1 TOWN OF GRANUM PROVINCE OF ALBERTA BYLAW A BYLAW OF THE TOWN OF GRANUM TO SUPPLEMENT REGULATIONS OF THE ALBERTA HIGHWAY TRAFFIC ACT. WHEREAS, it is deemed necessary to provide certain regulations for the orderly and safe flow of vehicular and pedestrian traffic within the boundaries of the Town of Granum and for the safe parking of vehicles on streets and alleyways; WHEREAS, the Council of a municipality may, pursuant to the Municipal Government Act being Chapter M-26.1 of the Revised statutes of Alberta, 1994 and amendments thereof, pass and amend bylaws; WHEREAS, pursuant to Highway Traffic Act, being Chapter H7 of the Revised Statutes of Alberta, 1980, and amendments thereof requires the council of a municipal bylaw to make bylaws for classifying motor vehicles and other vehicles and pedestrians for any or all purposes involving the use of streets, lanes and other public places; NOW THEREFORE, the Council of the Town of Granum in the Province of Alberta, DULY ASSEMBLED, HEREBY ENACTS AS FOLLOWS: 1. This bylaw may be cited as THE TRAFFIC BYLAW of the Town of Granum. 2. Unless a word or term is specifically defined in this bylaw, the meaning, if any, ascribed in the Highway Traffic Act and the Interpretation Act shall apply and in the event of a conflict between the meaning ascribed in the Highway Traffic Act and that ascribed in the Interpretation Act, the former Act shall apply. 3. In the Bylaw 1. ALLEY means, a narrow highway intended chiefly to give access to the rear of buildings and parcels of land; 2. BOULEVARD means, in an urban area, that part of a highway that; 1. is not a roadway, and 2. is that part of the sidewalk that is especially adapted to the use of/or ordinarily used by pedestrians; 3. COUNCIL means, the Municipal Council of the Town, duly assembled and acting as such; 4. VEHICLE means, a truck, trailer, semi-trailer or truck tractor except a truck, trailer, truck tractor or semi-trailer that is a public service vehicle, and, includes: (i) (ii) (iii) a motor vehicle from which sales are made of goods, wears, merchandise or commodity, and a motor vehicle by means of which delivery is made of goods, wears, merchandise or commodity to a purchaser or a consignee thereof, or a motor vehicle that has a seating capacity of ten or less but does not include an off-highway vehicle as defined in the Off-Highway Vehicle Act of Alberta, a truck, a multi -purpose passenger vehicle, a chassis cab or a moped or a motorcycle.

CROSSWALK means, a. that part of a roadway at an intersection included within the connection of the lateral line ofthe sidewalks on opposite sides ofthe highway, measured from the curbs or in the absence of curbs, from the edges of the roadway, or b. any part of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or by other markings on the road surfaces; 6. CYCLE includes any cycle propelled by human power upon which a person may ride regardless of the number of wheels it may have; 7. DAYTIME means, the period commencing one hour before sunrise and ending one hour after sunset; 8. DRIVER OR OPERA TOR means, a person who drives or who is in actual physical control of a vehicle; 9. EMERGENCY VEHICLE means a. a vehicle operated by a police force, b. a fire fighting or other type of vehicle operated by the fire protection service of a municipality, c. an ambulance operated by a person or organization providing ambulance services, d. a vehicle operated as a gas disconnection unit of a public utility, e. a vehicle designates as an emergency response unit under Section 17.1 of the Highway Traffic Act; 10. HIGHWAY means, any thoroughfare, street, road, trail, avenue, parkway, driveway, viaduct, alley, lane, square, bridge, causeway, trestle-way or other place whether publicly or privately owned, any part of which the public is ordinarily entitled or permitted to use for the passage or parking of vehicles, and includes: (i) a sidewalk (including boulevard portion of the sidewalk) (ii) if a ditch lies adjacent to and parallel with the roadway, the ditch, and (iii) if a highway right-of-way is contained between fences or between a fence and on one side of the roadway, all the land between the fences, or all the land between the fence and the edge of the roadway, as the case may be, but does not include a place declared by the Lieutenant Governor in Council not to be a highway; 11. HANDICAP PLACARD means, the official handicap placard obtained from the Alberta Solicitor General Motor Vehicle Licensing Branch. 12. HOLIDAY means a Sunday or public holiday as defined in the Interpretation Act of Alberta and a day or portion of a day proclaimed by Council as a civic holiday; 13. MAYOR means, the Mayor of the Town of Granum; 14. LOADING ZONE means, a portion of a street set aside adjacent to a curb designated for the exclusive use of vehicles for the loading or unloading of passengers or of materials; 15. MAXIMUM ALLOW ABLE WEIGHT means, the weight as determined by the number of tires multiplied by the carrying capacity of the tire size as set out by the Motor Transportation Act Regulation of Alberta 69/57 and as amended from time to time. 16. MOTOR CYCLE means, a motor vehicle on two or three wheels and includes those motor vehicles known to the trade as motorcycles and scooters but does not include an off-highway vehicle as defined in the Off-highway Vehicle Act of Alberta; 17. MUNICIPAL ADMINISTRATOR means the Chief Administrative Officer of the Town of Granum as appointed by Council

3 18. PARADE OR PROCESSION means, any group or train of persons or vehicles using any highway for show or display, but shall not include any funeral procession; 19. PARK means, when prohibited means allowing a vehicle (whether occupied or not) to remain standing in one place except: 1. when standing temporarily (for a period of five minutes), for the purpose of and while actually engaged in loading or unloading passengers, or 2. when standing in abeyance to a Peace Officer or traffic control device; 20. POLICE DEPARTMENT OR BYLAW ENFORCEMENT OFFICER/SPECIAL CONSTABLE means, the Royal Canadian Mounted Police (R.C.M.P.) and the Bylaw Enforcement Officer/Special Constable appointed by the Town of Granum; 21. PEACE OFFICER means, 1. a member of the Royal Canadian Mounted Police, 2. a Bylaw Enforcement Officer, 3. a Special Constable; 22. PEDESTRIAN means, a person afoot or a person in a wheel chair; 23. PUBLIC SERVICE VEHICLE means: 1. a motor vehicle, trailer or semi-trailer operated on a highway by or on behalf of a person for compensation, whether that operation is regular of only occasional or for a single trip, and 2. includes a motor vehicle kept by a person for purposed, subject to the regulation, or being rented without a driver, but 3. does not include a motor vehicle used solely as an ambulance or hearse or for any transportation of the Royal Mail; 24. ROADWAY means, that part of a highway especially intended for the use of vehicles; 25. SIDEWALK means, that part of a highway especially adapted to the use or ordinarily used by pedestrians, and includes that part of the highway between the curb line (or the edge of the roadway, where there is no curb line) and the adjacent property line whether or not paved or improved. 26. STOP means: 1. when required, a complete cessation from vehicular movement, and 2. when prohibited, any halting even momentarily of a vehicle, whether occupied or not, excepting when necessary to avoid conflict with other traffic or in compliance with the directions of a Peace Officer or traffic control device; 27. TOWN means, the Town of Granum, a municipal corporation of the Province of Alberta and includes the area contained within the corporate boundaries of the Town of Granum where the context is so required; 28. TRAFFIC CONTROL DEVICE means, any sign, signal, marking or device placed, marked or erected under authority of this bylaw for the purpose of regulating, warning or guiding traffic, which includes any traffic control signal whether manually, electrically or mechanically operated by which traffic is directed to stop and to proceed; 29. TRAILER means, a vehicle so designed that it may be attached to or drawn by a motor vehicle and intended to transport property or persons and includes any trailer that is designated, constructed and equipped as a dwelling place, including an abode or sleeping place, either permanently or temporarily, but does not include machinery or equipments used in construction or maintenance of highways; 30. TRUCK means a vehicle designated primarily for the transportation property or equipment but does not include a chassis cab, crawler-mounted vehicle, trailer,

4 machinery or equipment used in the construction or maintenance of highways or an off-highway vehicle as defined in the Off-Highway Vehicle Act; 31. TRUCK TRACTOR means, a truck that is designated primarily for drawing another vehicle and that is not designated to carry any load other than part of the weight of a vehicle drawn, and includes a vehicle that is designated to accommodate a fifth wheel coupling, but does not include a crane equipment breakdown vehicle; 4. Traffic Control Devices 1. The Council or Municipal Administrator and/or designate is hereby empowered to prescribe traffic control sign locations and keep a record of all such locations, to be kept open to public inspection during normal business hours. 5. Temporary Highway Closures 1. The Municipal Administrator and or Public Works Foreman of the Town may, for repairs, maintenance, or emergency, or any special circumstances, take such measures for the temporary closing of highways or the suspension of parking privileges and placing barricades or posing appropriate notices on or near the highway concerned, as they may consider to be necessary in the circumstances. 2. No person shall park a vehicle or cause a vehicle to enter upon any portion of a highway in the Town upon which movement or parking of vehicles has been prohibited by this part. 3. No person shall: a. tear down, remove, or interfere with any barricades or notice of closing or suspension, erected or posted under authority of this part; b. do anything in contravention of any notice posted under authority of this part. 4. No person shall place upon any part of any highway or upon any building or structure abutting thereon any sign, marking or notice relating to traffic regulations excepting in cases where the Town, due to special circumstances, may in writing, otherwise direct or permit. 6. Restricted Parking Hour Parking No person shall park or stand or permit to be parked or left standing, any vehicle on any roadway or public place for any period longer than seventy-two (72) consecutive hours unless such vehicle is parked in front of the property owned by or in control of the registered owner of the vehicle. 2. Unattached trailer No person shall leave parked or permit to be left parked on any street a trailer, whether designated for occupancy or load carrying, which has been detached from a vehicle which is used to draw it excepting for holiday trailers, not in excess of2.4 meters in width which may be parked in front of the residence of the registered owner of the holiday trailer from April1 st. to October 31st., providing frontage is not on any avenue, unless approval is obtained from Council.. 3. Parking In Alley No person shall park or permit the parking of a vehicle in any alley except for the purpose of loading or unloading or delivery of goods, wares or merchandise. 4. Parking For Service No person shall park or permit the parking of any vehicle on any highway for the purposes of greasing, servicing, repairing or making installations to the vehicle. 5. Park Dangerous Loads

5 No person shall park any vehicle or permit the parking of any vehicle used for the conveyance of inflammable, combustible, explosive, or other dangerous material whether loaded or unloaded on any highway or any property having a building or buildings thereon unless the vehicle is parked at least 15.0 meters from the nearest building likely to contain persons or valuable goods. Such prohibition shall not apply to the time during which any such vehicle is necessarily motionless while delivering dangerous materials to a retail dealers of such dangerous materials. 6. Fire Lanes Emergency Entrance No person shall park any vehicle in a posted fire lane access or in any other emergency entrance or exit. 7. Private Property No person park on private property without authority from the owner or person in lawful possession or control of the property. 8. Keys in Vehicle No person shall leave a motor vehicle unattended with keys in the ignition unless securely locked. 9. Vehicle Running No person shall leave a motor vehicle running and unattended unless securely locked. 10. No Parking Zone No person shall park or stand or permit to be parked or left standing any vehicle on any roadway where signs prohibit parking. 11. Park Left of Centre No person shall park or stand or permit to be parked or left standing any vehicle to the left of the centre line of a highway, unless such vehicle is parked completly off the highway. 12. Loading Zone No Persons shall park any vehicle in a loading Zone for a period of time longer than is necessary to load or unload the vehicle. 13. Weight Restrictions No persons shall park any vehicle, bus or recreational vehicle, trailer or truck with a maximum allowable weight in excess of Seventy-Five Hundred Kilograms (7,500 kg) or cause to be parked any vehicle, bus or recreational vehicle, trailer or truck (whether same is designed for occupancy or load carrying) on any streets or portion thereof other than those mentioned in Schedule A of this Bylaw, excepting for holiday trailers and recreational vehicles, not in excess of2.4 meters in width which may be parked in front of the residence of the registered owner of the holiday trailer or recreation vehicle from April 1st to October 31 5 \ provided frontage is not on any avenue, unless approval is obtained from Council. 14. Truck Tractor Notwithstanding Section 16.13, no person shall park any truck trailer or cause to park any truck tractor on any highway or portion thereof other than those mentioned in Schedule A of this Bylaw excepting: 1. A person may elect to park a truck tractor or cause to park a truck tractor on those highways or portions thereof that are not mentioned in Schedule A provided; a. such truck tractor is not carrying or attached to any trailer and is parked directly in front of the residence of the operator or owner of

6 the truck tractor only from October 1 to Apri130, provided frontage is not on any A venue, and b. such truck tractor shall be parallel parked on the roadway only pursuant to subsection 6.17, and c. requirements outlined in subsection.14.3 are completed. 2. Any person who elects to park a truck tractor or cause to park a truck tractor on those highways or portions thereof that are not mentioned in Schedule A pursuant to subsection.14.1 shall be responsible for any damage to any highway or portion thereof caused by the operations of the truck tractor on such highways. 3. Where a person elects to park a truck tractor or causes to park a truck tractor directly in front of his/her residence pursuant to subsection.14.1 and that person is not the registered owner of such property, that person shall, prior to the commencement of such parking, provide to the Town written authorization from the registered owner of such property, acknowledging the parking of a truck tractor directly in front ofthis property and accepting all responsibility for any damages to the highway caused by such parking. Written authorization shall be in a form approved by the Municipal Administrator. 4. Where a person is charged by the Town for the cost to repair damages pursuant to subsection.14.2, such cost, if unpaid shall be recoverable pursuant to Section 553 of the Municipal Government Act Statutes of Alberta, 1994, Chapter M-26 and any amendments thereof. 15. Restricted Property No person shall park any truck tractor or any vehicle with a maximum allowable weight in excess of Seventy-Five Hundred Kilograms (7,500 kg) or cause to park any truck tractor or any vehicle with a maximum allowable weight in excess of Seventy-Five Hundred Kilograms (7,500 kg.) on any property having a land use designation of Residential- R1 ",Mobile Home- R2", Country Residential- CR or Pubic oflnstitutional- Pas designated by the Land Use Bylaw of the Town as amended from time to time. 16. Town Property No person shall park any vehicle or cause to park any vehicle on any land owned by the Town except on such part thereof as may be designated by the Municipal Administrator with a sign for vehicle parking Parallel/ Angle Parking a. When parking on a roadway, a driver shall park the vehicle with the side thereof parallel to the curb or edge of the roadway and with the curbside wheel thereof not more than 500 millimeters from the curb or edge of the roadway, and between any markings which may exist to designate a parking space, and facing the direction of travel authorized for that highway. b. Where a sign indicates that angle parking is permitted or required, the vehicle shall be parked: i) with the forward wheel thereof not more than 500 millimeters from the curb or edge of the roadway, ii) and where parking guidelines are visible on the roadway, with the side of the vehicle between and parallel to any two such lines. c. No person shall angle park any vehicle which exceeds six (6) meters in overall length upon any highway ofthe Town. d. When a vehicle exceeds the length of a single parallel parking space, such vehicle may be parked so that it occupies two but not more than two parking spaces. 18. Public Utility

7 Vehicles operated by a public utility may park on a highway when it is advisable or necessary to do so for the purpose of construction, repair, maintenance or inspection of public utility facilities adjacent to along, over or under the highway. 19. School Bus a. Nothing in this section shall be construed to prohibit a school bus from parking on any highway or authorized property provided such school bus does not exceed a maximum passenger load of Forty-Two (42) persons. b. Notwithstanding subsection.19 a. no person shall park or permit to be parked any school bus on the West side of Railway Avenue. 20. Emergency/Service Vehicles Nothing in this section shall be construed to prohibit police vehicles, ambulances, tow trucks, vehicles engaged in highway repair, maintenance or inspection work from parking upon a highway when it is advisable to do so to prevent accidents, give warning of hazard, remove injured persons repair a roadway, or for similar purposes. 21. Interfering With Emergency Vehicles No person shall park or stand any vehicle or cause to parked or stand any vehicle in such a manner so as to interfere with the proper operation of any emergency vehicle. 22. Unregistered/Unlicensed Vehicle No person shall leave parked on any highway any unlicensed self propelled type of vehicle or vehicle incapable of being moved under its own power, unless caused by a breakdown or other emergency, and the person in charge or control of the vehicle can establish that action has been taken to arrange for the removal of the vehicle forthwith. 23. Garage/Service Station Operations No person in charge or control of a garage or service station or other premises where repairs or installations are made to vehicles shall leave, cause or permit to be left on any highway or alley, a vehicle that is in that persons possession for the carrying out or repairs or installations or for any other purposes. 24. General Parking restrictions Unless required or permitted by this Bylaw or by a traffic control device or in compliance with the directions of a peace officer or to avoid conflict with other traffic, no person shall stop or park a vehicle or cause a vehicle to park or stop: a. on a sidewalk, b. on a boulevard other than as approved by resolution of Council, c. on a crosswalk or any part of a crosswalk, d. within any intersection other than immediately next to a curb in a T intersection, e. at an intersection nearer than 4.5 meters to the projection of the comer property line immediately ahead or immediately to the rear, except when such vehicle is parked in a space where a parking meter or other traffic control device indicates parking is permitted, f. within 4.5 meters upon the approach to any stop sign or yield sign, g. within 4.5 meters of any fire hydrant, or when the hydrant is not located at the curb, within 4.5 meters of the point on the curb nearest to the hydrant, h. within 1.5 meters of an access to a garage, private roadway or driveway, or a vehicle crossway over a sidewalk, 1. within 4.5 meters of the near side of a marked crosswalk, j. along or opposite any street excavations or obstruction when the stopping of parking would obstruct traffic, k. on any bridge or on the approach thereof, 1. at any other place where traffic control device prohibits stopping or parking, during such times as stopping or parking is prohibited, m. on the roadside of a vehicle parked or stopped at the curb or edge of the roadway, 1. in any alley within the boundaries of the Town,

8 m. in the driving lane of any highway. 25. Vehicle On Jack No person shall leave a vehicle unattended on a highway ifthat vehicle has been placed on a jack or similar device and a. one or more wheels have been removed from the vehicle, or b. part of the vehicle is raised. 26. Abandoned Cycle/Power Cycle If any cycle or power cycle is left abandoned or unattended for a period of forty-five (45) days, the unclaimed cycle or power cycle becomes the possession of the Town and shall be sold at public auction after the lapse of the previously noted time. 27. Handicapped Parking No person shall park or stand a vehicle or cause to park or stand a vehicle in a parking space designated as Handicapped Parking except a vehicle displaying a handicapped placard. 28. Exception A vehicle shall not be deemed to be operating in contravention of this Section during the time which any such vehicle is motionless while engaged in loading or unloading products or material at a specific location. 7. No Parking Maintenance Signs 1. Notwithstanding any other provision in this Bylaw, the Municipal Administration or the Public Works Foreman of the Town may cause No Parking Sign to be placed on or near a roadway for roadway maintenance or construction purposes. 2. After such signs are placed on or near a roadway, no person shall park or leave a vehicle on the portion of such roadway so signed contrary to the provision of such no parking signs. 3. When roadway maintenance or construction commences, any vehicle parked on the signed roadway may be removed pursuant to Section 20.1 hereof. 8. Speed Limits 1. The rates of speed as outlined in the Highway Traffic Act of Alberta shall apply except as shown herein: a. that portion of Secondary Highway 519 located within the boundaries of the Town shall have a maximum rate of speed of sixty kilometers per hour.(60 km.lhr.) b. No person shall drive any vehicle in any alley at a speed in excess of fifteen kilometers per hour (15 km.lhr.) 9. Tracked Vehicles 1. No persons shall operate on any highway; a. a vehicle or trailer having metal spikes, lugs or cleats or hands projecting from the surface of the wheel or tire or such vehicle, or b. any vehicle or trailer having skids or using street pads or flat surface tracks. 10. Snowmobiles 1. No snowmobile shall operate on any highways within the Town or on any property owned or in control by the Town.

9 2. No snowmobiles shall be operated at a speed in excess of fifteen kilometers per hour (15 kmlhr.). 3. No snowmobiles shall be operated within the Town boundaries, except between the hours of7:00 a.m. and 10:00 p.m. Monday thru Sunday inclusive. 11. Truck Routes 1. Vehicles, trucks or trailers with a maximum allowable weight capacity in excess of Seventy-Five Hundred Kilograms (7,500 kg.) shall be operated only on those highways hereinafter outlined in Schedule B attached hereto and forming part of this Bylaw, excepting when such vehicle, truck or trailer is engaged in a delivery or pickup of material. 2. Truck tractors shall be operated only on those highways hereinafter outlined in Schedule B attached hereto and forming part of this Bylaw. 3. Where a vehicle, truck or trailer having a maximum allowable weight in excess of Seventy-Five Hundred Kilograms (7,500 kg.) is engaged in making a delivery or pickup on any highway not outlined in Schedule B attached, such vehicle, truck or trailer shall take the shortest route to and from the location such delivery or pickup is to be made. 12. Unprotected Hose 1. When an unprotected hose ofthe Town Fire Department of Town Public Works Department has been laid down on a roadway or a driveway, no person shall drive a vehicle over such a hose unless the person representing the Town at the scene has specifically allowed such person to do so. 13. Obstructing 1. No person shall stop a vehicle or permit a vehicle to be left upon a highway in such a manner as to block, obstruct, impede or hinder traffic thereon. 2. No person shall conduct him/herself or otherwise position himself on a highway in such a manner as to obstruct vehicular or pedestrian traffic or as to inconvenience any other person upon the highway. 3. A registered owner of land shall not permit any hedge, trees, shrub, fence, wall, structure or any other object on private property within five (5) meters of a highway intersection so that visibility of traffic is interfered with or hampered. 4. A registered owner of land shall not permit any hedge, trees, shrub, fence, wall, structure or any other object on private property to obstruct any sidewalk or pedestrian pathway. 5. No person shall make or place on obstruction of any kind, in, upon, or above any highway. 6. No person shall dump, place spill, abandon, unload or push any dirt, ice snow, gravel, asphalt, concrete or any other deleterious matter onto any highway which in any manner obstructs or impedes vehicular, pedestrian traffic or drainage. 14. Damage 1. No persons shall interfere with, break, cut or otherwise injure or damage a highway. 2. No person shall in any way damage, mark, or deface any street furniture on any highway or public place. 15. Littering 1. No person shall place, abandon, throw, deposit or permit to be placed, abandoned, thrown or deposited any nail, tacks, glass, crockery, wire, scrap metal, bottle, paper

10 carton or other paper or any other container, substance or thing on any highway or public place. 2. a. b. No person shall drive or pull onto or upon a highway a vehicle containing a load unless such load is completely secured in such a manner that no portion of the said load can escape, blow, drop, spill or fall onto a highway or land adjacent thereto. In the event that any load or any portion thereof becomes loose or detached or blows, drops, spills or falls from any vehicle onto any highway, it shall be the duty of the driver of the vehicle forthwith to take all reasonable precautions to safeguard traffic and forthwith remove such material from such highway. 16. Parades And Processions 1. No person shall hold or take part in any parade or procession, other than a funeral procession, unless a written permit for the parade or procession has first been obtained from the Municipal Administrator. 2. No person driving a vehicle, a cycle, or riding or driving a horse and no pedestrian shall drive, ride, or walk through the ranks of a funeral procession, or in any way obstruct or interfere with same. 3. All vehicles in a funeral procession shall, while in such procession, have headlights turned on or display on each vehicle distinctive signs or markings indicating that such vehicles are in a funeral procession, and the driver of the leading vehicle shall, before entering upon any intersection where a stop is required by law, bring the vehicle to a stop and yield the right-of-way to vehicles on the intersecting street before proceeding, and vehicles that follow in the procession may than proceed through the intersection without stopping, subject to the direction of any Peace Officer. 4. A Peace Officer may regulate all traffic in the vicinity of any parade, procession, or funeral procession, and any or all persons, whether on foot, on horse or in a vehicle, or cycles, shall obey the orders and directions of such Peace Officer. 17. Sidewalks 18. Horses 1. No person, other than a child often (10) years of age or less shall ride any cycle/bicycle, or skateboard on any sidewalk or boulevard of the Town. 2. No person shall park any cycle on any sidewalk or boulevard of the Town except where cycle stands are available. 3. No persons shall park or drive any vehicle on any sidewalk or boulevard on the Town. 1. No person shall ride, walk or permit a horse to be on any roadway, sidewalk of boulevard and shall stay with the following areas; a. East side of Railway A venue, b. West side ofrailway Avenue South ofminto Street, c. South side ofminto Street. 2. No person shall ride, walk or permit a horse to be on any roadway, sidewalk or boulevard. 19. Dutv To Enforce 1. Each Peace Officer is hereby charged with the duty of enforcing the provisions of this Bylaw and shall direct traffic when needed for the protection of life or property. 2. Every Peace Officer who on reasonable and probable grounds believes that any of the offenses enumerated in Section 6.8 or 6.9 has been committed, may seize and detain the keys for safe keeping and security of the vehicle. 20. Impoundment OfVehicle

11 1. Any Peace Officer is hereby authorized to remove or cause to be removed any vehicle or trailer from a highway, roadway, alley, parking lot or public place, a. b. where such Peace Officer reasonably believes there is or has been a contravention of any provision of this Bylaw, or where emergency conditions may require such removal from a highway, and such vehicle may be removed to a place designated by the Town Administrator where it will remain impounded until claimed by the owner thereof or his agent. 2. No impound vehicle shall be released to its owner or his agent until the towing and storage charge on the vehicle has been paid; such charges shall be in addition to any fine or penalty imposed in respect of any such violation or to any payment made in lieu of prosecution as provided for in Schedule C ofthis Bylaw. 21. Owner To Disprove Liability 1. The owner of a vehicle which is involved in any contravention of this Bylaw is guilty of an offence unless he proves beyond a reasonable doubt that at the time of the offence the vehicle was not being driven or was not parked or left by him/her or by any other person with his consent, expressed or implied. 2. Notwithstanding subsection.1, if the owner was not at the time ofthe offence driving the vehicle he/she is not in any event liable to imprisonment. 22. Voluntary Payment Tag 1. Where a Peace Officer believes that a person has contravened any section of this Bylaw, he/she may serve upon such a person a voluntary payment tag in a form designated by the Town Administrator allowing payment of the minimum penalty specified in Schedule C for such offence to the Town, and such payment shall be accepted by the Town in lieu of prosecution for the offence. 2. If the person upon whom a volunteer payment tag is served fails to pay the required sum within the time specified in the voluntary payment tag, the provisions of this section regarding acceptance of payment in lieu of prosecution do not apply. 3. The Provincial Offences Procedures Act, Statutes of Alberta 1988 as amended thereof, shall govern the procedure for the prosecution of offences and the imposition of penalties imposed under this Bylaw. 23. Voluntary Payment Tag Service A Volunteer Payment Tag shall be deemed to be sufficiently served: 1. If served personally on the accused, or 2. If mailed to the last known address ofthe registered owner ofthe vehicle concerned, or to the person concerned, or 3. If attached to or left upon the vehicle in respect of which the offence is alleged to have been committed. 24. Penalties 1. Any person who contravenes or disobeys, or refuses or neglects to obey any provisions of this Bylaw by: a. doing any act or thing which he/she is prohibited from doing herein b. failing to do any act or thing he/she is required to do herein; is guilty of an offence and is liable on summary conviction to a fine not exceeding Ten Thousand Dollars ($1 0,000) and in the event of failure to pay any fine levied to imprisonment for a period of not more than one (1) year or until such fines and cost of committal are paid.

Where any part of this Bylaw or Schedule C hereto provides for a minimum fine to be made for contravention of this Bylaw, the court entering the conviction of the offence, shall not levy a lesser fine than that set out in the provisions of this Bylaw. 3. Nothing in this section shall: 25. Schedules a. prevent a person from exercising his/her right to defend any charge or committing a breach of any of the sections referred to in Schedule C. b. prevent a Peace Officer from laying an Information or complaint in lieu of serving a volunteer payment tag. The documents attached hereto and marked Schedules A, B and C are hereby incorporated into and make part of this Bylaw. 26 Coming Into Effect 1. Bylaw # and Bylaw# are hereby repealed. 2. This Bylaw shall come into full effect on the Final reading thereof.
