General Manager (POWERGRlD) of Power Grid Corporation of India Ltd., the representative of the Petitioner in the above matter, and am duly authorized to make this'affidavit. 2. On the' direction of CERC under Record of Proceedings against petition no. 127/2012, CTU filed a7 affidavit dated 2 nd August 2012 (Copy enclosed as Eltel-} from Page>- to -_~). In the above affidavit, CTU inter-alia stated that As per the CEA Advisory dated , no additional domestic gas is likely to be available till 20 I 5-16 and the advisory further stated that developers not to plan projects based on domestic gas till 20 I The above advisory states the uncertainty of gas for power plants till and beyond this also, quite uncertain. The scheduled commissioning date for the Vemagiri Transmission System is April 2015 and the transmission system shall not be utilized atleast till Srikakulam -Vemagiri 765kV DIC transmission line (for import ofpower IPPs in Orissa to southern Region) has also been recommended by Empowered Committee on Transmission under Tariff Based Competitive Bidding and that the same is expected to be commissioned by In the situation of gas not being available beyond , Vemagiri Transmission System shall remain un-utilized for about 2 years till availability of Srikakulam - Yemagiri 765kY ole transmission line. 3. After the submission of Affidavit in August 2012, the following developments have taken place subsequently: (i) No change in uncertainty of gas for power plants. (ii) Spectrum Power Generation Limited, the long-tenn transmission customer for Vemagiri Transmission System Limited, has requested for tennination of BPTAffSA citing non~availability ofgas and filed petition in CERC. (v) Further Samalkot Representative has stated that in the above meeting Quote "He clarified that as the generation project is financed on its own merit, they shall not be in a position to pay transmission charges in case it does not operate due to non~availabilityof gas." Unquote 4. Looking into the position of Samalkot Power Limited's that they shall not be in a position to pay transmission charges in the event of non~availabilityof gas has raised an apprehension about the non~realization of taritt and legal disputes thereon. 5. Looking into the pre.sent situation and the present circumstances, it may be appropriate that implementation of Vemagiri Transmission Limited may be taken up matching with the implementation schedule ofsrikakulam~vemagiri 765 kv Dlc line (under implementation through TBCB process). 6. It is, therefore, Hon'ble Commission may consider for: (a) Looking into the CEA advisory that developers not to plan projects based on domestic gas till 2015~16 and no infomlation of gas beyond 2015~16, it is necessary to review the time frame of requirement of Vemagiri Transmission System; (b) The issues emerged out during the 15th Meeting of SR constituents regarding LTA and Connectivity Applications/35th Meeting of Standing Committee on Power System Planning in Southern Region held on and the position taken by IPPs in Yemagiri Area needs careful examination in terms ofti of requirement of Vemagiri Transmission System. Hyderabad - Wardha- Jabalpur 76SkV Ole lines c. Associated substations and their interconnectivity to the grid 6. The above transmission system was granted regulatory approval by the Hon'ble CERe vide order dated wherein the Commission had directed to implement the above transmission system in phases matching with the progress of generation projects. While considering phasing ofthe above planned transmission system only 2 nos IPPs SPL (LTA-2200MW) & 5POL (LTA-ll50MW) had signed BPTA and fum~hed isite Bank Guarantee as per the regulations. Subsequently, GMR Rajahmundry (LTA-775MW) was also granted LTA utilizing the above corridor and they had furnished the Bank Guarantee and signed revised annex-ures to the BPTA in Feb, From the above it may be seen that againstthe total LTA of4325 MW ( ) the transmission system had been taken-up for implementation with a tratjs(er capacity of about MW without N-I contingency criteria. The SPGL has since requested for withdrawal of LTA, thereby the remaining LTA quantum for evacuation shall be 2975 MW, 11. Further, to provide thc requisite (N-l) contingcncy to the planned transmission system, the proposal for implcmentation of 2 nd 76Sk'V V.emagiri :- Khammam - Hyderabad transmission corridors was proposed in the 29 th Meeting ofthe Empowered Committee on Transmission held on 15, , wherein in view of the uncertainty of"ltlc availability of gas, concern were raised regarding utilization of the first Vemagiri transmission corridor itself. SPGL (LTA : 13S0MWl : No physical progress citing nonwavailability ofgas. GMR (LTA 77SM\Yl : First module of Gas & Steam turbine were synchronized with, Ule grid in Aug & Dec, un 1 respectively and remaining idle since then for want of gas allocation. Second Module has also completed first fire and FSNL test and waiting for permission for diversion ofgas: to carry out synchronization test. 13. Utilisation Of Vemagiri TransmiSsion System -. The utilization of the subject transmission system shall depend on the generation of power in the V.emagiri area which in-turn shall depend on the availability ofga~ for the eneration projects. It is evident from the above that no additional domestic gas is likely to be available till 2015-/6. Hence, tkvelopers are advised,liot to pia" projects based on domestic gas till 201S 16. MoP&NG has not given any projections for the year 2014-/5 and ',

10 From the above it is secn that till 2015~16 gas is not available for the power plants and b'cyond this also quite uncertain, Here it would be pertinent to mention that the schedule commissioning date for the subject transmission system is April, 2015 which would mean that transmission system shall not be utilized atleast for a year till March, 2016 and beyond which also utilization shall be subject to availability ofgas to the power plants. 14. However it is also a fact that GMR (768MW) is already completed and SPL (2400MW) is partially completed & work on balance is under progress. Therefore, ifavailability of gas is declared without giving atleast 3-4 years of time which is required for development of planned transmission system then the' entire generation capacity shall be bottled which may not be desirable in the present deficit scenario. 15. Further it is to be mentioned that additional, intenegional transmission link viz. Srikakulam - Vimagiri 765kV Dlc line has been recently recommend,cd by Empowered Committee in its 29 1ll meeting held on ISill,June, for implementation through TaritfBased Competetive Bidding route This link in conjunction with the Angul - Srikakulam 76SkV Ole!.ine "(un'der implementation ~ a part of Transmission Syst~m for Srikakulam IPPs) shall facilitate import of powe.r from IPPs i!1 Orissa to Southern region,. 12 I Report ofsite Visit to the IPPs generation Projects in Vemagiri Area In the 29 lh meeting of the Empowered Committee on transmission held on June 15, 2012 at New Delhi, it was decided that a tcam of CEA and POWERGRID officials would visit the lpps generation projects sites in Vemagiri area to get first hand infonnation on the status of generation projects. Samalkot has planned to setup 2400 MW in the present phase of development comprising of 3 modules (2 GTs + I 8T) of 800 MW each. though there is a space provision for enhancing the capacity by additional 2 modules of similar capacity. It has been infonned that 2 GTs (250 MW each) has already been synchronized once and is presently idle for want of gas allocation. 13 I II has been observed that physical work for 1st Steam turbine has been commenced '" and has been scheduled for synchronization lest by March, 2013 The 400kV GIS switchyard has 23 nos. of bays out of which 16 nos. of bays have already been erected and work on balance 7 nos. of bays is under progress which is scheduled for commissioning in next 2 3 months. The construction of dedicated lines from switchyard to VemagioMII Pooling slation has also been commenced and about 20 nos. of towers out of 39 nos. for line- J has been completec. General observation - the worked at the generation was observed to be going 011 fuji swing with number of large cranes deployed at the project site. It was intonned that... about workers are presently working at site and construction work is goint on as.. per scltedules. The photographs ofthe site is given at Annexure -I. 2. Gl\fR Rajahmundry Energ)! Limited There is a existing 380 MW generating station (1 GT + 1 S1) which is connected by a 400kV Ole line to exis~dgvemagiri substation of A.P'I'RANSCO. GMR has plans to setup 768 MW in the present phase of development comprising of 2 modules (1 GT + I ST) of384 MW each. Proposed GTG#2 & STGn were synchronized With the grid. in Aug & Dec, 2011 respectively. Si~i1ar1y 01'0#3 &. STG#3 have als~ completed first.fire and FSNL test and. waiting for pcnnission for diversion of gas to carry out synchronization test. Entire switehyard including Bus reactor have also been test charged. It was informed that 400 kv dedicated line to Vemagiri Pooling Station of Powergrid would be completed byjuly The photographs of the site is given at Annexure - I. 3. RVK Energy Limit~ [j "'O' GlI",,,... ~ tf: "0 ~ >.-. ;t ~. Presently there is 37 MW of Gas Engines (like 00 sets that run on Gas instead of diesel). 1bese Gas Engines comprise of 3 nos. of new units of9 MW each and 3 nos. of 3.25 MW each shifted from their project al Maehilipattnam. It was informed that since erection these units have not been operat~ due to nonp.vaijability ofgas. -11 ~

14 f In the second phase additional 37 MW Gas Engines had been planned and their foundation has been constructed but it was not pursued further due to non-availability of gas. In!.he Phase-IU. 360 MW of plant was proposed for which Connectivity was granted by POWERGRID as the proje<.1 deveioper had most of LIte necessary clearances available.. H,pwever in view of non-availabilityofgas. no physical activity has been observed at site for Ute phase-iii project. The photographs of~e site is given at Annexure-I. 4, Spectrum Power Generation Ltd. (SPGL) ~ently there is existing 208 MW generating station which is connec:ted ~o AP State.'grid ~ugh 220kV lines. It was infonned that for past some time the plant is running at very less PLF due to limited availability'of Gas. In the present phase of development. SPGL h.as planned to augment lhe existing.. capacity by 1400 MW gas based generation project. It- was informed that the placement of award for BTG & BoP were about 10 be made. wh~n non-a.vaiiability of gas (or coming 34 years was notified by the Govt. The team did not observe any activity going on at site towards implementation of the proposed augmentation ofthe generation project. 5. Conclusion From.the site visit of above 4 number of Gas based IPP generation projccts, it was seen that GMR project of 768 MW is already completed and Samalkot project of2400 MW is partially complet~. Tp,erefore. these two projects with a cumulative capacity of about 3200 MW is likely to be available with good certainty. Commissioning of the balance two projects viz. SPGL & RVK with cumulative capacity of 1760 MW shall depend on availability of gas and till that time uncertainty about these projects would rem ain.

Long Term Access and Connectivity Applications in Southern Region held on 4 January, 2013 at Gurgaon. List of Participants is enclosed at Annexure-I. 1.0 COO (cru), POWERGRID welcomed the participants for the 15 lh Meeting of Southern Region (SR) constituents regarding Long Term Access and Connectivity applications of SR. In his opening remarks, he infonned thnt as per the earlier circulated agenda, POWERGRlD have received 5 nos. of new connectivity applications from Wind generation developers. He infonned that there is no bay space in the existing POWERGRID substation in the area to accolllmodate these wind generators. Further these wind generators have not applied for LTA so there is no commitment under LTA for development of new transmission system. Therefore, these applications need to be discussed in details to work Ollt their connectivity system. COO (CTU), POWERGRID requested CDE (CTU), POWERGRID to proceed with the agenda for the meeting. 2.0 Confirmation of the minutes of 14 th Meeting or Southern Region constituents regarding Long Term Access and Connectivity applications 2.1 POWERGRID stated that, there were no comments received on the minutes of the 14 lh Meeting of Southern Region constituents regarding Long Tenn Access and Connectivity applications issued vide letter dated and the minutes are confinned. Copy of the minutes is available at POWERGRID website ( 3.0 Common Transmission System Assochlted with IPP Ilrojccts ill Srikakulam Area, Andhra ]lradesh 3.1 POWERGRID informed that the transmission system for evacuation of power from IPP projects in Srikakulam area was earlier planned to be developed under 2 phases viz. the 765/400 kv SrikakuJam Pooling Station along with SrikakuJam - Angu] 765 kv Dlc line to be initially charged at 400 kv under the "Common Transmission System Associated with lpp projects in Sri kakul am Area Pan - A" and subsequently upgraded to 765 kv level in "Common Transmission System Associated with IPP projecls in Srikakulam Area Part - e". 3.2 During the 33 rd Meeting of Standing Committee on Power System Planning in Southern Region held on 20 lh October Srikakulam Pooling Slation - Vemagiri Pooling Station 765 kv Dlc line was approved to facilitate import of power to Southern Region due to changed load generation scenario and this is being implemented through Tariff Based Competitive Bidding. Further, there is lot of resistance from local people also. From about 20 nos. of sites surveyed, we have zeroed on one of the most suitable site but the same is not enough to accommodate nonnal 765/400 kv AIS substation. Considering all these factors he proposed that Srikakulam Pooling Station may be constructed with 400 kv ponion as AIS and 765 kv portion as GIS. 3.3 POWERGRJD further infomled that in this regard, CEA vide its letter dated has already conveyed their in-principle clearance for constructing Srikakulam Part - A and Pal1 - C together in the same time frame and Srikakulam Poolinp Station with 400 kv portion as AIS and 765 kv portion as GIS subject to regularisatlon in the next Standing Committee Meeting. 3.4 After discussion it was agreed for constructing of Srikakulam Part - A and Part - C together in the same time frame and Srikakulam Pooling Station with 400 kv portion as AIS and 765 kv portion as GIS. with suitable deletion of elements meant for initial charging the system at 400 kv from the scope of Part - A. 4.0 Implementation of CODuIlon Transmission System Associated with IPPs in Vemagiri Area, Andhra Pradesh & Request of GMR Rajahmundry Energy Limited for connectivity through LILO of Vijayawada - Gazuwaka 400 kv SIc line as an interim arrangement till the commissioning of Vemagiri Pooling Station. 4.1 PQWERGRID infomled that the Common Transmission System Associated with lhe lpps in Vemagiri area, Andhra Pradesh interalia comprised of two nos. of 765kV Ole line from Vemagiri to Hyderabad via Khammam. Looking into the unccrtainty of lhe availability of Gas only onc 765kV Ole line was under taken for implementation through Tariff Based Competitive Bidding route which was planned 10 be initially charged at 400kV level. It was also informed that during the joint visit by CEA & POWERGRID, it was gathered that GMR project of 768 MW is already commissioned & Samalkot project of 2400 MW is partially commissioned and arc waiting for gas allocation. Also Srikakulam - Vemagiri 765kV Ole line has been planned to facilitate import to Southern Region for meeting future load demand. 4.2 Considerating all these factors PQWERGRID have proposed to charge the Ve agiri _GAo+ Khammam - Hyderabad 765kV Ole line at its rated voltage of 765kV right ~~' tb beginning. for which CEA vide its leher dated 17 th September, 2012 ha 'e' i conveyed its in-principle approval subject to regujarisation in the next m' 0 Standing Committee. Oct.~ 4.3 POWERGRID. further stated Ihat the Common Transmission System inter-alia also comprised of Hyderabad - Wardha 765kV Ole, which upon the decision of Empowered Committee on Transmission, POWERGRID is implementing this line. It has been learnt from the site that as per the preliminary survey the line length of this line is becoming more then 500 kms. The increase in line length is due to line routing, to avoid Hydcrabad City limits and Forest stretches. P 8' I"I~ 1.-1

24 Minut~s of J~ Muting ofsr comtitu~nts rtgording LTA ond Con/J«tivit)' OppliCUliQns In view of the above, POWERGRID proposed to establish a 765/400 kv substation al intennediate location enroute Hyderabad - Wardha 765 kv Ole line making Hyderabad - intennediate substation - Wardha 765 kv Dlc line and the intennediate substation at 400kV level shall be connected to Southern Grid which shall be decided later based upon the Joint studies ofaptransco, POWERGRID & CEA. 4.4 After discussion following transmission system was agreed a} Vemagiri - Khammam - Hyderabad 765kV Dlc line shall be charged at its rated voltage of 765kV level right from the beginning. b) Establish a 765/400kV substation at intennediate substation enroute Hyderabad Wardha 765kV D/c line making Hyderabad - intennediate substation - Wardha 765 ky D/c line with suitable interconnection at 400kY level to southern regional grid. It was further decided that the location of intennediate 765/400kV substation and its interconnection at 400kY level to SR grid shall be decided separately in association with APTRANSCO. 4.5 GMR Rajahmundry Energy Limited (OREL) infonned that their 768 MW Gas based power plant is ready; however there is no generation due to un-availability of Gas. Further they have indicated that they are implementing the connectivity line 400 kv quad line from their power plant to kv Yemagiri Pooling Station as per the revised intimation issued by POWERGRID. The Vemagiri Pooling station is targeted for commissioning by April, 2015 matching with commissioning of TBCH lines. Considering the timeline of Vemagiri Pooling station, GREL have requested LILO of Gazuwaka~Vijayawada 400 kv SIc line at their power plant by joining their connectivity 400 ky line as an interim arrangement till the commissioning of Vemagiri Pooling station of POWERGRlD. 4.6 POWERGRID representative stated that as per revised connectivity granted to GMR on their request, the connectivity line to be constructed by GMR is to terminate at Vemagiri pooling stalion. POWERGRID has completed all the preliminary activities for taking up construction of Vemagiri pooling station. As this is a GIS substation various issues of equipment compatibility are involved hence POWERGRID had been repeatedly requesting GMR and Samalkot for signing of agreement for implementation of bays at Vemagiri pooling station for tennination of their dedicated line. However both the generation developers are not agreeing for the same and are delaying it. In view of this, it may be appreciated that if POWERGRID starts working on implementation of Vemagiri pooling station without waiting for...p agreement for implementation bays for tennination of dedicated line. a the IPPs tenninate their connectivity transmission line then not only Ve station shall remain unutilised but shall also lead to compatibility issue 0 a later date when these generation developers decide to tenninate their tkl!lliilli'']j;t~ line. 4.7 Samalkot representative stated that uncertainty with respecl to availability of gas is known yet they have made investment in the generation project and it is not that there is no gas, it is just time frame of its availability is uncertain. He stressed that utility of Vemagiri substation is coupled with the availability of Vemagiri - Khammam - Hyderabad line, however, the order from CERe on the license application of PQWERGRlD is yet 10 come. This adds 10 the uncertainty with respect to availability of Vemagiri - Khammam - Hyderabad line also DGM ectu) staled that taking into consideration Ihat the generation project of GMR is already on the ground and that of Samalkot is partially completed, it would be required that Vemagiri Pooling station and the Vemagiri - Khammam - Hyderabad line are implemented as per schedule. He further mentioned as the generation developers are not facilitating implementation of Yemagiri pooling station which may lead to delay in Yemagiri Transmission system and under such situation if availability of gas is announced at a short notice the generation shall be bottled leading to disputes especially in the light of LTA already granted to both Samalkot and GMR. Samalkot representative mentioned that the application for LTA has been made with tentative/target beneficiaries hence as per their understanding of present CERe regulations their LTA cannot get operationalised until the beneficiaries are tied up. Under such situation he questioned the relevance/validity of the BPTA signed with CTU. He further stated even question of levying transmission charges is very vital. He clarified that as the generation project is financed on its own merit, they shall not be in a position to pay transmission charges in case it does not operate due to nonavailability of gas. Therefore, they arc taking step by step decision as the question here it not only for transmission charges on account of bays for termination of dedicated line at Yemagiri pooling station but also that of entire Vemagiri transmission system corresponding to 2200 MW. He stated that in the background of uncel1ainty of availability of gas and time frame of commissioning of onward Vemagiri - Khammam - Hyderabad due to delay in disposal of license application by CERe they don't find any merit is agreeing to sign the agreement with POWERGRlD for implementation of bays at Vemagiri pooling station. Regarding levy of transmission charges, CTU clarified that Samalkot Power is liable for payment of charges in the event of commissioning of transmission system even when LTA cannot get operationalise due to beneficiary not tied up. In fact many generators are presently paying transmission charges in this category. Towards this, the representative of Samalkot had indicated that their understanding as indicated above (at the beginning of para) remains same. Based on the discussions, the following issues emerged out: The uncertainty of gas still remains and the lenders have put restriction even for the baysjqr-t~{mjnation of dedicated line at Vemagiri Pooling GURG...,O t:~i ~o. Jt was decided that a separate meeting shall be convened in CEA for addressing this issue As regards the request of GMR for interim LJLO the matter was deliberated and as the constituents were not in agreement the same was not agreed to. 5.0 Request of Lanco Kondapalli Power Limited (LKPL) for reduction of Long4erm Open Access granted from their Phase-II power plant from 250 MW to 75 MW 5.1 POWERGRlD infonned that LANCO KondapaJli Power Limited (L.K.PL) was granted Long-term Open Access (LTOA) for a quantum of 350 MW in June for a period of 25 years and the same was to become effective from date of commissioning of the generation project. The LTOA was granted for target beneliciaries in WR MW and NR MW. Subsequently. in January LKPL submitted request for reduction of LTOA quantum by 100 MW. The above proposal was discussed and approved in the 33 rd meeting of Standing Committee on Power System Planning in SR and 19 lh meeting of SRI'C. 5.2 Further vide letter ref. no. LKPL:PGCL:4489:2012 dated 14 August, 2012 and subsequent reminder dated 4 September, 2012, LKPL have requested for reduction of LTOA qu<lntum from 250 MW to Zcro MW. )- The major reasons mentioned by the LKPL for secking reduction of LTOA qu<lntum to Zero MW are as below: o Non- av<lil<lbility of g<ls due to reduction of gas from KG D6 basin. Hence they are bound to sell electricity in Andhra Pradesh only and that too through short tenn route only. 5.3 The issue was deliberated during the 20th meeting of SRPC held on 28 September, 2012 in Hyderabad and the decision is reproduced as below: "Tile Committee agreed with the recommendation oftcc that in view ofthe petition filed before l'lon'ble CERC by POSOCO. statlls quo of presem billing may be continued Subsequently LKPL vide their lettcr dated 29 November 2012 has requested for reduction of LTA from 250 MW to 75 MW and request for change in the target region from WR, NR to SR. Further vide above letter LKPL had indicated that reduction of LTA is sought due to the continuous reduction in the output of KG 0-6 basin, Also vide above referred letter LKPL has indicated change in target region from WR & NR to SR because electricity supply to home state has been made a pre-condition for supply of gas. 5.5 LKPL representative said that though they have been granted LTOA for 350 MW, however in absence of PPA with beneficiaries their LTOA is not getting effected and they are not getting any benefit of LTOA regulations in priority, scheduling etc. for their generation. However in absence of PPA they are resorting to STOA for power transfer from their generation projeci. Further they are not getting full capacity gas and also have given undertaking to MOP for sale of power to Andhra Pradesh, therefore the LTOA may be reduced to 75 MW and target regions may be changed to Southern Region. 5.6 APTRANSCO representative statcd that they are not agrecable to reduce the quantum from 250MW to 75 MW, 5.7 KPTCL was of the opinion that the quantum & target regions should remam unchanged ,0 6.1 SRPC was of the opinion that the direction from MOP in this regard may be followed for the gas based generation projects. The dedicated line to Nellore was proposed while granting LTA, keeping view the generation schedule. availability of bays at Nellore & conservation of the Right-of-way for the corridor. The common transmission System for LTA is under implementation by POWERGRID and is expected to be commissioned by September, Under this system it was proposed to LILO both circuits of SEPUMEPL-Nellore 400 kv Ole line at Nellore Pooling Station. 6.3 Both these generation projects SEPL & MEPL have commissioned their first unit and during the commissioning they faced difficulties in scheduling, dispatch, metering, energy accounting including UI etc. Therefore. MEPL has approached the Hon'ble CERe vide their petition no. 205/MP12011 and while disposing the petition on the commission directed as below: "The generating stations ojthe petitioner (MEPL) and Respondelll No.5 (SEPL) shall be treated by SRLDC as separate (Ind independem emitiesjor the p"rpose 0/ schedllling and dispatch, metering. energy accounting i"cluding VI computation by opening the inter-connection line between the genero/ing Sl(ltion5 and installing separate meters af the illlercollllel't;oll points at Ne/lore. We order accordingly... In view of the direction of CERC to open the interconnecting line betwecn these generation projects, the generation projects are gelling radially connecting to Nellore through 400 kv SIc (quad) line. This arrnngement has lead to failing in N-I reliability criteria for both the generation projects. 6.4 However for meeting N-I criteria, additional 400 kv Dlc linc to Nellore Pooling Station is proposed from anyone of the power plant. Upon commissioning of proposed line the existing dedicated MEPUSEPL - Nellore 400kV DIe line may be re-routed forcmanating from one power plant only. 6_5 The MEPL representative stated that they have gone to Appellate Tribunal for Electricity against the order of CERe and made presentation & proposed two options that committee may consider for the metering arrangement or the dedicatcd transmission line may be taken over by the POWERGRID. 6.6 POWERGRID infomled that it can not take over a transmission line developed by a private party P.~.,6.?2 ")...6

In this regard. he explained that UPCL generation is an ISGS having allocation to more than Olle State who have sought and granted LTOA to Inter State Transmission System (lsts). 7.2 The transmission system identified for grant of LTOA included NPCL switchyard Hassan 400 kv quad Dlc as dedicated line and Hassan - Mysore 400kV Dlc line as system strengthening. However, subsequently. dedicated transmission line was constructed by KPTCL as State sector line. He further infonned that the applicant despitc repeatcd efforts have not signed requisite agreement for sharing of applicable transmission charges. 7.3 Director (KPTCL) expressed that they are not agreeable for seeking LTOA for their share of power from the UPCL generation project. 7.4 Member Secretary (SRPC) mentioned that this issue has been regularly appearing as agenda item in SRPC meetings with no resolution. Further it is directed by Hon'ble CERe that the transmission system development should be phased to uvoid creation of any redundant transmission capacity. In the past, to facilitate project dcvelopment activities POWERGRlD had granted connectivity/lta even to projects who had not achieved importmh milestones but in such cases it is seen that such IPPs arc repeatedly delaying the signing of BPTA and fumishing Bank Guanll1tee. Such delay in the BPTAlBG complicates the mauer, especially in the scenario of implementation of transmission system through competitive bidding, where the selected bidder is not liable to delay/advance the commissioning schedule to match with the generation progress. 9.2 In this regard, at present there are number of Connectivity & LTA applications pending for about I to 21h years. These applications had been taken lip sillce last 3-4 meeting with not much progress observed in respect of project development. In view of the forgoing and to avoid unrealistic planning, POWERGRID proposed to close these applications and they may apply afresh whenever the projects have progressed in getting requisite clearances.
