9 GENERAL RULES AND REGULATIONS TYPES OF SERVICE RULE 2 Page 1 Types of Service A. Cost-Based Service This Service Election provides Electricity Services in the traditional manner. The Company provides all Electricity Services to the Consumer and the Consumer purchases all Electricity Services from the Company under applicable appropriate tariff schedules. Consumers who have not affirmatively chosen a Service Election remain on Cost-Based Service. Consumers receiving Direct Access or Standard Offer service that wish to switch to Cost-Based Service must meet the returning service requirements described in Schedule 201. B. Direct Access Service This service election allows Nonresidential Consumers to purchase Electricity and Ancillary Services from ESSs. Consumers electing Direct Access Service will purchase Delivery Service from the Company under a Delivery Service schedule, and may also purchase Ancillary Services and Billing Services from the Company under applicable schedules. C. Demand Pulse Access Service Company will provide access to Company's metering pulses proportional to Consumer's kilowatt-hour usage by means of Demand Pulse Relay equipment to be owned, installed and maintained by Company. The installation of Company owned Demand Pulse Relay equipment shall be conditioned on the following: 1. Consumer enters into an agreement with Company for not less than one year and pays Company an amount as specified in Schedule 300 for installation, operation and maintenance of Demand Pulse Relay equipment. 2. Ecept for metering equipment normally furnished for Consumer's load characteristics, any metering equipment or associated work that must be provided to make the Demand Pulse Relay operable, shall be by Company at Consumer's epense. 3. The Company's billing meter installation shall, in all instances, govern in establishing Consumer's energy and demand record for billing purpose. 4. The Company's meter used in determining the Consumer's billing shall measure demand by rolling consecutive subintervals and shall not provide end of interval pulses to the Consumer. 5. Company reserves the right to interrupt the supply of pulse information to perform meter tests or maintenance procedures and assumes no responsibility for the effect on the Consumer's operation or equipment. 10 DIRECT ACCESS RULE 21 Page 10 VII. Standard Offer and Cost-Based Service B. Form of Authorization is authorized to make the change and authorizes the Company to provide service; and (8) the Consumer's signature or electronic authorization, and title. C. Implementation 1. The request for Standard Offer or Cost-Based Service will be subject to all Tariffs for new Company service, including applicable deposit provisions stated in Rule The Consumer must give the Company at least five business days notice before the date it wishes to switch to default Standard Offer Service. Additional notice periods may apply to other Standard Offer Service rate options as set forth in this Tariff. 3. A Consumer receiving Standard Offer or Direct Access Service may return to Cost Based Service only by complying with the returning service requirements stated in Schedule 201. If the Company receives a request for Cost-Based Service from a Consumer ineligible for such service under this Rule, then the Company will notify the Consumer of its ineligibility and request a new authorization from the Consumer for Standard Offer Service. 4. Requests for Standard Offer Service that require a meter change by the Company may be served using eisting acceptable metering equipment. Billing for such Consumers will be based on load profiles specified by the Company until standard metering equipment is installed. Consumers seeking Standard Offer Service will receive the same priority for changes in standard metering equipment as other Consumers. 5. If the change date does not coincide with the Company's established meter reading schedule, the Consumer will pay to the Company the applicable charge for off-cycle meter reading specified in Schedule 300. The Company will provide the option to Consumers of switching on a date that coincides with the Company's established meter reading schedule. 6. The Company and the Consumer may, by mutual agreement, agree to a different date for the service changes requested by the Consumer. 7. The Company will notify the Consumer's EES within 5 business days of the day that a Consumer requests Standard Offer or Cost Based Service. 11 RESIDENTIAL SERVICE DELIVERY SERVICE SCHEDULE 4 Available In all territory served by the Company in the State of Oregon. Applicable To single-family Residential Consumers only for all single-phase and three-phase electric requirements when all service is supplied at one point of delivery. Three-phase service will be supplied only when service is available from Company's presently eisting facilities, or where such facilities can be installed under Company's Line Etension Rules, and, in any event, only when deliveries can be made by using one service for Consumer's single-phase and three-phase requirements. Monthly Billing The Monthly Billing shall be the sum of the Distribution Charge and Transmission & Ancillary Services Charge plus applicable adjustments as specified in Schedule 90. Additionally, each Consumer shall specify Supply Service Schedule 201, Schedule 210, Schedule 211, Schedule 212 or Schedule 213, as appropriate and in accordance with the Applicable section of the specified rate schedule. (R) (R) I Special Conditions Consumer shall so arrange his wiring as to make possible the separate metering of the three-phase demand at a location adjacent to the kwh meter. If, on November 25, 1975, any present Consumer's wiring was arranged only for combined single and three-phase demand measurement, and continues to be so arranged, such demands will be metered and billed hereunder ecept that the first 10 kwof such combined demand will be deducted before applying demand charges for three phase service. No new combined demand installations will be allowed such a demand deduction. Continuing Service This Schedule is based on continuing service at each service location. Disconnect and reconnect transactions shall not operate to relieve a Consumer from minimum monthly charges. Rules and Regulations Service under this Schedule is subject to the General Rules and Regulations contained in the tariff of which this Schedule is a part and to those prescribed by regulatory authorities. 12 OUTDOOR AREA LIGHTING SERVICE NO NEW SERVICE DELIVERY SERVICE SCHEDULE 15 Page 1 Available In all territory served by the Company in the State of Oregon. Applicable To all Consumers for outdoor area lighting service furnished from dusk to dawn by means of presently-installed Company-owned mercury vapor or high-pressure sodium luminaires which may be served by secondary voltage circuits from the Company's eisting overhead distribution system. Luminaires shall be mounted on Company-owned wood poles and served in accordance with the Company's specifications as to equipment and installation. Monthly Billing The Monthly Billing shall be the Rate Per Luminaire plus applicable adjustments as specified in Schedule 90. Special Conditions Maintenance will be performed during regular working hours as soon as practicable after the Consumer has notified the Company of service failure. The Company reserves the right to contract for the maintenance of lighting service provided hereunder. The Consumer may request temporary suspension of power for lighting by written notice. During such periods, the monthly rate will be reduced by the Company's estimated average monthly relamping and energy costs for the luminaire. The Company will not be required to reestablish such service under this rate schedule if service has been permanently discontinued by the Consumer. 13 GENERAL SERVICE - SMALL NONRESIDENTIAL DELIVERY SERVICE SCHEDULE 23 Page 1 Available In all territory served by the Company in the State of Oregon. Applicable To Small Nonresidential Consumers whose entire electric service requirements are supplied hereunder and as specified in the Company's Rules & Regulations, Rule 7.K. Deliveries at more than one point, or more than one voltage and phase classification, will be separately metered and billed, ecept as provided below for Communication Devices. Service for intermittent, partial requirements, or highly fluctuating loads, or where service is seasonally disconnected during anyone-year period will be provided only by special contract for such service. Monthly Billing The Monthly Billing shall be the sum of the Distribution Charge and Transmission & Ancillary Services Charge plus applicable adjustments as specified in Schedule 90. 14 GENERAL SERVICE - SMALL NONRESIDENTIAL DELIVERY SERVICE SCHEDULE 23 Page 2 Minimum Charge The minimum monthly charge shall be the Basic Charge and the Load Size Charge. minimum may be required under contract to cover special conditions. A higher Reactive Power Charge The maimum 15-minute reactive demand for the month in kilovolt-amperes in ecess of 40% of the measured kilowatt demand for the same month. Such unmetered devices not eceeding 35 line watts per unit, served under multiple Points of Delivery to a single Consumer, may be grouped under a single Consumer account for billing purposes such that the Consumer pays a single Basic Charge for multiple units in addition to a per unit energy-based charge. Not more than 100 units shall be grouped under a single account. All devices are required to be installed and maintained under a pole attachment agreement. The Consumer is required to notify the Company in writing and receive subsequent approval prior to installation, modification or removal of any device. All devices mounted to Company owned facilities shall be installed, maintained, transferred or removed only by qualified personnel approved in advance by the Company. If approved qualified personnel are not available or at the Company's discretion, the Company may perform these functions at the Consumer's epense. Supply Service Options All Small Nonresidential Consumers taking Delivery Service under this schedule shall pay the applicable rates in Schedule 200, Base Supply Service. If the Consumer satisfactorily follows the Company-approved Load Reduction Plan during the Penalty Period the load reduction plan kw credit will be reinstated at the end of the three month Penalty Period. If the Consumer fails to follow the Company-approved Load Reduction Plan during the Penalty Period, all kw credits for an additional three months period shall be forfeited. If the Consumer satisfactorily follows the Company-approved Load Reduction Plan during the second three month Penalty Period, the load reduction plan kw credit will be reinstated at the end of the second three month Penalty Period. If the Consumer fails to follow the Company-approved Load Reduction Plan a second time during the combined si month period, the Load Reduction Plan shall be terminated. The duration of the Penalty Period shall not be limited by the establishment of a new contract. Following termination or contract epiration, Consumer may submit a new Load Reduction Plan to the Company. Applicable To service furnished from dusk to dawn for the lighting of public streets, highways, alleys and parks by means of presently-installed mercury vapor lights. Service includes installation, maintenance, energy, lamp and glassware renewals. If qualified personnel are not available, the Company may maintain these at the Consumer's epense. Appurtenances or other alterations to the Company's standard will not be supported by, or become the responsibility of, the Company. Following notification by the Consumer, inoperable lights under this provision will be repaired as soon as possible, during regular business hours or as allowed by Company's operating schedule and requirements. Costs described in this provision will be invoiced to the Consumer upon completion of the work. 3. The entire system, including the design of facilities, installation of fitures on Consumer poles, and wiring suitable for connection to Company's system, will be furnished by the Consumer. 4. Consumer must notify the Company in writing of any changes to the street lighting system which would affect billing, including new installations, removals or wattage changes. Applicable To schools, governmental agencies and nonprofit organizations for service supplied through one meter at one point of delivery and used eclusively for annually recurring seasonal lighting of outdoor athletic or recreational fields. This Schedule is not applicable to any enterprise which is operated for profit. Service for purposes other than recreational field lighting may not be combined with such field lighting for billing purposes under this Schedule. At the Consumer's option, service for recreational field lighting may be taken under the Company's applicable General Service Schedule. 46 NET POWER COSTS COST-BASED SUPPLY SERVICE SCHEDULE 201 Page 4 Returning Service Requirements (N) For Nonresidential Consumers who have chosen service under Schedule 220, Standard Offer Supply Service or who have chosen Direct Access Delivery service under the applicable tariff. A Consumer shall meet the Returning service Requirements of this Schedule by making a request to the Company to receive service under this Schedule and agreeing to pay to the Company a Returning service Payment that compensates for the increased cost of serving such returning Consumer due to an increase in market price as compared to the market price used in determining the Consumer's applicable transition credit as specified under Schedule 294. Upon return to this Schedule, PacifiCorp will cease applying Schedule 294 to the returning Consumer receiving service under this Schedule and shall remove the Consumer's Schedule 294 credit from the transition adjustment balancing account. Returning Service Payment, epressed in dollars, shall be the result of multiplying the epected remaining monthly usage times the difference between the forward market price at the time of the Consumer's request to return to Cost-Based Supply Service and the forward market price used for determining the Schedule 294 Transition Adjustment, times 110 percent. The Payment shall be based on the Consumer's epected monthly usage and the Company's current forward energy market prices. The Consumer's epected remaining usage shall be based on a pro rata share of the current month's usage and Consumer's historical data for each remaining month of the period over which the Transition Adjustment was calculated. Consumer's usage will be allocated into peak and off-peak periods by month using a predetermined peak/off-peak ratio for Customer's applicable Delivery Service Schedule. The payment will be calculated by multiplying the monthly allocated peak- and off-peak usage by the difference between the forward market price at the time of the request and the forward market price used for the Schedule 294 Adjustment. The Returning Service Payment will only apply if the result of this calculation results in a positive number. For the Consumer who chooses direct access service or Schedule 220, the Consumer will pay the Returning Service Payment to return to service under this schedule. This adjustment is to recover the actual and forecasted revenue requirement associated with the prudently incurred costs of resources, including associated transmission, that are eligible under Senate Bill 838 (2007) and in service as of the date of the proposed rate change. The revenue requirement includes the actual return of and grossed up return on capital costs of the renewable energy source and associated transmission at the currently authorized rate of return, forecasted operation and maintenance costs, forecasted property taes, forecasted energy ta credits, and other forecasted costs not captured in the Transition Adjustment Mechanism (TAM). 50 PORTFOLIO TIME-OF-USE SUPPLY SERVICE SCHEDULE 210 Page 2 Off-Peak Period All non On-Peak Period plus the following holidays: New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day. Guarantee Payment The Company shall guarantee against increase of consumer costs for the first 12 months of enrollment in the program. If the total annual energy costs incurred on this Schedule eceed 10% over what costs would have been for the same period under Cost-Based Supply Service, the net difference, Guarantee Payment, will be credited on the customer's bill following the last month of the one-year commitment. The Portfolio Service Charge shall not be included in the calculation of the Guarantee Payment and shall not be credited. No Guarantee Payment shall be given if Consumer terminates service before the end of the initial one-year period. Special Conditions 1. The Consumer shall not resell electric service received from the Company under provisions of this Schedule to any person, ecept by written permission of the company and where the Consumer meters and bills any of its tenants at the Company's regular tariff rate for the type of service which such tenant may actually receive. 2. The Company will recover any lost revenues and Guarantee Payment amounts incurred under the Portfolio Option through adjustments to Schedule 291 or Schedule Consumers on this tariff schedule shall have a term of not less than one year. Service will continue under this schedule until Consumer notifies the Company to discontinue service. 4. The Consumer must have a time-of-use meter installed to participate in this option. The Company anticipates that a delay may occur from the time a Consumer requests service under this option until the Company can provide the meter installation. In the interim, Consumers will receive service under the applicable Delivery Service schedule on Supply Service Schedule Billing under this schedule shall begin for the Consumer following installation of the time-of-use meter and the initial meter reading. 6. Energy Charge Per kwh 1.20 Administration Product provides Renewable Power. The Company is acquiring Renewable Energy Credits (RECs) through a Commission-approved bid process to support this product. Funds received from participating customers under this Schedule will be used to purchase RECs to match participating customer's monthly electricity usage and to cover program costs. Funds remaining after purchasing RECs and covering program costs will be donated to a renewable energy development and demonstration fund, which will be used to fund renewable energy projects in the state of Oregon. Renewable Power Eligible renewable technologies that may be used to supply certified power include the following: low emissions biomass - including landfill and sewage gas, geothermal, certified low impact hydroelectric, solar, wind and fuel cells using a renewable fuel. Certified products must meet certain minimum standards for the supply of new eligible renewable energy (kwh). Renewable energy generated in response to any federal or state statutory reqyirement to construct or contract for the renewable energy is not eligible as new. New renewable resources are those (1) placed in operation (generating electricity) on or after July 23, 1999, therefore ecluding electricity generated by that part of the Wyoming, Foote Creek Wind Project fully in service before July 23, 1999; (2) repowered on or after July 23, 1999 such that at 80% of the fair market value of the project derives from new generation equipment installed as part of the repowering, or (3) a separable improvement to or enhancement of an operating eisting facility that was first placed in operation prior to July 23, 1999, such that the proposed incremental generation is contractually available for sale and metered separately than eisting generation at the facility. Any enhancement of a fuel source that increases generation at an eisting facility, without the construction of a new or repowered, separately metered generating unit, is not eligible to participate. Charge per Block $1.95 per month Renewable Energy Renewable Energy includes bundled power or Renewable Energy Credits (RECs) derived from the following fuels: wind; solar; geothermal energy; certified low impact hydroelectric; hydrogen derived from photovoltaic electrolysis or a non-hydrocarbon derivation process; wave or tidal action; and low emissions biomass based on digester methane gas from landfills, sewage treatment plants or animal waste and biomass energy based on solid organic fuels from wood, forest or field residues or dedicated crops that do not include wood pieces that have been treated with chemical preservatives such as creosote, pentachlorophenol or copper chrome arsenic. Renewable Energy Credits (also known as Tradable Renewable Energy Credits, Renewable Energy Certificates, Green Tags or Carbon Credits) represent all of the regional and global environmental and emissions benefits associated with one unit of output from a qualifying renewable electricity generating resource. In some markets, the credits are certified by an independent third party and include a serial number for tracking purposes. 56 EMERGENCY SUPPLY SERVICE SCHEDULE 230 Available In all territory served by the Company in the State of Oregon Applicable To Nonresidential Consumers. Service commences upon the Company becoming aware that the Nonresidential Consumer's ESS is no longer providing service. Delivery Service shall be billed under the Consumer's applicable rate schedule from the following: Schedule 23,28,30,41,47,48,51,52, 53, 54. The Consumer must move off of this service within five business days of commencing service under this Schedule. Energy Charge The Energy Charge shall be based on the Energy Charge Daily Rate as described below. The Energy Charge Daily Rate is the Dow Jones Mid-Columbia Daily Electricity Firm Price Inde (DJ- Mid-C Inde) plus the Emergency Default Risk Premium plus the adjustment for losses. If prices are not reported for a particular day or days, the average of the immediately preceding and following reported days' on-peak and off-peak prices shall be used to determine the price for the non-reported period. On-peak and off-peak hours shall be defined as reported by Dow Jones for the Mid-Columbia Inde. If resource, market, or other system conditions deviate significantly from epected conditions at the time the Company accepted the customer's request for Scheduled Maintenance Energy, the Company may cancel Scheduled Maintenance Energy at any time with seven days notice prior to the beginning of a Scheduled Maintenance period. 60 TRANSITION ADJUSTMENT SCHEDULE 294 Page 1 Purpose The purpose of this Schedule is to adjust prices to reflect the results of the ongoing valuation method under OAR Applicable This Schedule is applicable to all Nonresidential Consumers receiving service under Schedule 220, Standard Offer Service, Schedule 230, Emergency Supply Service or the applicable Direct Access Service Schedule. Transition Adjustment The transition adjustment is the difference between the estimated market value of the electricity that is freed up when a customer chooses to leave Cost-Based Supply Service for Direct Access versus the Company's regulated price. The estimated market value of the freed up electricity is determined by running two system simulations - one simulation with the Company serving the Direct Access Consumer and one simulation with the Company not serving the Direct Access Consumer. The difference between the two scenarios is analyzed to calculate the impact on the Company's total system. The impacts are then used to determine the Weighted Market Value of the energy, which is then compared to the Customer's energy-only tariff schedule rate. On-Peak hours are between 6:00 a.m. and 10:00 p.m. Pacific Prevailing Time (PPT) Monday through Saturday, ecluding North American Electric Reliability Council (NERC) holidays. Due to the epansions of Daylight SaVing Time (DST) as adopted under Section 110 of the U.S. Energy Policy Act of 2005, the time periods shown above will begin and end one hour later for the period between the second Sunday in March and the first Sunday in April and for the period between the last Sunday in October and the first Sunday in November. Eisting Partial Requirements Consumers shall select their Baseline Demand for each contract term based upon the Consumer's peak demand for the most recent 12 months during the times the generator was operating as planned, adjusted for changes in load and planned generator operations. Planned generator operations includes changes in the electricity produced by the generator as well as the Consumer's plans to sell any electricity produced by the generator to the Company or third parties. Any modification to the Baseline Demand must be consistent with Special Conditions in this schedule. Facility Capacity Facility Capacity shall be the average of the two greatest non-zero monthly Demands established during the 12-month period which includes and ends with the current Billing Month, but shall not be less than the Consumer's Baseline Demand. For new customers during the first three months of service under this schedule, the Facility Capacity will be equal to the Consumer's Baseline Demand. Reserves Charges The Company provides Reserves for the Consumer's Facility Capacity. following components: Reserves consist of the Spinning Reserves In addition to the Spinning Reserves provided for the Consumer's Baseline Demand, Spinning Reserves provide Electricity immediately after a Consumer's demand rises above Baseline Demand. Supplemental Reserves In addition to the Supplemental Reserves provided for the Consumer's Baseline Demand, Supplemental Reserves provide Electricity within the first ten minutes after a Consumer's demand rises above Baseline Demand. The agreement shall specify the kw of Spinning Reserves, Supplemental Reserves, or both provided by the Consumer at 3.5 percent for Spinning Reserves and 3.5 percent for Supplemental Reserves of Facility Capacity, the notification processes for delivery of reserve Energy, the requirements for Consumer delivery of requested reserves, the requirements for Consumer notification to Company of any changes in the ability to self-supply Reserves, the settlement process to be used when Reserves are supplied by the Consumer, the provisions for a demonstration of such capability, any additional metering requirements and other necessary notification, plant and financial requirements. For Consumers who self-supply Reserves, Reserves kw credits will be applied to Consumer's bill based on the kw amount of Self-Supplied Spinning Reserves, Supplemental Reserves or both specified in the Self-Supply Reserves Agreement. Supplemental Reserves Load Reduction Plan For purposes of calculating Supplemental Reserves charges, a Consumer may submit to the Company a load reduction plan demonstrating the ability to reduce load within the first ten minutes of generator failure and specifying a kw amount of load reduction. The Consumer's load reduction plan must be approved by the Company. If approved by the Company, and adhered to by the Consumer, a load reduction plan kw credit will be applied to Consumer's bill based on the kw amount of load reduction specified in the Company-approved Load Reduction Plan. If Consumer fails to follow the Company-approved Load Reduction Plan, all kw credits for the subsequent three months (Penalty Period) shall be forfeited. If the Consumer satisfactorily follows the Company-approved Load Reduction Plan during the Penalty Period, the load reduction plan kw credit will be reinstated at the end of the three month Penalty Period. If the Consumer fails to follow the Company-approved Load Reduction Plan during the Penalty Period, all kw credits for an additional three month period shall be forfeited. If the Consumer satisfactorily follows the Company-approved Load Reduction Plan during the second three month Penalty Period the load reduction plan kw credit will be reinstated at the end of the second three month Penalty Period. If the Consumer fails to follow the Company-approved Load Reduction Plan a second time during the combined si month period, the Load Reduction Plan shall be terminated. The duration of the Penalty Period shall not be limited by the establishment of a new contract. Following termination or contract epiration, Consumer may submit a new Load Reduction Plan to the Company. Company will approve the new Load Reduction Plan if the Consumer is able to demonstrate the load reduction capability of the Plan to Company's satisfaction. Notwithstanding the above, Consumer may terminate the Company-approved Load Reduction Plan upon giving written notice to Company as provided in the Self-Supply Agreement. Base Supply Service All Consumers taking Delivery Service under this schedule shall pay the applicable rates in Schedule 200, Base Supply Service.
