5 Status Delegated and Implementing acts Future studies Regulation 168/2013, recital 12 environmental effect study: This Regulation sets environmental requirements for two stages with the second stage (Euro 5) being mandatory for new types of vehicles as of , thereby creating long-term planning security for the vehicle manufacturers and the supplier industry. Based on future available data an environmental effect study stipulated in Article 23 will provide additional underpinning through modelling, technical feasibility and cost-effectiveness analysis based on the then latest available data. In addition, the study will i.e. asses the feasibility and cost-effectiveness of inservice conformity testing requirements, off-cycle emission requirements and a particulate number emission limit for certain (sub-) categories. On the basis of the study results, the Commission should consider presenting a proposal introducing these new elements into future type-approval legislation applicable after the stages foreseen in this Regulation. 6 Status Delegated and Implementing acts Future studies Regulation 168/2013, Article 23, paragraph 5 - environmental effect study The Commission shall by 31 December 2016 present to the European Parliament and the Council a report on the following: (a) the enforcement dates of the Euro 5 level referred to in Annex IV (b) the Euro 5 emission limits referred to in part A3 of Annex VI(A3) and the OBD thresholds in part B2 of Annex VI(B2) (c) that all new types of vehicles in (sub-)categories L3e, L5e, L6e-Ae and L7e-Ae, in addition to OBD stage I, shall also be equipped with OBD stage II at the Euro 5 level (d) the durability mileages for the Euro 5 level referred to in part A of Annex VII(A) and the deterioration factors for the Euro 5 level referred to in part B of Annex VII(B) The Commission shall make any appropriate legislative proposals in the light of that report Working Group on Motorcycles (MCWG) - 19 April

8 Status Delegated and Implementing acts Future studies Advanced safety requirements for L7e-A Article 74 of Regulation (EU) 168/2013 prescribes that additional functional safety and vehicle construction requirements for subcategory L7e-A heavy on-road quads will be investigated Comparison of type of accidents that L7e category vehicles are involved in compared to small / light M class vehicles The purpose of this is to determine the need for increased crash safety of this vehicle category compared to M1 category vehicles This task may not be possible due to small sample size of L7e vehicle category available today. 10 Comitology Euro 3 step for categories L1e, L2e and L6e and automatic headlamp-on for all L-vehicle categories During trialogue meetings on L-cat Codecision proposal a compromise has been accepted by Council and EP to delete the Euro 3 step and to delay the date of first application of the new legal package to 01 Jan 16 Conditions: 1. The Euro 3 environmental step for categories L1e, L2e and L6e would be based on the current type-approval legislation in force (Directives 2002/24/EC and 97/24/EC) and enter into force in 2014 through Comitology 2.
