7 CHAPTER 8 TRAFFIC AND PARKING REGULATIONS ARTICLE 1. REGULATIONS ADDRESSING OFF-ROAD VEHICLES AND MOTORIZED BICYCLES. Sec. 8-1 Definitions and Interpretation. (a) The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: (1) MOTORIZED BICYCLE. 1 A bicycle with or without operable pedals and an internal combustion engine or battery-powered motor which may be propelled by human power or by an internal combustion engine or battery-powered motor, or by both, and, when powered by an internal combustion engine, having a rating of no more than one and five tenths (1.5) brake horsepower, and a cylinder capacity not exceeding fifty (50) cubic centimeters, an automatic transmission, and a maximum design speed of not more than twenty-five (25) miles per hour on a flat surface. (2) OFF-ROAD VEHICLE. Any motor driven vehicle capable of cross country travel, without benefit of a road or trail, on or immediately over land, water, snow, ice, marsh, swampland, or other natural terrain. It includes, but is not limited to, a multi-wheel drive or low pressure tire vehicle, amphibious vehicle, ground effect air cushion vehicle, mini-bike, snowmobile, or other means of transportation deriving motive power from a source other than muscle or wind. It does not include a farm vehicle used for military or law enforcement purposes, construction, mining, or other industrial related vehicles used in performance of its common function or a registered aircraft. (3) OPERATE. 2 The word operate or any form or tense thereof shall mean to ride in or on, to drive, to use, to put into action, cause to function, or to be in actual physical control of a vehicle as defined herein. (4) OPERATOR. 3 Any person who drives, operates, or is in actual physical control of a vehicle defined herein. (5) OWNER. 4 A person who holds the legal title of a vehicle, or in the event a vehicle is the subject of an agreement for the conditional sale or lease thereof with the right of purchase upon performance of the conditions stated in the agreement, and with an immediate right of possession vested in the conditional vendee or lessee, or in the event a mortgagor of a vehicle is entitled to possession, then such conditional vendee or lessee or mortgagor shall be deemed the owner for the purposes of this article I.C., , defines motorized vehicle. An off-road vehicle designed for travel primarily on snow or ice, of any type, which utilizes sled type runners or skis, or an endless belt tread or any combination of these or other similar means of contact with the surface upon which it is operated. No , ) Sec. 8-2 Regulations for Snowmobiles and Off-Road Vehicles. 5 (a) It shall be unlawful for any person to operate a snowmobile or off-road vehicle under the following circumstances: (1) On private property of another without the express permission to do so by the owner or occupant of said property. (2) On public school ground, park property, playgrounds and recreational areas without express provision or permission to do so by the proper public authority and the execution of a waiver of liability form. (3) On any street or sidewalk within the town; provided, however, that the police department may authorize use of a snowmobile or off-road vehicle on the public streets, highways, and rights-of-way within its jurisdiction during emergencies when conventional motor vehicles cannot be used for transportation due to snow or other extreme highway conditions. (4) In a manner so as to create loud, unnecessary, or unusual noise so as to disturb or interfere with the reasonable peace and quiet of other persons. (5) In a careless, reckless, or negligent manner so as to endanger the safety of any person or the property of any other person. (6) While under the influence of intoxicating liquor, fermented malt beverages, or controlled substances on drugs. (b) All snowmobiles and off-road vehicles operated within the town shall have the following equipment: (1) Mufflers which are properly attached and which reduce the noise of operation of the vehicle to the minimum noise necessary for operating the vehicle and no person shall use a muffler cut out, bypass, or similar device on said vehicle. (2) Adequate brakes in good working condition and at least one headlight and one taillight. (3) A safety or-called deadman throttle in operating condition; a safety or deadman throttle is defined as a device which when pressure is removed from the accelerator or throttle causes a motor to be disengaged from driving tract. 5 I.C., , et seq., addresses off-road vehicles including snowmobiles S-2 358

9 8-2 TRAFFIC AND PARKING REGULATIONS 8-3 (c) It is unlawful for the owner or operator of a snowmobile or off-road vehicle to leave or allow said vehicle to be or remain unattended on public property while the motor is running or with the keys for starting the vehicle left in the ignition. (Ord. No , 2, ) Sec. 8-3 Violations. (a) Motorized Bicycles: (1) No person, including, but not limited to a parent, a child, a teenager, or an adult shall violate any of the provisions of this article relating to motorized bicycles, including, but not limited to, Sections 8-4, 8-5, and 8-6, as the same may be amended from time to time. (2) No parent or guardian shall authorize or knowingly permit his or her child or ward to violate any of the provisions of this article relating to motorized bicycles, including, but not limited to, Section 8-4, 8-5, and 8-6, as the same may be amended from time to time. (3) Any person violating any section of this article, as set forth in sub-paragraphs (a)(1) and (2) hereinabove, in lieu of being charged for said violation in a Court of competent jurisdiction, may pay within five (5) days after receiving notice of a violation to the Town Clerk-Treasurer, as Clerk of the Town Violations Bureau, a fine in the sum of Fifty Dollars ($50.00). In the event that this fine is not paid by a person notified of a violation of a provision of this article within five (5) days after being notified and advised of the violation and right to pay said fine to the Clerk of the Town Violations Bureau in lieu of being charged, that person shall be charged with the violation in a Court of competent jurisdiction. Twenty- Five Dollars ($25.00) of the fine shall be deposited into the Town Law Enforcement Continuing Education Fund (LECEF) for the purposes as set forth and permitted by the Town Code Section as amended from time to time. The remaining portion of the fine in the amount of Twenty-Five Dollars ($25.00) shall be deposited to the Town General Fund. Each offense of violation of this article shall be deemed a separate offense, with separate fines for each as set forth herein. All such fines shall be paid to the Local Ordinance Violations Bureau, administered by the Clerk-Treasurer of the Town. (b) Off-road vehicles. (1) No person, including, but not limited to a parent, a child, a teenager, or an adult shall violate any of the provisions of this article relating to off-road vehicles, including, but not limited to, Sections 8-2 and 8-6, as the same may be amended from time to time. (2) No parent or guardian shall authorize or knowingly permit his or her child or ward to violate any of the provisions of this article relating to off-road vehicles, including, but not limited to, Section 8-2 and 8-6, as the same may be amended from time to time. (3) Any person violating any section of this article, as set forth in sub-paragraphs (b)(1) and (b)(2) hereinabove, in lieu of being charged for said violation in a Court of competent jurisdiction, may pay within five (5) days after receiving notice of a violation to the Town Clerk-Treasurer, as Clerk of the Town Violations Bureau, a fine in the sum of One Hundred Dollars ($100.00). No , 1, ) Sec. 8-4 Traffic Regulations for Motorized Bicycles. (a) Operators of motorized bicycles on a public highway or public path shall be subject to the provisions of traffic laws of the state and the town applicable to the operation of motor vehicles generally, subject to the special regulations in this section, and excepting those provisions of the traffic laws which by their nature can have no application. (b) A motorized bicycle shall not be operated by any person under the age of fifteen (15) years. (c) Operators of a motorized bicycle shall obey the directions and instructions of official trafficcontrol devices and signals, signs, and other control devices applicable to vehicles, unless otherwise directed by a police officer. (d) Whenever authorized signs are erected indicating that no right or left or U turns are permitted, no persons operating a motorized bicycle shall disobey the direction of any such sign, except where such person dismounts from the vehicle to make such turn, in which event the person shall obey the regulations applicable to pedestrians. (e) A person operating a motorized bicycle shall not drive, other than upon the permanent and regular seat attached thereto, nor shall the operator permit any passengers in excess of the number allowed for by the design and number of seats of the vehicle. (f) No person shall operate a motorized bicycle at a speed greater than is reasonable and prudent under the conditions then existing, and the operator of a motorized bicycle may not exceed the speed of twenty-five (25) miles per hour or the speed limit, whichever is lesser. (g) Every person operating a motorized bicycle shall drive as near to the right hand side of the roadway as is possible, and in single file when passing other vehicles, parked or moving, or any other considerable object on the highway. (h) The operator of a motorized bicycle emerging from an alley, driveway, or building shall, upon approaching a sidewalk, yield the right-of-way to all pedestrians approaching on said sidewalk or sidewalk area, and upon entering the roadway shall yield the right-of-way to all vehicles on the roadway close enough to constitute a hazard. (i) No person operating a motorized bicycle shall attach the same or himself to any vehicle upon a public highway or public path S

11 8-4 TRAFFIC AND PARKING REGULATIONS 8-5 (j) No person operating a motorized bicycle shall carry any package, bundle, or article which prevents the operator from keeping both hands upon the handlebars. (k) Trick riding is prohibited. The hands of the operator of a motorized bicycle shall be on the handlebars at all times, except while in the act of signaling. (l) No operator of a motorized bicycle shall cause or permit a motorized bicycle to curve side to side. (m) No person shall park a motorized bicycle in such a manner as to interfere with the normal flow of pedestrian traffic, vehicular parking or vehicular flow of traffic. (n) The operation of motorized bicycles upon sidewalks is prohibited. (o) Every motorized bicycle, operated on a public highway, during the period from one-half hour after sunset until one-half hour before sunrise, shall be equipped with a lamp on the front exhibiting a white light visible from a distance of at least five hundred (500) feet to the front and with a lamp on the rear exhibiting a red light visible from a distance of five hundred (500) feet to the rear. In lieu of such rear lighted red lamp on motorized bicycles, a red reflector glass button not less than one and one-half (1½) inches in diameter, or red reflecting tape of not less than four (4) square inches may be mounted securely on the rear mudguard, or lacing a mudguard on the rear of the saddle. (p) No person shall ride a motorized bicycle unless it is equipped with a horn or other device capable of giving a signal audible for a distance of one hundred (100) feet or more. (q) Every motorized bicycle shall be equipped with a brake which will enable the operator to make the braked wheels skid on dry, level, or clean pavement. (r) Every person operating a motorized bicycle shall employ the use of hand signals in the manner provided by state law for turning or changing lanes if such vehicle is not equipped with a lighted turn signal device. (Ord. No , 4, ) Sec. 8-5 Registration and Licensing. (a) Every motorized bicycle, either owned by a resident of the town, or stored within the town (excepting motorized bicycles held primarily for resale in the ordinary course of business), shall be registered and licensed with the police department within ten (10) days after 2001 S

13 8-5 TRAFFIC AND PARKING REGULATIONS 8-6 becoming the owner of said motorized bicycle, or commencing the storage of said motorized bicycle. The license shall expire annually on December 31 of the year of registration and issuance of the license. Each motorized bicycle shall be re-registered and re-licensed on or before the expiration of any existing license, and the renewal shall be on an annual basis. (b) Every person required to register a motorized bicycle shall complete such registration forms as are adopted from time to time by the police department. (c) Any person fifteen (15) years of age or older owning a motorized bicycle shall obtain a license for each motorized bicycle from the police department. No license shall be issued to, or for the benefit of, any person under the age of fifteen (15) years. (d) Each person filing an application for registration and issuance of a license for a motorized bicycle shall pay a fee of ten ($10.00) dollars for each motorized bicycle so registered and licensed. (e) The police department shall issue a motorized bicycle license to each eligible applicant who has completed the registration form and paid the required license fee. The license shall contain the number assigned to the vehicle and the name of the town. (f) A motorized bicycle license is not transferable. (g) A motorized bicycle license shall be affixed to and maintained upon the motorized bicycle registered for license, and in such position as to be plainly visible from the rear. No person shall remove a license from a motorized bicycle during the period for which issued, except upon a transfer of ownership, or when so removed by the police department. Upon the sale or other transfer of a licensed motorized bicycle, the licensee shall remove the license. (h) The police department shall keep on file a list of registrations of motorized bicycles for official use and the license application shall include the name of the owner, address, telephone number, make of motorized bicycle, type, size, color and manufacturer serial number, if any. (Ord. No , 5, ; Ord. No , 1, ) Sec. 8-6 Miscellaneous Rules and Regulations. (a) No person shall board or alight from any off road vehicle or motorized bicycle while such vehicle or bicycle is in motion, and no person shall alight on the roadway side from any off road vehicle or motorized bicycle. (b) No person shall ride on any off road vehicle or motorized bicycle upon any portion thereof not designated or intended for the use of passengers. (c) No person under the age of eighteen (18) years shall ride upon or operate a motorized bicycle without: (1) Wearing protective headgear meeting the standards established by the United States Department of Transportation under 49 CFR in effect January 1, 1979; and 1995 S-1 361

Sec Bicycle Usage Regulations. ARTICLE 2. BICYCLE REGULATIONS. 6 (a) A person propelling a bicycle shall not ride other than upon the permanent and regular seat attached thereto; nor carry any other person upon such bicycle otherwise than upon a firmly attached and regular seat thereon; nor shall any person ride upon a bicycle, otherwise than as above stated. (b) No bicycle shall be used to carry more persons at one time than the number for which it was equipped. (c) Any person upon any bicycle, coaster, roller skates or toy vehicle shall not attach the same or himself to any streetcar or vehicle upon a roadway. (d) Persons riding bicycles upon a roadway shall not ride more than two (2) abreast, except on paths or parts of roadways set aside for the exclusive use of bicycles. (e) No person riding a bicycle shall carry any package, bundle or article which prevents the rider from keeping both hands upon the handlebars. (Ord. No. 903, 1-5, ) Sec Equipment Requirements. (a) Lamps: Every bicycle operating upon a highway from one-half hour after sunset until one-half hour before sunrise, shall be equipped with a lamp on the front exhibiting a white light visible from a distance of at least five hundred (500) feet to the front and with a lamp on the rear exhibiting a red light visible from a distance of five hundred (500) feet to the rear; except that a red reflector meeting the requirements of this section may be used in lieu of a rear light. (b) Brakes: Every bicycle shall be equipped with a brake which will enable the operator to make the braked wheels skid on a dry, level, clean pavement. (Ord. No. 903, 6, 7, ) Sec Compliance With Traffic Code. 7 (a) Every person riding a bicycle upon a roadway shall be subject to the provisions of the Traffic Code of the Town of Dyer, Lake County, Indiana, which is made a part hereof by reference, except as to those provisions of that code which by their nature can have no application to this ordinance. 6 I.C., , defines bicycle and related equipment. 7 I.C., , authorizes the regulation of bicycles including licensing and registration fees. 362

15 8-12 TRAFFIC AND PARKING REGULATIONS 8-20 (b) The operator of any bicycle upon any public highway shall observe each and all of the regulations and requirements of the Uniform Act regulating traffic on highways of the State Of Indiana and the rules of the road of the State of Indiana as these apply to the usage of the right lane of the highway in travel, the stoppage and proceeding in accord with traffic signals, and the utilization of prescribed manual signs for the guidance of other traffic. (c) The parent of any child and the guardian or any ward shall not authorize or knowingly permit any such child or ward to violate any of the provisions of this act. (d) These regulations applicable to bicycles shall apply whenever a bicycle is operated upon any highway or upon any path set aside for the exclusive use of bicycles subject to those exceptions stated herein. (Ord. No. 903, 8-11, ) Sec Bicycle Registration Required. (a) Every bicycle operated within the corporate limits of the Town of Dyer, Lake County, Indiana, shall be registered with the Dyer Police Department on or before July 30, 1974 and each year thereafter. (b) Such registration shall include the name or the owner, the make, model and serial number of the bicycle and the date of purchase or acquisition. (Ord. No. 903, 12, 13, ) Sec Bicycle Inspections. As a condition of registration, each bicycle shall be inspected by the Dyer Police Department or its representatives and shall be required to comply with the sections hereinabove set forth concerning lamps and brakes. (Ord. No. 903, 14, ) Sec Penalty. It is an ordinance violation for any person to do any act forbidden by this ordinance or fail or perform any act by this ordinance. (Ord. No. 903, 15, ) Sec through Sec Reserved for Future Use. Sec Definitions. ARTICLE 3. TRAFFIC CODE OF THE TOWN OF DYER. 8 Division I. In General. The words and phrases used in this ordinance shall have the same meaning and definitions as defined in Indiana Code , et seq. addressing definitions. (Ord. No. 81-8, Art. I, 1, ) 8 I.C., , authorizes local authorities to adopt by ordinance additional traffic regulations. 363

16 8-21 TRAFFIC AND PARKING REGULATIONS 8-26 Division II. Enforcement and Obedience to Traffic Regulations. Sec Authority of Police Department and Fire Department Officials. It shall be the duty of the officers of the Police Department of this Town to enforce the provisions of this Ordinance and all state laws applicable to street traffic in this Town. The Chief of Police and his officers are authorized to direct all traffic either in person or by means of visible or audible signal in conformance with all traffic laws and ordinances, provided that in the event of a fire or other emergency or to expedite traffic or safeguard pedestrians, officers of the Police Department or Fire Department may direct traffic, as conditions may require, notwithstanding the provisions of this Ordinance. (Ord. No. 81-8, Art. II, 1, ) Sec Obedience to Personnel. The Chief of Police and his officers are herein sometimes referred to as a police officer and it shall be unlawful for any person to refuse or fail to comply with any lawful order, signal or direction of a Chief of Police, or police officer, or fireman, when acting in accordance with Section (Ord. No. 81-8, Art. II, 2, ) Sec Permits for Parades. No procession or parade, excepting the forces of the United States Army or Navy or the Military Forces of the State of Indiana and the forces of the Police Department and Fire Department, shall occupy, march or proceed along any street except and in accordance with a permit issued by the Chief of Police and such other regulations as are set forth herein which apply. (Ord. No. 81-8, Art II, 3, ) Sec and Sec Reserved for Future Use. Sec Pedestrians to Comply. Division III. Pedestrian Obedience to Traffic Signals. 9 At intersections where traffic is controlled by traffic control signals, the movement of pedestrians shall be regulated by such traffic signals as hereinafter set out. (a) At intersection controlled by traffic control signals exhibiting the words Go, Caution, or Stop, or exhibiting different colored lights successively, pedestrians shall move as follows: (1) Pedestrians facing a traffic control signal showing green or exhibiting the word Go may proceed across the roadway within any marked or unmarked crosswalk. (2) Pedestrians taking a traffic control signal exhibiting or showing yellow or exhibiting the word Caution are advised that there is insufficient time to cross the roadway, and any pedestrian then starting to cross shall yield the right-of-way. 9 I.C., through , address pedestrians. 364

17 8-26 TRAFFIC AND PARKING REGULATIONS 8-33 (3) Pedestrians facing the traffic control signal showing red or exhibiting the word Stop shall not enter the roadway unless it can be done safely and without interfering with vehicular traffic. (b) Pedestrian Walk and Wait Signal. Whenever pedestrian control signals exhibiting the words Walk or Wait are in place such signals shall indicate as follows: (1) WALK - Pedestrians facing such signal may proceed across the roadway in the direction of the signal and shall be given the right-of-way by the drivers of all vehicles. (2) WAIT or DON'T WALK - No pedestrians shall start to cross the roadway in the direction of such signal, but any pedestrian who has partially completed his crossing on the WALK signal shall proceed to a sidewalk while the WAIT or DON'T WALK signal is showing. (Ord. No. 81-8, Art. III, 1, ) Sec and 8-28 Reserved for Future Use. Sec Standing or Parking Close to Curb. Division IV. Method of Parking. Except where angle parking is prohibited, no person shall stand or park a vehicle on a roadway other than parallel with the edge of the roadway headed in the direction of the lawful traffic movement and with the right hand wheels within twelve (12) inches of the curb or the edge of the roadway, except as otherwise provided in the following paragraph and in this Article. (Ord. No. 81-8, Art. IV, 1(a), ; Am. Ord. No , ) Sec Angle Parking Prohibited. Angle parking in any area of the Town of Dyer is allowed only upon written approval of the Town of Dyer Police Department, Town of Dyer Fire Department, and the Town of Dyer Department of Public Works. Whenever a vehicle is lawfully parked at night upon any street within a business or residence district, no lights need be displayed upon such parked vehicle. (Ord. No. 81-8, Art. IV, 1(b), ; Am. Ord. No , ) Sec Through Sec Reserved for Future Use. Sec Funeral Processions. 10 Division V. Miscellaneous Driving Rules. (a) A funeral procession composed of vehicles may be identified as such by the display upon the outside of each vehicle of a paint of the type designated by the Chief of Police, or shall drive with headlights turned on. (b) Each driver in a funeral procession shall drive as near to the right hand edge of the roadway as practicable and safe. 10 I.C., through , address funeral processions S

18 8-33 TRAFFIC AND PARKING REGULATIONS 8-40 (c) Each mortician shall notify the Police Department of the day and the hour of each funeral procession to be had by him in the Town of Dyer together with the proposed route thereof, as far ahead of the proposed time as possible. (Ord. No. 81-8, Art. V, 1, ) Sec Driving Through Funeral Procession. (a) No driver of a vehicle, except an emergency vehicle, shall drive between the vehicles comprising a funeral procession or other authorized procession while they are in motion and when such vehicles are conspicuously designated as required in this ordinance. (b)this provision shall not apply at an intersection where traffic is controlled by a traffic-control signal or a police officer and shall not apply to authorized emergency vehicles. (Ord. No. 81-8, Art. V, 2, ) Sec Restrictions on Backing. The driver of any vehicle shall not back such vehicle into an intersection or over a crosswalk and shall not in any event or at any place back a vehicle against the current of traffic, except to back into a parallel parking space of to back out of a designated angle parking place. No vehicle shall be backed over a public sidewalk except where necessary; and where it is necessary the driver shall either sound his horn or halt before crossing the sidewalk. (Ord. No. 81-8, Art. V, 3, ) Sec Vehicles Shall Not Be Driven on Sidewalk. The driver of any vehicle shall not drive over any sidewalk area except at a permanent or temporary driveway, or park within such area. No vehicle shall be driven over or across the curb of any street except as above provided. (Ord. No. 81-8, Art. V, 4, ) Sec Boarding or Alighting from Vehicles. No person shall board or alight from any vehicle while such vehicle is in motion, and no person shall alight on the roadway side from any vehicle. (Ord. No. 81-8, Art. V, 5, ) Sec Unlawful Riding. No person shall ride on any vehicle upon any portion thereof not designed or intended for the use of passengers. This provision shall not apply to an employee engaged in the necessary discharge of a duty. (Ord. No. 81-8, Art. V, 6, ) Sec Through Sec Reserved for Future Use. 366

19 8-41 TRAFFIC AND PARKING REGULATIONS 8-43 Division VI. Traffic Control Devices. 11 Sec Authority to Install Traffic Control Devices. (a) The Chief of Police and Superintendent of Public Works pursuant to the order of the Town Council shall cause to be placed and maintained traffic control signs, signals, and devices when and as required under the traffic ordinances of this Town to make effective the provisions of said ordinances. (b) In the case of the identification and/or existence of a dangerous traffic situation, as determined by the Chief of Police, he or she is hereby authorized to install traffic control signs, signals and/or devices on a temporary basis after collaboration with the Superintendent of Public Works and until such time as the installation of said traffic control signs, signals and/or devices can be approved by the Town Council. (1) When a temporary traffic sign, signal or device is authorized to be installed by the Chief of Police, he or she shall be required to provide a written report with an accompanying recommendation to the Town Council regarding the same. Said written report and recommendation shall be provided to the Town Council no later than three (3) days after the installation of the temporary traffic control device. (2) The Town Council shall review the written report and recommendation of the Chief of Police and shall take official action regarding said recommendation at its next regularly scheduled public meeting. In no case shall the recommendation of the Chief of Police regarding the temporary placement of a traffic control device remain pending for longer than sixty (60) days without official action approving or denying the recommendation by the Town Council. (Ord. No. 81-8, Art. VI, 1, ; Am. Ord. No , ) Sec Manual and Specifications for Traffic Control Devices. All Traffic Control signs, signals and devices shall conform to the manual and specifications approved by the State Highway Commission. All signs and signals required hereunder for a particular purpose shall, so far as practicable, be uniform as to type and location throughout the Town. All traffic control devices so erected and not inconsistent with the provisions of State law or this Ordinance shall be official trafficcontrol devices. (Ord. No. 81-8, Art. VI, 2, ) Sec Obedience to Official Traffic Control Devices Located Within the Town of Dyer and Within Construction Areas in the Town. (a) The driver of every vehicle shall obey the instructions of any official traffic control device applicable thereto and placed in accordance with the ordinances of this Town, as amended from time to time, unless otherwise directed by a police officer. (b) The driver of every vehicle shall obey the instructions of any traffic control devices including, but not limited to, signals, signs, warnings, and all directions, signs, or warning devices 11 I.C., through , address traffic control devices S

20 8-43 TRAFFIC AND PARKING REGULATIONS 8-45 that may be given or displayed by a police officer or flagman to safely control traffic movement in a construction area and to promote safety in the construction area. (c) Any violation of the provisions of this Section is punishable by fines and penalties in accordance with, and as provided by Sections 8-120, et. seq., and 2-221(c), as amended from time to time. (Ord. No. 81-8, Art. VI, 3, ; Am. Ord. No , 1, ) Sec When Traffic Control Devices Are Required for Enforcement Purposes. No provision of this Ordinance for which signs are required shall be enforced against an alleged violator if at the time of the alleged violation an official sign is not in proper position and sufficiently legible to be seen by an ordinarily observant person. (Ord. No. 81-8, Art. VI, 4, ) Sec Traffic Control Signal Legend. Whenever traffic is controlled by traffic control signals, exhibiting the words Go, Caution, or Stop, or exhibiting different colored lights successively, the following colors only shall be used and said terms and lights shall indicate and apply to drivers of vehicles as follows: (a) GREEN alone or GO - Vehicular traffic facing the signal may proceed straight through or turn right of left, unless a sign at such place prohibits either such turn. Vehicular traffic shall yield right-of-way to other vehicles and to pedestrians, lawfully within the intersection at the time such signal is exhibited. (b) YELLOW or CAUTION - When shown with or following the green or Go signal: Vehicular traffic facing the signal shall stop before entering the nearest crosswalk at the intersection, but if such stop cannot be made, in safety, vehicle may be driven cautiously through the intersection. (c) RED alone or STOP - Vehicular traffic facing the signal shall stop before entering the nearest crosswalk at an intersection or at such other point as may be indicated by a clearly visible line and shall remain standing until GREEN or GO is shown. (d) GREEN ARROW - Vehicular traffic facing such signal may cautiously enter the intersection only to make the movement indicated by such arrow, but shall yield the right-of-way to pedestrians lawfully within a crosswalk. (e) In the event an official traffic-controlled signal is erected and maintained at a place other than an intersection, the provisions of these sections of this ordinance shall be applicable except as to those provisions which by their very nature can have no application. Any stop required shall be made at a sign or marking on the pavement indicating where the stop shall be made, but in the absence of any such sign or marking the stop shall be made at the signal S

21 8-45 TRAFFIC AND PARKING REGULATIONS 8-47 (f) Traffic control signals shall be located at the intersections as provided in Schedule 1 attached hereto and made a part of this Ordinance. (Ord. No. 81-8, Art. VI, 5, ) Sec Flashing Signals. Whenever flashing RED or YELLOW signals are used they shall require obedience by vehicular traffic as follows: (a) FLASHING RED or STOP SIGNAL - When a red light is illuminated with rapid intermittent flashes, drivers of vehicles shall stop before entering the nearest crosswalk at an intersection of streets and/or streets and railroads or at a limit line when marked, or if none, then before entering the intersection and the right to proceed shall be subject to the rules applicable alter making a stop at a stop sign. (b) FLASHING YELLOW CAUTION SIGNAL - When a yellow light is illuminated with rapid intermittent flashes, drivers of vehicles may proceed through the intersection or past such signal only with caution. (Ord. No. 81-8, Art. VI, 7, ) Sec Display of Unauthorized Signs, Signals or Markings. (a) No person shall place, maintain, or display upon or in view of any highway any unauthorized sign, signal, marking of device which purports to be or is an imitation of or resembles an official traffic control device or railroad sign or signal, or which attempts to direct the movement of traffic, or which hides from view or interferes with the effectiveness of any official traffic control device or any railroad sign or signal. No person shall place or maintain nor shall any public authority 2002 S

22 8-47 TRAFFIC AND PARKING REGULATIONS 8-53 permit upon any highway, any traffic sign or signal bearing thereon any commercial advertising. This shall not be deemed to prohibit the erection upon private property adjacent to highways of signs giving useful directional information and of a type that cannot be mistaken for official signs. (b) Every such prohibited sign, signal or marking is declared to be a public nuisance and the authority having jurisdiction over the highway is empowered to remove the same or cause it to be removed. (Ord. No. 81-8, Art. VI, 7, ) Sec Interference With Official Traffic Control Devices or Railroad Signs or Signals. No person shall, without lawful authority, attempt to, or in fact, alter, deface, injure, knock down, obscure, or remove any official traffic control device, sign, or street name sign, or any railroad sign or signal, or any inscription, shield or insignia thereon, or any other part thereof. Sec and Sec Reserved for Future Use. Sec Application of Division. Division VII. Stopping, Standing or Parking Restricted or Prohibited on Certain Streets. The provisions of this Article prohibiting the standing or parking of a vehicle shall apply at all times or at those times herein specified and as indicated on official signs, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or an official traffic control device. (Ord. No. 81-8, Art. VII, 1, ) Sec Regulations Not Exclusive. The provisions of this Division imposing a time limit on parking shall not relieve any person from a duty to observe other and more restrictive provisions limiting the stopping, standing, or parking of vehicles in specified places or at specified times. (Ord. No. 81-8, Art. VII, 2, ) Sec Special Regulations for Street Work and Snow Removal. (a) WORK - The Superintendent of Public Works is given the power to post temporary signs reading No Parking-Street Work along any street which he intends to sweep, clear, or work within the succeeding twenty-four (24) hours. The Superintendent of Public Works shall post every street that he intends to work with said signs prior to 4:00 P.M. of the preceding day. All vehicles shall be removed before 7:00 A.M. of the day the street is to be worked. Any vehicle which is illegally parked after 7:00 A.M. of the day the street is to be worked may be towed away in the manner provided in Division VII, Section 8-54 of this Traffic Code. (b) SNOW REMOVAL - No person shall park any vehicle on any street within the corporate limits of the Town of Dyer, whenever there is two (2) inches or more of snow thereon, until said snow is removed. Any vehicle which is parked on said streets when the depth of the snow exceeds two (2) inches, may be towed away in the manner provided in Division VII, Section 8-54 of this Traffic Code. (See Schedule 2) (Ord. No. 81-8, Art. VII, 3, )

24 8-54 TRAFFIC AND PARKING REGULATIONS 8-58 Sec Illegally Parked or Abandoned Vehicles. Any motor vehicle found upon the streets, alleys or highways within the Town of Dyer, Indiana, illegally parked or reasonably appearing to be abandoned may be removed from said street, alley or highway, under the direction of the Chief of Police, and be impounded in one (1) of the garages within or without the Town of Dyer, or in a privately owned garage, as designated by the Chief of Police. A notice shall be mailed by the Dyer Town Chief of Police by certified mail to the registered owner if the car is not claimed within three (3) days. (Ord. No. 81-8, Art. VII, 4, ) Sec Parking on Private Property Prohibited. No person shall drive, stop, stand or park a vehicle onto or upon privately owned property or an area developed as an off-street parking facility without the consent of the owner, lessee, or person in charge of such privately owned property or facility. A violation of this Section shall place such vehicle in the status of an illegally parked vehicle and upon complaint of the owner, lessee, or person in charge of the privately owned property or facility, said vehicle may be dealt with as described in Division VII, Section 8-54 of this Ordinance. (Ord. No. 81-8, Art. VII, 5, ) Sec Impounding of Vehicles of Repeated Offenders. 12 Any motor vehicle found upon the streets or highways of the Town of Dyer, Indiana having charged against the State license registration number of said vehicle an accumulation of four (4) or more offenses may be removed for impoundment in the manner described in Division VII, Sections 8-53 and 8-54 of this Ordinance. Should the owner of said vehicle appear to claim same, he will be booked for appearance in a court having jurisdiction on all outstanding offenses. (Ord. No. 81-8, Art. VII, 6, ) Sec Towing and Storing Fees. The owner of any motor vehicle removed and impounded pursuant to the terms of Division VII, Sections 8-53 and 8-54 of this Ordinance may appear and claim said motor vehicle upon payment of the towing and storage fees and presenting a release from the Dyer Police Department, whereupon said vehicle shall be released to him or his authorized representative. (Ord. No. 81-8, Art. VII, 7, ) Sec Storage of Vehicle. Using streets for storage of vehicles or parking of vehicles for more than ninety six (96) consecutive hours prohibited. It shall be unlawful for any person to park or cause to be parked any motor vehicle upon any street or public highway in the Town of Dyer, Indiana, for a period longer than ninety six (96) consecutive hours except as hereinafter provided. Any person who desires to park a motor vehicle upon any street in the Town of Dyer, Indiana, for a period of more than ninety six (96) consecutive hours shall apply to the Chief of Police of the Town of Dyer, for a permit to do so.
