1 IMO MEPC 64 Report External Client version Executive Summary The 64th session of the IMO Marine Environment Protection Committee (MEPC 64) was held from 1 to 5 October 2012, at the IMO headquarters in London. This executive summary provides a brief overview of the key decisions agreed and further information can be found in the body of the report. The priority for MEPC 64 was to finalize various technical guidelines and define ambiguous terms relating to Chapter 4 of MARPOL Annex VI Regulations on Energy Efficiency for Ships. Various interpretations and guidelines were agreed as follows: Major Conversion -. It was agreed that any work carried out to a ship has to considered in the context of whether it constitutes a major conversion. New ships new chapter 4 does not define new ships for phrase 1, 2 and 3. Notwithstanding the contract date or keel-lay date for new ships, it was agreed that delivery for a new ship for Phases 1, 2 and 3 would be on or after 48 months after the start of each phase respectively. The applicable phase would therefore be bound by the start of the delivery period of the next phase. SEEMP - It was agreed that the deadline for placing SEEMP should be first intermediate or renewal survey of the IAPP certificate, whichever is the first, on or after 1 January 2013, not the single date of 1 January Exclusion to offshore platform was also agreed. The language used for SEEMP was agreed to be working language or languages understood by ship's personnel. Minimum power guidelines Interim measures were agreed and the guideline will be further revised toward MEPC 65 scheduled in May The interim stop-gap solution to be implemented from 1st January 2013 would apply for three vessel types only (bulk carriers, tankers and combination carriers) noting that these vessels may be more vulnerable to underpowering. The solution combines a proposal made at MEPC 64 resulting in lowering of the level 1 minimum power lines for bulk carriers, tankers and combination carriers from the IACS proposal, incorporating the majority of all ships in these categories above the minimum power line for manoeuvring in adverse conditions. In addition, the use of the IACS level 2 simplified assessment method can also be used if required for those ships which do not meet the level 1 assessment. With regard to the technology transfer resolution, MEPC 64 continued to work towards MEPC resolution. The working group is to continue its work at MEPC 65. With regards to Greenhouse Gases emissions from ships, discussion on market based measures, reduction targets and other matters was deferred to MEPC 65 (May 2013). MEPC 64 agreed to the Secretariat s proposal to update the 2009 GHG Study and a workshop will be held in 2013 to define the methodology to update this study. The start date for the low sulphur fuel availability study as stipulated in MARPOL Annex VI regulation 14 relating to the 2020 global sulphur limit was discussed. While industry members requested earlier commencement of the study, MEPC 64 decided not to discuss this issue until MEPC 66 scheduled in March There was significant progress in the ratification of the Ballast Water Management Convention. The number of the governments (30 States) has already been cleared (36 States), while tonnage requirements (35% of world tonnage) is still to be met (currently 29.07%). Recognizing possible entry into force of the convention in the very near future, governments and industry are raising various questions and concerns for actual/practical implementation. These were, actual application deadline for the existing ships, including ships constructed in and after 2009 which are considered as new ships under the convention, application to the specific Executive Summary

2 ship/structure, such as offshore industry structures/ships, and type approval standard for the management systems. At MEPC 64, primary decisions were: Approval of systems - further 5 basic and 3 final management systems using active substances were approved implementation scheme - a resolution addressing revision of compliance deadline will be discussed by correspondence group toward MEPC 65 Type approval guideline G8 - decided not to revise it. However, a large number of delegations stated their disagreement to this decision. MEPC 64 adopted an MEPC resolution on the 2012 Guidelines on implementation of effluent standards and performance tests for sewage treatment plants. These standards are applicable to the Baltic Sea which was designated as a special area for sewage discharge and expected to enter into force on 1 January 2016 for new ships and apply to all existing ships visiting the area from 1 January Among two Nitrogen and Phosphorus removal standards proposed by DE 55, MEPC 64 decided to go along with the more stringent standard with a view to revisiting the availability of the system in late Further, a dilution compensation factor was incorporated at MEPC 64. With regard to the Ship Recycling convention, MEPC 64 concluded on the guidelines for survey and certification as well as Port State Control. Matters of thresholds values for exemption will be further discussed intersessionally toward MEPC 65. 3 Harmful aquatic organisms in ballast water and other Interpretations of, and amendments to, MARPOL and related instruments (Agenda item 2 and part of 7) Context The International Convention for the Control and Management of Ships' Ballast Water and Sediment, 2004 (BWM Convention) will enter into force 12 months after ratification by 30 States, representing 35% of world merchant shipping tonnage. To date (31 August 2012), 36 States representing 29.07% of the world merchant shipping tonnage have ratified this Convention. Discussion Areas Approval of the Ballast Water Management Systems A further 5 basic and 3 final management systems using active substances were approved. Readers are to note that these approvals are subject to type approval by the Flag Administration for onboard use. Currently there are 28 systems that have type approval from flag administrations. Readers are also to note that systems that do not use active substances do not require IMO s approval. Updated data and information on the status of ballast water management system installation Information provided by governments regarding the status of installation of the ballast management systems indicated slow uptake. The following were expressed as reasons for this slow uptake; unsolved sampling issue concerns over the actual operational performance of the system Review of the implementation scheme MEPC 64 noted that slow progress of the ratification and subsequent delay in entry into force is creating a challenge for retrofitting within the windows given in the convention. The following elements were discussed for consideration: Treating ships constructed in 2009 or thereafter as existing ship, Extending the compliance deadline from 2 or 3 years to 5 years, i.e. remove interim survey as a deadline Exemption of older ships. There was general support to a proposal to grant 5 years period of grace as a maximum period (i.e. until first renewal survey). The issue will be further considered by a correspondence group toward MEPC 65 (May 2013) with a view to developing another Assembly Resolution on the implementation that may be similar to Resolution A.1005(25) Application of the International Convention for the Control and Management of Ships Ballast Water and Sediments, Effective implementation of the BWM convention MEPC 64 noted that 28 ballast water treatment systems have received type approval from their administrations to date and that further systems are likely to be type approved in the near future, and hence concluded that appropriate ballast water treatment technologies are currently available to meet the D-2 standard. Valid concerns regarding the supply, operation and suitability of Ballast Water Treatment Systems (BWTS) were raised. These included adverse impacts on BWTS performance associated with variations in salinity, water temperature, flow rate and concentration of suspended solids. MEPC 64 requested delegations to submit case studies, including quantitative data and information, to facilitate more informed analysis of these aspects.

4 Consideration of amending the Guidelines for approval of ballast water management systems (G8) MEPC 64 noted concerns expressed by an industry NGO on consistencies and reliability of the type approved ballast water management systems. They are also concerned about that one system has withdrawn from the market owing to these issues. Nevertheless MEPC 64 decided that it was not necessary at this time to amend the Guidelines (G8). However MEPC did instruct BLG17 to consider improving MEPC.175(58) Information Reporting on Type Approved Ballast Water Management Systems with a view to providing greater transparency on the operational limitations of BWTS that are Type Approved. In addition MEPC 64 instructed BLG17 to expand the Guidance in BWM.2/Circ.28, Guidance to Administrations on the type approval process for BWTS, with recommendations on the testing of BWTS for variations in salinity, water temperature, flow rate and concentration of suspended solids, as well as the QA/QC methodologies of test facilities and how to deal with and report on test failures. Issuance of a document certifying compliance with the convention MEPC 64 approved a BWM circular encouraging concerned parties to issue a document stating compliance with the convention earlier than the entry into force date. Pending issues: Self-monitoring of BWMS - The possibility of developing standards to cover the type of data that BWTS use to monitor their performance - to be further discussed at BLG 17 Application to Mobile Offshore Units (MOUs) - to be further discussed at MEPC 65 Definition of major conversion - to be further discussed at MEPC 65 Application to offshore support vessels - to be further discussed at BLG 17 Matters relating to coating systems - to be further discussed at BLG 17 Stowage of grey and black water in the ballast tank - Stowage of grey and black water in the ballast tanks in relation to the impact on ballast water management systems were initially discussed at MEPC 63. At MEPC 64, a proposed text for the amendments to MARPOL Annex IV was put forward. Having exchanged various views and opinions, MEPC 64 realized the complexity of the issue but did not conclude anything. MEPC 64 agreed to include the matter in the planned output for biannual. Advice to clients Lloyd s Register has produced a series of guidance on Understanding Ballast Water Management including status of technology, installation requirements and how to comply with the convention. This is available to download from Recycling of ships (Agenda item 3) Context On 15 May 2009, at a Diplomatic Conference in Hong Kong, the International Convention for the Safe and Environmentally Sound Recycling of Ships was signed by 67 Member States of the IMO. This internationally binding Convention has been adopted due to concerns about standards of ship recycling. It affects both recycling facilities and shipowners. The Convention will enter into force 24 months after it has been ratified by 15 States, representing 40% of the world fleet, and with an annual ship recycling capacity of 3% of that fleet. It is predicted that this condition will be met by January As of September 2012, no State has become party to the Convention. Discussion Areas

5 MEPC resolution on Guidelines for Survey and Certification of Ships (Survey Guidelines) Article 5 of the Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships, 2009, (hereafter referred to as "the Convention") prescribes that each party shall ensure that ships flying its flag or operating under its authority and subject to survey and certification are surveyed and certified in accordance with the regulations in the annex to the Convention. The purpose of this document is to provide guidelines for the survey and certification of ships under the Convention MEPC resolution on Guidelines for Inspection of Ships (PSC Guidelines) This document is intended to provide basic guidance for conducting port State control inspections in compliance with the Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships, It descries initial inspection, more detailed inspection and detainable deficiencies. Threshold values and exceptions The values will be further considered by a correspondence group established. Advice to clients The non mandatory guidelines being developed are likely to be made mandatory by signatory governments, in the normal fashion. Each guideline may impose requirements (rather than guidance for the implementation), depending upon the discussion. The guidelines may also impose very complex systems in actual implementation. The implication date is unknown at this stage. Lloyd s Register has developed a guide to assist owners and other stakeholders through the recycling process and to explain current practices and regulations and offers a voluntary service for the Inventory of Hazardous Materials Verification. More information is available on the Lloyd s Register website Reference - LR Classification News No. 14/2009, available at CDLive ClassNews link Air pollution and energy efficiency (Agenda item 4 and part of 7 and 11) Context MARPOL Annex VI - Prevention of Air Pollution from Ships - entered into force on 19 May The latest amendments introducing the new Chapter 4 on Energy Efficiency will enter into force on 1 st January 2013 Energy Efficiency related Discussion Areas MEPC resolution on promotion of Technical Co-operation and Transfer of Technology The new MARPOL Annex VI regulation 23 adopted by MEPC.202 (62) stipulates promotion of Technical Cooperation and Transfer of Technology. Subsequently MEPC 64 finalized a MEPC resolution that provides details of such technical co-operation and transfer of technology. The resolution sets up inter-government co-operation, thus, there is no direct impact on the industry. The draft resolution was prepared by MEPC 64 for finalization at MEPC 65. Matters relating to energy efficiency measures (EEDI) and relevant proposals, that includes: Interpretation of major conversion The key outcome was that the definition of major conversion in relation to Chapter 4 of MARPOL Annex VI, will, in all cases, be considered by the Administration. Examples were given in relation to the definition of substantial modification given in MARPOL Annex VI Chapter 1 Regulation It was agreed that any work carried out to a ship has to considered in the context of whether it constitutes a major conversion. This could

6 result in a new ship which means recertification of the EEDI, or for an existing ship which is not already subject to the regulation, the work is so extensive it is now considered applicable under the regulations. This may result in Recognised Organisations referring to the Administration, on whose behalf they are acting, for clarity in all cases. Interpretation of new ships While new MARPOL Annex VI chapter 4 defines the definition of new ships in relation to the phrase 0 period (starting 1 January 2013), there is no definition of new ships for subsequent phrases. MEPC 64 agreed that the delivery date specified Regulation of MARPOL Annex VI, for Phase 1, 2 and 3 should be replaced. Notwithstanding the contract date or keel-lay date for new ships, it was agreed that delivery for a new ship for Phases 1, 2 and 3 would be on or after 48 months after the start of each phase respectively. The applicable phase would therefore be bound by the start of the delivery period of the next phase (see Annex 1). Interpretation relating to SEEMP It was agreed that the deadline for placing SEEMP should be first intermediate or renewal survey of the IAPP certificate, whichever is the first, on or after 1 January 2013, not the single date of 1 January It was agreed that the language of the SEEMP should be in the working language of the ship so as to be understandable by the seafarers onboard but also noted that since a SEEMP does not need to be approved, then the SEEMP does not need to be in the language of the IMO. Finally an interpretation was added that SEEMP should be established in a working language or languages understood by ship s personnel using similar text to that given in the ISM Code (paragraph 6.6). With regard to the application of SEEMP, MEPC 64 agreed that platforms (including FPSOs and FSUs) and drilling rigs, regardless of their propulsion are not required to have SEEMP. Fruit Juice carriers Concerns over the unfair treatment of small specialised ships were raised by Liberia and the International Chamber of Shipping concerning Fruit Juice carriers, of which there are only a very small number of ships. These ships are highly specialised and under current EEDI requirements are cateogirsed as chemical tankers which makes it difficult for them to meet the required EEDI values defined by the reference lines for chemical tankers. It was agreed that these ships should be more appropriately categorised as refrigerated cargo carriers and therefore the reference lines that relate to that category. In addition, it was agreed that there may be other smaller specialised vessel types which may need to have their categories considered on a case-by-case basis within the EEDI framework in order to ensure that they are also not unduly penalised. Minimum power guidelines New regulation 21 in MARPOL Annex VI chapter 4 states For each ship to which this regulation applies, the installed propulsion power shall not be less than the propulsion power needed to maintain the manoeuvrability of the ship under adverse conditions as defined in the guidelines to be developed by the Organization." Recognizing that the new chapter 4, including this regulation, will enter into force on 1 January 2013, MEPC 64, MEPC developed interim guidelines. MEPC 64 also agreed to advise the matter to MSC accordingly. The Working Group re-established during MEPC 64 was tasked with finalising interim guidelines for determining minimum propulsion power to maintain manoeuvrability in adverse conditions with a view to adoption by MEPC at this session. It was discussed that interim guidelines should be based on the IACS level 1 (minimum power line) and 2 (simplified assessment) methodologies, however, it was agreed that more work would be required to further improve the guidelines produced by IACS on minimum power before a finalised interim solution would be available and that a further stop-gap interim measure would be required to ensure that something is in

7 place from 1st January Consideration was given to a proposal from Greece that using minimum speed could be used until the IACS approach was ready but the majority preferred to concentrate on minimum power as the way forward. It was agreed that the stop-gap solution to be implemented from 1st January 2013 would apply for three vessel types only (bulk carriers, tankers and combination carriers) noting that these vessels may be more vulnerable to underpowering. The solution combines a proposal from Japan in their paper MEPC 64/4/42 and a recommendation from Norway to exclude any outlying vessels from the minimum power lines. Consequently, this will result in lowering of the level 1 minimum power lines for bulk carriers, tankers and combination carriers from the IACS proposal, incorporating the majority of all ships in these categories above the minimum power line for manoeuvring in adverse conditions. In addition, the use of the IACS level 2 simplified assessment method can also be used if required for those ships which do not meet the level 1 assessment. Whilst the guidance containing the technical methodology for both assessment levels was agreed, the precise characteristics of the level 1 minimum power lines would be presented for approval at MSC 91 prior to the 1st January deadline. Speed trial and model test The new procedures ITTC Speed/power trials part 2 analysis of speed/power trial data, were agreed and these procedures would be explicitly referenced by amending the guidelines in MEPC.213(63). It was also agreed that the reference would explain that these procedures are preferable to the use of the existing ISO 15016:2002 procedure. Shaft generator - amendments to guidelines for calculation of the EEDI It was agreed to amend the 2012 Guidelines on Calculation of the EEDI (Resolution MEPC.212(63)) in relation to EEDI calculation methods for shaft generators and auxiliary engine power PAE. The amendments also amended the guidelines in order to account for ships equipped with more than one engine through summation. Guidance on treatment of innovative energy efficiency technologies Whilst discussions focussed on draft guidelines on the treatment of innovative technologies as well as proposals to adjust a ship s EEDI in future in respect of utilising certain innovative technologies, no decision was reached regarding adopting any guidelines. It was, however, agreed to forward the current draft guidelines and comments made through other submissions to a Correspondence Group for further development with a view to finalising guidelines at the next session. Guidelines for the calculation of the coefficient fw The coefficient fw used in the EEDI calculation relates to the decrease in ships speed in representative sea conditions. Interim guidelines for calculating this coefficient based on the application of Beaufort 6 for all ships and other amendments were approved at this session whilst a correspondence group will further review the interim guidelines. Work plan for the energy efficiency New MARPOL Annex VI chapter 4 does not cover all ship types. There is a plan to cover remaining ship type such as passenger ships, ro-ro passenger ships. Development of the EEDI framework for passenger ships, ro-ro passenger ships and ro-ro cargo ships was considered based on papers submitted to this session. In addition, discussions also focussed on EEDI calculation for ships with non-conventional propulsion and reduction rates for regulatory limits for larger size bulk carriers and tankers. Due to short timescales and a larger number of items to review, the discussions were kept high level for the majority. A review was undertaken in regard to the reduction factors for large bulk carriers and oil tankers noting that concerns over whether they may disappear from the market due to the required reduction factors they will be required to meet as part of the later phases of EEDI.

8 Lastly, consideration was given to how to fairly account for the wide variety of smaller size general cargo ships less than 20,000 dw. It was agreed that these proposals put forward should be further considered for finalising at MEPC 65. MARPOL Annex VI Discussion Areas (other than energy efficiency ) Low sulphur fuel availability study The proposal to commence a study on the availability of low sulphur fuel as soon as possible was not accepted. The earliest the study can commence is 2013 and it was decided not to discuss this matter until MEPC 66 (March 2014). NOx Tier III CG report and relevant information/proposal MEPC 64 noted the intermediate report of the correspondence group and the information on the research conducted by Japan. MEPC 64 re-established the correspondence group for final report to MEPC 65. Guidelines for certification of engines using SCR exhaust gas after-treatment systems A proposal to revise the Guidelines for Selective Catalytic Reduction (SCR) systems (resolution MEPC.198 (62)), regarding the formula for deriving the NOx reduction rates in paragraph of the guidelines was presented. It was concluded and agreed not to proceed with this proposal. Onshore power supply MEPC 64 reviewed information prepared by the Secretariat regarding availability of the onshore power supply facility at ports and draft regulations to mandate member States provision of onshore power supply facilities at their ports. MEPC 64 approved a non-mandatory circular inviting members to provide onshore power supply facilities meeting international standards. Recording of incinerator capacity on the supplement to the IOPP Certificate Deletion of the incinerator capacity, as a consequential amendments to the IMO MARPOL Unified Interpretation to regulation 12.1 of MARPOL Annex I (MEPC 58/23, annex 28), from supplement A and B of the IOPP certificate was agreed. Sampling of fuel oil used on board ships While BLG was tasked to consider revision to the resolution MEPC.182(59), 2009 Guidelines for the sampling of fuel oil for determination of compliance with the revised MARPOL Annex VI, it was not clear what was to be developed. MEPC 64 concluded that, for further consideration on this matter, it would be necessary to consider further submissions that identify the compelling need for procedures and include concrete proposals, e.g. draft amendments to MARPOL Annex VI or draft unified interpretation and draft guidelines on sampling fuel oil being used on board ships. Unified Interpretation for regulation 16.9 of MARPOL Annex VI MEPC 64 approved the unified interpretation concerning the use of sludge oil during the warm-up process of continuous-feed type shipboard incinerators. Advice to clients Challenges to the industries are:

9 Compliance with the new chapter 4 of MARPOL Annex VI, i.e., EEDI for new ships and SEEMP for all ships Low Sulphur Fuel requirements under Regulation 14 of MARPOL Annex VI 2016 Stringent NOx emission requirements under Regulation 13 of MARPOL Annex VI Further information and advices are available from the following URLs: Adoption of amendments to the IBC Code (Agenda item 6) Context The revised IBC code chapters 17, 18 and 19 were adopted at MEPC 64. The amendments will also be adopted by the MSC 91. Expected entry into force date is 1 June Summary: Primary discussion points and amendments made to the code are as follows: In total 43 new cleaning additives were presented and 29 accepted for Annex 10 of MEPC.2/Circ. MEPC.2/Circ Provisional classification of liquid substances transported in bulk, and other related matters 2 new products were assessed: a discrepancy with regards to fire-fighting requirements for Hexamethylenediamine (molten) was identified. The new information will be in LIST 1 of the MEPC2/Circ 18 on 17 December 2012, all countries, no expiry. OLOA /3/3 by SINGAPORE for LIST 3 of the MEPC2./Circ 18 all countries, no expiry. Inconsistencies in carriage requirements noted for a number of entries in chapters 17 and 18 of the IBC code including undertaking a review relevant chapter 21. Fully assessed LIST 1 MEPC.2/Circ 17 will go to Chapter 17 or Chapter 18, respective of their application. Missing column I products were updated Chapter 19 - The draft was in BLG 14/3 Annex 3. Now, UN Numbers were removed and 2 qualifying footnotes about subset and chain length introduced and new synonyms of cargoes implemented since BLG 14. Tall Oil, crude and Tall Oil pitch; reassessed at BLG 11 in 2007 will also be added. Advice to clients: Owner: Significant as the cargoes lists attached to the certificate of fitness will be revised to some extent and may affect the cargoes that can be carried and will require the certificate of fitness to be reissued Shipbuilder/Equipment manufacture: Significant as there made be carriage requirement changes for some products which affecting the design of the ship and the equipment required to be installed for the carriage of intended cargoes the ship is being designed to carry National Administration / Recognized Organization: significant as all certificates of fitness and associated cargoes lists will be required to be reissued. Other Interpretations of, and amendments to, MARPOL and related instruments (Remaining part of agenda item 7 and agenda item 11) Application of MARPOL convention to non-self propelled unmanned barges A question was raised about the application of survey and certification requirements non-propelled unmanned barges. It is in general, agreed that such barges does not have sources of pollution, but may require careful consideration on annex by annex. It was agreed to address this matter at the FSI Sub-Committee further.

10 Matters relevant to MARPOL Annex V - cargo residue and cargo hold washing water The revised MARPOL Annex V which imposes general prohibition of garbage discharge will enter into force on 1 January This poses immediate question as to how to handle cargo residue and cargo hold and deck washing water. While the DSC Sub-Committee is appointed to provide proper pollution categories into the IMSBC Code, as an interim solution, an MEPC circular on Guidelines for the provisional classification of solid bulk cargoes under the revised MARPOL Annex V between 1 January 2013 and 31 December 2014 was approved. Amendments to the 2011 Guidelines for the carriage of blends of petroleum oil and biofuels (MEPC.1/Circ.761) The proposal was developed to address the need for ethanol/gasoline blends containing more than five per cent ethanol to be protected by alcohol resistant foams and a corresponding amendment to column l for the entry Biofuel blends of Gasoline and Ethyl alcohol (>25% but <99% by volume) MEPC circular on the Guidance for minimising the transfer of invasive aquatic species as biofouling (hull fouling) for recreational craft The guidance will be voluntary and encourage recreational craft owners/operators to apply a suitable antifouling hull coating and regularly clean the hull including niche areas such as rudders, inlets and outlets, anchors etc. MEPC resolution on the 2012 Guidelines on implementation of effluent standards and performance tests for sewage treatment plants The existing resolution on effluent standards and performance tests for sewage treatment plants was amended to include requirements for sewage treatment plants on passenger ships operating in the Special Area. This will be submitted to MEPC 64 (October 2012) and is expected to be applicable from 01 January Among two Nitrogen and phosphorus removal standards given in [ ], MEPC 64 decided to go along with the more stringent standard with a view to revisiting the availability of the system in late Further, a dilution compensation factor was incorporated at MEPC 64. MEPC circular on incinerators with a capacity greater than 1,500 kw and up to 4,000 kw An MEPC circular allowing type approval of incinerators with a capacity greater than 1,500 kw up to 4,000 kw was approved as a temporally measure until proper amendments are introduced to existing specification given in resolutions MEPC 76 (40) and MEPC.93 (45).
