY 1. Introducing the system The electric power assisted bike and e-roller rental system of Public Bike System Hungary Ltd. allows the citizens of Kaposvár, the students of the city, and all who come to work from surrounding villages to reach their destination in the city faster, easier and cheaper. The bike rental system operates with electric power assisted bicycles and e-rollers. The system has been designed according to the most recent European innovations and complies with the standards of regulation EN The "Kaposvári Tekergő" system is currently operating with 4 stations (know more about locations: with a total of 48 docking stations, 26 e-bikes, and 6 e-rollers. The stations and the docks are operating with ONLINE Internet connection. ONLINE SIGN UP: 2. Elements of the bike rental system 2.1. Station The station consists of the docking stations, the electric bicycles and the e-rollers. It is connected to the dispatch center. The station is the location for rental and return.

2 2.2. Docking station The device responsible for storing and dispensing the Public Bike System e-bike and e-roller located at the rental station. Its elements include the card reader, the lock and the LED light source. The docking station is connected to the dispatch center via internet Card reader The card reader is located at the front surface of the terminal which is indicates the status of the terminal with an LED display Public Bike System e-bikes and e-rollers Custom-designed, electric power assisted bikes owned by Public Bike System Hungary Ltd. which only consist of custom parts. Their frames and parts are unconventional, their seats cannot be removed. Equipped with large surface front and rear mudguards, rear luggage boxes and reflective tapes, run flat tires and constant lighting. Apart from the electric power assistance their use is further assisted by the Shimano NEXUS 3-gear transmissions built into their hubs. Furthermore the e-roller is also a custom-designed and power assisted wehicle which can be used in standing and sitting postion as well. After picking up the e-roller it is ready to use and by turning the gasgear it is immediately ready to start. The battery level can be seen at the right part of the wheel. Under

3 this indicator, a red button is serving to control the power of the battery. When the user turns off the red button he/she can save energy for the battery. The e-roller can not be used under the age of 14. Both wehicles may be used by assumeing all risks. The electric bike's range is max. 70 km! The e-roller has a range of max. 20 km! 2.5. RFID card The RFID card or the Kaposvár Card which was uploaded with the service system, will allow access to the e-bike and e-roller rental.

The information panel allows the user to remove the vehicle from the station with a code. In addition, the user may get information about the destination stations nearby, the capacity and also can get information and opportunities provided by the city Alternative energy (solar energy) and survillance camerathe energy supply can be easily produced from renewable energy sources by the solar panels. To ensure the safety of the bike rental, the stations are equipped with motion sensors infrared cameras. This camera is sending the live pictures to the dispatcher center as soon as some motion is detected in the station area.

5 2.9. Dispatch center The call center located in Pécs, Baranya cunty which is constantly connected to all stations via computer and is continuously online. It records and verifies the start and end times of the Public Bike System e-bike rentals, as well as their placement into and removal from the docking stations. It is responsible for the appropriate distribution of e-bikes on the docking stations and for managing the maintenance of docking stations and e-bikes. It furthermore assumes all responsibilities that are necessary for the proper functioning of the system Logistics team Responsible for the equal, manual distribution of e-bikes among the stations User Registered user who is personally being granted permission for using the bicycle and roller rental using their personal documents at the Kaposvár Tourinform office located at 8. Membership for the electric community bike rental system of Kaposvár may be granted to all persons 14 years of age and above who have their place of residence in Kaposvár; students 14 years of age and above studying at a school in Kaposvár who possess a valid student ID; as well as employed persons who commute to their workplace in Kaposvár on a daily basis regardless of their permanent address. The eligibility has to be verified using credible evidence Tourist and occasional user All temporally visiting persons tourists or occasional users may make use of the rental system by paying the rental fee. The acquisition of such a ticket is described in point Public Bike System Hungary Ltd. The Public Bike System Hungary Ltd. deals with the maintenance, operation and management of the Kaposvári Tekergő bike sharing system also PBSH Ltd is the owner of the stations, bicycles and scooters Terms of use Menas this terms of uses and conditions Rental time Rental starts by removing the bicycle or the e-roller, from the docking station and ends by placing it back in it. The e-bike can be picked up at any station and can be placed back at any station.

Registration Useful information before registration ONLY Registered users can use the Kaposvári Tekergő bike sharing system, because the system needs to identify the userat the docks (with a card or a PIN code). The current station s central controller checks the validity of the customer s card or PIN code, only after this delivers the signal to the dock. For authorized users the lock is going to be open and the bike can be used. For unauthorized users the docking will reject the request! User groups: o Kaposvár card holders o CityeBike Kaposvár card holders o Toursit/ Occasional (online) users of Kaposvár Tourists and occasional users can register online. This is the fastest way to get a bike from the dock (available from 1 st of November, 2016). Also at the card saller points can they buy access to the system During the registration process the following data have to be given: Surname (surname of the registering user) First name (first name of the registering user) Address (address of the registering user) Phone number (a phone number by which the registering user can be reached; a mobile phone number if possible. Its format: using a two-digit country code i.e.: ) address (valid personal electronic mail address / /) ID number (ID number of the registering user) Datas of birth (place and date of birth of the registering user) Student status (student ID proving student status of the registering user in Kaposvár) Certified statement of work (certified statement that proves the employment relationship of the registering user if not a resident of Kaposvár) 3.2. Personal registration It is possible to register personally at the Kaposvár Tourinform office located at 8. Fő u. Kaposvár, 7400, phone: , fax: (opening hours: 15 th June 31 st August: Mo-Fr , Sa: , Su: as well as 1 st September 14 th June: Mo-Fr: , Sa: ), where users who would like to register are being served within opening hours. Using a personal registration it is possible to pay in cash as well as using a card. It is also possible to register in Fekete István Visitor Center at Deseda ( ), (opening hours: April 1-October 31 between Mo-Su , October 31-April 1 between except Monday every day). At the Fekete István Visitor Center you may only pay in cash.

7 3.3. Registration online It is also possible to register online for the tourist/ occasional users at the following website: This site is available at the touch infopoints at the stations or from the PCs from home or from the user s smart phone User registration After entering the correct data, the system creates a user account and sends the corresponding password to the user's address. It is important to give a VALID address, as the confirmation will be sent there from the system Login With combination of the address and password, it is possible to log into the system.

8 Pick up a bike After login, the system displays the user's basic information and displays the current balance. If the user does not have balance the following image is displayed. The balance can be uploaded at the "Upload your Balance" menu and after the user can pay via credit card or at our Barion account site.

9 Payment system The Public Bike System Hungary applies the payments system of Barion, where it is possible to pay by credit card or Barion account.

11 In order to remove a bike from the station you need to select the current station, then the system will give you a PIN code and within 5 minutes it is possible to pick up a bicycle. After that, you should log out from the system, but the system will automatically log out after one minute of inactivity Reckoning (only occasional users!)

12 Occasional or tourist users can request the settlement, by clicking on reckoning and claim back the deposit. (Every begun hour counts as a full hour. The unused balance can not be refunded.) 4. Yearly usage fee 4.1. Local residents / Kaposvár Card For all persons 14 years of age and above who have their permanent place of residence in Kaposvár, students 14 years of age and above studying at a school in Kaposvár who possess a valid student ID, membership for the electric community bike rental system of Kaposvár is available at a highly reduced price. The fee is 3650 HUF + Vat for a year (4635 HUF gross), if they own Kaposvár card. After payment, the user receives 3650 hungarian forints onto his or her card, with which the e-bike rental system can be used for 365 days. The usage period can be shortened if the User is not using the bikes according to the agreement (point 6.1.). The registration fee may be paid using a bank card or cash. The card issuer provides receipt of all yearly usage fees, made out on the user s name. For the local residents the first 30 minutes are always free. After the free 30 minutes the system will automatically minus 50 HUF/30 mins from the balance. The local residents do not have to pay deposit. The user can use the balance for 365 days. From the annual card Public Bike System Hungary can not refund any money Local residents / without Kaposvár Card / Cityebike Kaposvár card Those citizens of Kaposvár who does not own Kaposvár card, also above listed user groups, as well as employed persons who commute their workplace in Kaposvár on a daily basis regardless of their permanent address, the fee is 4500 HUF+Vat for a year (5715 HUF gross). After payment, the user receives 3650 points onto his or her card, with which the e-bike rental system can be used for 365 days. The RFID-card s fee is included in the price. In case the card is destroyed, damaged, or lost, the price of replacement is 380 HUF+ Vat. With the issuing of the new card the old card is being disabled. The registration fee may be paid by using a bank card or cash. After consuming all 3650

13 points from the card, another yearly access to the system can be bought in the Tourist Office. At this occasion the User must bring the RFID card and pay the fee. In case the User does not want to continue to use the bike rental system, he or she has to bring back the card to the office. After payment, the user receives 3650 hungarian forints onto his or her card, with which the e-bike rental system can be used for 365 days. The usage period can be shortened if the User is not using the bikes according to the agreement (point 6.1.). The registration fee may be paid using a bank card or cash. From the annual card Public Bike System Hungary can not refund any money. 4.3.The tourist card can be bought in person in the Tourist Office in Kaposvár, at the Deseda Lake and online ( For the tourist and occasional users the deposit is HUF, which can be paid via credit card or cash. The tourist card s fee is 500,-HUF gross / hour. In case of using the bicycle or e-roller longer than it s paid, it will be charged automatically from the deposit amount. Every begun hour counts as a full hour. The deposit will be credited back to the bank account number specified by the Tourist within 7 days after the expiration date of the lease. The RFIDcard s fee is included in the price. In case the card is destroyed, damaged, or lost, the price of replacement is 380 HUF gross. With the issuing of the new card the old card is being disabled. At the end of the rental, the Tourist must give the RFID card back. Every begun 10 minutes are always free! 60 minutes: gross 500 Huf/ hour Minimal rental period: 1 hour gross 500 Hungarian forints Maximal rendtal period: optional 4.4. The fee for Deseda station is concured with the Kaposvár toursit card s fee. The deposit is HUF, which can only be paid by cash. The tourist card s fee is 500,-HUF gross/ hour. In case of using the bicycle or e-roller longer than it s paid, it will be charged automatically from the deposit amount. Every begun hour counts as a full hour. The citizens of Kaposvár who wants to rent an bike or e-roller at Deseda and does not have Kaposvár Card, has to show his or her documents and they are exempted from the deposit. Those Users who has already permission to use the system, can bike to Deseda station. Nevertheless please note, that here Public Bike System Hungary can not ensure that the docked bike will free upon the Users return.

If the user does not wait for 15 minutes then the balance will be reduced. *** Minimal purchased duration is 1 hour. 5. How the system works 5.1.The e-bikes and e-rollers can be found at the stations locked into the docking stations. 5.2.At the start of the e-bike and e-rollers usage, the user holds up his or her RFID card to the docking stations reader surface, then waits for the system to identify the card s owner and allow usage of the system. The confirmation is reinsured by a tone and a green light on behalf of the device. (This may take up to 10 seconds.) At every station a multilingual information board informs about the proper use of the system. 5.3.The battery level is shown on a display located next to the e-bike and e-roller. If the e-bike or e-roller is rentable, the LED light is green. 5.4.In order to activate the system the user pulls the e-bike or roller out of the docking and starts to ride. This turns on the PEDELEC electric power assistance which when cycling continuously activates and

15 propels the electromotor built into the front wheel, assisting the advance of the vehicle by up to 50%. When braking, he switches located in the brake control levers switch of the propulsion. The assistance can be turned on again by releasing the brakes and cycling with the pedals. After picking up the e-roller the lights are begin to work automatically and it is ready to use. By turning the gas gear it is immediately start. Both wehicles may be used by assuming all risks, the system does not include insurance. In case of the need of insurance, the user must take care of it. 5.5.While travelling, the user only needs to set up the right height of the seat, any other electrical settings will be automatically set. The fitting speed setting can be set by winding the mechanic shifter located on the right grip. The chosen gear can be found on the window of the shifter. 5.6.Upon retrieval the user puts the e-bike or e-roller back into the docking station. Fastening the e-bike in the right position does not require any major effort, the fastening is signaled by a tone and a flashing light on behalf of the bicycle storage. The user may return the e-bike and e-roller to a free docking station at any station. The data recording may take up to 5-10 seconds. As far as the system finds everything in order, a green light appears on the dock. Locking the bike incorrectly the light stays red, in which case the bicycle has to be removed from the dock and the insertion must be repeated. The user may return the e-bike to a free docking station at any station. In case there are no empty docks on the station, the bicycles have to be placed in the storages next to the docks. The handling of bicycle storages is described in their user manual which can be found on the storages themselves. In case there are no empty docks nor free spaces on the bicycle storage the dispatch has to be informed immediately. The User is responsible all bikes left unattended. The time of returning the e-bikes into the docking station marks the end time of the rental, which is being recorded by the card reader built into the docking station. In case of a power outage or a breakdown/discharge of the batteries of the rental stations, the user is unable to remove the e-bike from the docking station, it is however possible even in such situations to place the e-bike back into the docking station after rental. The time of a power outage does not increase the rental time.

16 6. General terms of use for the e-bike and e-roller rental, limitations and regulations, privacy policies 6.1.The electric power assisted bike rental system was created by Public Bike System Hungary Ltd. to facilitate transportation for the citizens of Kaposvár. Its goal is to allow as many people as possible to make use of the service. The e-bike rental may be used with the issued annual card. Every first begun 30 minutes is free. The usage of the e-bike has to be finished before the end of minute 30. To rent another bike or roller the User must wait 15 minutes. This ensures that there are always e-bikes available for the users. This is a strict term of use, after minute 30 the system reduce 50 points from the user s balance, shortening their free eligibility of 365 days. Of this, the user receives an notification via the provided address. This is being repeated after every 30th minute up until the e-bike is being placed back into the docking station. 6.2.A registered user my use 2 bikes or rollers with one card or PIN code at the same time. In this case the overusage fee of the 2 bikes will be charged from the registrated balance. 6.3.The maximum time of rental for the Public Bike System e-bikes and e-rollers may take up to 5 hours starting from the removal from the docks. Upon expiration of the 5 hour usage time the dispatch will call the user on the given phone number. If the contacting is unsuccessful and if even during this time the e-bike is not being placed back into the docking station, the system classifies the e-bike as stolen. Public Bike System Hungary Ltd. is authorized to take legal and other measures. The e-bike and the e- roller is being sought out by the responding authorities. All costs incurred are to be paid by the user. 6.4.The Public Bike System e-bike and e-roller may only be used within the administrative boundaries of Kaposvár or the Deseda bicycle road Those Users who has already permission to use the system, can bike to Deseda station. Nevertheless please note, that here Public Bike System Hungary can not ensure that the docked bike will free upon the Users return. 6.6.The Public Bike System Hungary is authorized to collect all e-bikes and e-rollers from the station in order to make all service and put them to winter storage upon the weather is under -5 degrees.

17 6.7.Users entering false data upon registration will be banned from the system. 6.8.The user is obliged to use the e-bike as intended and defined in present document. 6.9.The user is obliged to use the e-bike according to the corresponding laws of the Highway Code The user states to only use the e-bike if his or her state of health and physical capabilities allow it, and to use the e-bike at his or her own risk and responsibility Before each started biking or scootering, the user is obliged to make sure that the bike or scooter is in perfect condition, there are no signs of damage or a defect. If the user realize any error or malfunction, it is his obligatory to immediately announce it to the Call-center ( ). If the operator will realize any damage the last user will be held accountable! The user is obliged to protect the rented e-bike from theft, loss, damaging, annihilation as well as any other types of damage, to act with a level of care that may be expected under such circumstances, and to take the required measures. When interrupting the journey, it is imperative to ensure the proper locking using the bicycle lock provided by the operator The user may not perform any modifications on the e-bike and the roller It is forbidden to enable usage, lend, or rent out the e-bike to a third party. The e-bike may only be used by the user The user may not transport passengers on the e-bike, except when Public Bike System Hungary Ltd. provides the user with a bicycle suitable and designated for such usage The e-bike may not be used when under the influence of alcohol, medication or drugs The user is obliged to inform Public Bike System Hungary Ltd., or if needed, the police, immediately about any out of the ordinary occurrence related to the e-bike with special consideration towards damages and theft through the dispatch center via the phone number The prices include value-added tax (VAT) the rate of which when present GTC took effect was 27%. The Service Provider reserves the right to modify prices upon value-added tax (VAT) modifications Public Bike System Hungary Ltd. guarantees that the e-bike or the e-roller is technically fit for intended use and states that during the time of rental no third party representative has any right or claim towards the Public Bike System e-bikes that would hinder, limit or exclude the user in its use Public Bike System Hungary is authorized to modify present Terms. In case of Term modification, Public Bike System Hungary Ltd. informs on the website publicbikesystem.hu/ as well as via notifications placed at clearly visible areas of the station at least 30 days before taking effect. The notifications contain exact references towards modified provisions of the Term, the time of the

18 modification taking effect, as well as the accessibility of the modified Terms Present Terms are valid until recalled The Public Bike System Hungary Ltd. owns professional liability insurance, which is limited for the devices and it means that it is not contains accident insurance for the user. In case of the regular or one time user needs the insurance he or she has to get it for him /herself. 7. Complaint Handling 7.1. The User's complaint may be made in writing or in writing at the Sales Points to the staff. Written Complaint on the Pécs, Liszt Ferenc u. No. 7. mail address or 7.2.
