Errors and omissions Every effort has been made to write Road Policing Specimen Charges that address the majority of offences set out in the various transportrelated acts, regulations, rules and bylaws. If an investigation identifies the need for an additional charges(s) to be written to cover an offence(s) against a transport-related act, regulation, rule or bylaw for which no code has been assign you will need to contact Road Policing Support at Police National Headquarters setting out for what offence(s) Road Policing specimen charges are required. The same applies to any Road Policing Specimen Charge that you believe may contain an error or omission. Every endeavour will be made to meet any such requests. 3

4 2. Exclusions from 6 month period of limitation (a) The following Road Policing specimen charges are not subject to the 6 month period of limitation for the laying of an information. There is no time limit. All offences subject to imprisonment qualify for DNA sampling As from 4 December 2011 all offences that have imprisonment as a sentencing option are relevant offences under the Criminal Investigations (Bodily Samples) Act 1995 and a constable may require a person who he/she intends to charge with any of these offences to provide a bodily sample for the purpose of deriving a DNA profile. The Act grants constables the discretion as to whether or not to require an offender to provide a bodily sample. In exercising that discretion constables should first acquaint themselves with the DNA Chapter of the Police Manual. This details the process as it relates to Intention to Charge Sampling for an imprisonable offence. The attached list summarises the decision making process you will need to follow. The factors to be considered are: Is the person going to be charged with an imprisonable offence; Is the person 17 years or over; Is a DNA Databank profile/sample already held; Is this a serious offence and/or the type of offence for which DNA evidence is often relevant; If not (in the case of EBA) is the individual less than 20 years old, had 2 or more convictions, or is on active charges for theft, possessing knife in public place; failure to answer bail; or are there other unique characteristics. As you can see the decision to take DNA should not just rest on the fact that there is an intention to charge a person for the imprisonable offence of EBA. The other factors must be considered along with where the sampling will take place. The latter will be dictated by the sampling officer's access to NIA to print out the appropriate sampling forms. While available in a booze bus it clearly will not be available to patrols on the roadside. Remember, just because the law now says you can require a sample to be provided doesn t mean you have to, or should, every time. A series specimen charges - Note to enforcement staff Staff are reminded that if a person commits an A Series drink/drive-related offence against sections 52 to 62 Land Transport Act 1998 while he or she is driving a vehicle being used in a transport service (other than a rental service) then you must use the appropriate specimen charge in the A600 series.
