These facilities enable researchers to conduct experiments they cannot perform anywhere else in the world and provide access to Argonne staff expertise and support in a wide array of technical fields. For approved, peer-reviewed projects, operating time is available without charge to researchers who intend to publish their results in open literature.

3 How Can Industry Work with Argonne? Argonne works proactively with industry to identify and develop commercialization opportunities, license new applications and introduce transformational technologies to the private sector. The laboratory has many types of contractual agreements to meet the needs and interests of industry. } Collaborative Research and Development Agreement Collaborative, cost-shared R&D project Coordinated work performed by the laboratory and the company is typical Argonne s work may be funded by the DOE or by the company Company s cofunding may be funds to the laboratory or in-kind No funds may flow from the lab to the company Argonne and the company each own their inventors subject inventions Company may obtain (by negotiation with the laboratory) rights to Argonne s inventions in a defined Field of Use Data can be protected for up to 5 years } Sponsored Research Agreement Work at lab is paid entirely by a non-doe sponsor Work is performed entirely by the laboratory Research data may be kept proprietary for a private sponsor with non-federal funding Sponsor ownership of subject IP may be possible depending upon circumstances } Technical Services Agreement Short (6 months) project Project limited to $100,000 May not involve R&D (no inventions) Typically used for testing, etc. Sponsor typically can designate data/results as proprietary May not involve non-u.s. sponsorship } Licensing Argonne s license terms, in most regards, are similar to commercial licenses used by universities and industry. They are tailored to address the specific technology and licensing situation. They may be non-exclusive, limited exclusive or exclusive They may cover specific field(s) of practice In working with industry, other agreements, such as non-disclosure agreements, are commonly employed to cover the company s and the laboratory s sensitive information. Sensitive R&D work done at the laboratory may be compartmentalized to minimize the risk of inadvertent disclosures.
