This electric unit was recently installed as part of Texas Eastern s Kosciusko Project, which was certificated by the Commission in Docket No. CP09-61, and the design of the Kosciusko Compressor Station reflects that this unit will be operated at 12,500 horsepower. Texas Eastern will utilize the additional horsepower at this unit only to the extent necessary to allow Texas Eastern to maximize its ability to schedule nominated service on its system during an approximate two-week partial outage at the Kosciusko Compressor Station beginning on September 7, 2010 associated with completing the construction and installation of the remaining facilities comprising the Kosciusko Project. Texas Eastern requests that this Application be processed by the Director of the Office of Energy Projects ( Director ) in accordance with the delegated authority provisions of Section of the Commission s regulations. 2 This outage is scheduled to commence on September 7, 2010, and accordingly, Texas Eastern respectfully requests that the Director grant the requests herein by September 7, Such timely approval will minimize the potential effect of the scheduled outage. As described in the Application, no landowners or stakeholders will be affected by this Application, and there will be no environmental impacts associated with this proposal. In light of the foregoing and the request for expedited action, Texas Eastern respectfully requests that the Director waive the notice period for this filing. Texas Eastern recently determined that it may need to operate this electric unit at the increased horsepower to allow it to maximize its ability to schedule service during the partial outage period. Once Texas Eastern has completed construction of the Kosciusko Project, Texas Eastern will place the remaining upgrades at the Kosciusko Compressor Station into service in accordance with the Commission s certificate order in Docket No. CP09-61, and Texas Eastern will operate the electric unit at the design horsepower established in that certificate order. 5 I. Identity of Applicant The exact legal name of Texas Eastern is Texas Eastern Transmission, LP. Texas Eastern is a limited partnership organized and existing under the laws of the State of Delaware and has its principal place of business at 5400 Westheimer Court, Houston, Texas Texas Eastern is an indirect, wholly-owned subsidiary of Spectra Energy Transmission, LLC. Texas Eastern is a natural gas company as defined in the NGA, engaged in transmission of natural gas in interstate commerce, subject to the jurisdiction of the Commission. Texas Eastern s transmission system extends from Texas, Louisiana and the offshore Gulf of Mexico area, through the states of Mississippi, Arkansas, Missouri, Tennessee, Illinois, Indiana, Kentucky, Ohio, Pennsylvania and New Jersey, to its principal terminus in the New York City metropolitan area. Proposal On October 6, 2009, the Commission issued an order in Docket No. CP09-61 granting Texas Eastern the authority to construct, abandon and operate pipeline facilities at its Kosciusko Compressor Station in Mississippi ( Kosciusko Project ). 6 The Kosciusko Project includes the installation of a Solar Model C452 centrifugal compressor, with an electric motor operated at 12,500 horsepower ( HP ) of compression, at Texas Eastern s existing Kosciusko Compressor Station. Also as part of the Kosciusko Project, Texas Eastern is removing an outdated Westinghouse Model W171RMS compressor unit operated at 12,500 HP, installing upgrades on five existing reciprocating compressor units, and constructing a new 30-inch diameter pipeline header system, among constructing other related appurtenant facilities. The purpose of the Kosciusko Project is to improve the overall operation and efficiency of the Kosciusko Compressor Station. Texas Eastern is not adding any incremental HP of compression or capacity to the Kosciusko Compressor Station as part of the Kosciusko Project. In order to complete construction of the upgrades to the existing reciprocating compressor units and the pipeline header system, Texas Eastern must take the existing reciprocating compressor units out of service for an approximate two-week period. Texas Eastern has completed construction of the new electric compressor unit and requested approval from the Director to place the new unit into service to allow Texas Eastern to continue providing existing levels of service to its customers during the outage 6 Texas Eastern Transmission, LP, 129 FERC 61,014 (2009). 4

7 required to complete the entire Kosciusko Project, which is expected to be in service as early as October 1, On August 25, 2010, the Director granted Texas Eastern s request. 7 The new compressor unit is capable of operating at up to 16,875 HP of compression, although Texas Eastern has designed the Kosciusko Compressor Station with the new compressor unit operating at 12,500 HP of compression, as submitted in Texas Eastern s certificate application for the Kosciusko Project in Docket No. CP In order to maximize Texas Eastern s ability to schedule service nominated during the partial outage period, Texas Eastern is requesting a temporary certificate to operate the new compressor unit at up to 16,875 HP during the period of the outage. As noted above, the partial outage is scheduled to commence on September 7, 2010 and continue for approximately two weeks. Texas Eastern will not operate the station at a horsepower above the overall horsepower certificated for the station. III. 8 complete upgrades to the units and to complete construction of the pipeline header system authorized as part of the Kosciusko Project in Docket No. CP During the outage, Texas Eastern will be operating the new compressor unit to offset the reduction in compression caused by taking the reciprocating units out of service. Texas Eastern is requesting a temporary certificate to operate the new unit at up to 16,875 HP in order to assure maintenance of adequate service and to mitigate the potential for Texas Eastern to not be able to schedule all nominations through that part of its system during the outage. Because the reciprocating units will be out of service, operation of the new compressor unit at either 12,500 HP or 16,875 HP will not exceed the overall horsepower of the Kosciusko Compressor Station during the outage. IV. Request for Expedited Action The partial outage is scheduled to commence on September 7, Accordingly, Texas Eastern respectfully requests that the Director grant the requests herein by September 7, Such timely approval will minimize the potential effect of the scheduled outage. As described below, no landowners or stakeholders will be affected by this Application, and there will be no environmental impacts associated with the request proposed herein. Certificate Policy Statement This Application does not raise the types of concerns addressed by a Certificate Policy Statement analysis because there is no construction related to the requests herein, no potential for subsidization by existing customers, and, as described below, no environmental impact. Accordingly, a Certificate Policy Statement Analysis is not applicable to this Application. VI. Environmental Impact The Solar Model C452 electric compressor unit is a jurisdictional facility that has already been certificated and constructed as part of the Kosciusko Project under Docket No. CP09-61, and no further construction activity will be required under the temporary certificate requested herein. Accordingly, no environmental clearances or landowner approvals are necessary, and no cultural resources or federally listed threatened or endangered species will be affected. Additionally, the increase in compression proposed herein is required simply to offset the loss of horsepower during the outage and operate the Kosciusko Compressor Station at or below its certificated horsepower, so there will be no impact to air emissions and noise levels at the station, if not a reduction in overall impact to air emissions and noise levels because five reciprocating units will be out of service and the new electric unit, which has no impact on air emissions, will be operating. Accordingly, granting the temporary certificate will have no impact on the environment or landowners. 7

Other Applications Other than the instant application, Texas Eastern knows of no other application to supplement or effectuate the proposal herein which must be filed with the Commission or any other federal, state or other regulatory body. VIII.
