1 COMMONWEALTH OF PENNSYLVANIA DEPARTMENT OF ENVIRONMENTAL PROTECTION BUREAU OF AIR QUALITY GENERAL PLAN APPROVAL AND GENERAL OPERATING PERMIT BAQ-GPA/GP 2 STORAGE TANKS FOR VOLATILE ORGANIC LIQUIDS GENERAL CONDITIONS 1. Statutory Authority and General Description In accordance with Section 6.1(f) of the Air Pollution Control Act, 35 P.S , and 25 Pa. Code and , the Department of Environmental Protection (Department) hereby issues this general plan approval and general operating permit for storage tanks for volatile organic liquids (hereinafter referred to as Storage Tank General Permit ). 2. Applicability/Source Coverage Limitations Approval herein granted to construct and operate under this Storage Tank General Permit is limited to stationary storage tanks with a rated capacity of 2,000 gallons or greater which store volatile organic liquids as defined in 40 CFR b with a storage vapor pressure of 11.1 psia or less. This Storage Tank General Permit authorizes the construction, modification, or reconstruction of storage tanks with a rated capacity of 2,000 gallons or greater that meet the best available technology requirements of and (a)(5). The emission limitations and requirements that a storage tank is subject to are dependent on the date the tank was constructed, reconstructed or last modified. The dates of July 23, 1984, and May 18, 1978, are important dates regarding the applicability of Federal New Source Performance Standards found in 40 CFR Part 60, Subparts Ka and Kb. Rated capacities of approximately 10,000, 20,000 and 40,000 gallons are applicability levels for differing requirements. The Storage Tank General Permit also covers tanks regulated under the provisions of the National Emission Standards for Hazardous Air Pollutants for Source Categories established pursuant to Section 112 of the Federal Clean Air Act as promulgated under 40 CFR Part 63, Subparts F, G, R and CC. These Subparts are for the synthetic organic chemical manufacturing industry, petroleum refineries and gasoline distribution facilities. 3. Application for Use Any person proposing to operate a storage tank under this Storage Tank General Permit shall notify the Department using the Storage Tank General Permit Application provided by the Department and shall receive prior written approval from the Department as required under 25 Pa. Code (relating to application for use of general plan approvals and general operating permits). 4. Compliance Any storage tank operating under this Storage Tank General Permit must comply with the terms and conditions of the general permit. The storage tank and any associated air cleaning devices shall be: a. operated in such a manner as not to cause air pollution

2 b. operated and maintained in a manner consistent with good operating and maintenance practices. c. operated and maintained in accordance with the manufacturer's specifications and the applicable terms and conditions of this Storage Tank General Permit. 5. Permit Modification, Suspension and Revocation This Storage Tank General Permit may be modified, suspended, or revoked if the Department determines that affected storage tank(s) cannot be regulated under this general permit, or the permittee fails to comply with applicable terms and conditions of the Storage Tank General Permit. The approval herein granted to operate storage tanks shall be suspended, if, at any time, the permittee causes, permits or allows any modification (as defined in 25 Pa. Code 121.1) of the storage tank and any associated air pollution control device that is not in accordance with this general permit. Upon suspension of the general permit, the permittee may not continue to operate or use said storage tanks. If warranted, the Department will require that the storage tank be permitted under the state operating permit or Title V operating permit requirements in 25 Pa. Code Chapter 127, if applicable. 6. Notice Requirements The permittee shall comply with applicable notification requirements established in 25 Pa. Code Chapter 127, Subchapter H (relating to general plan approvals and operating permits). Any notification submitted to the Department shall be sent to the appropriate Regional Office responsible for issuing general permits in the county in which the storage tank is located. The permittee shall immediately notify the Department of any malfunction of any storage tank which results in, or may possibly be resulting in, the emission of air contaminants in excess of the limitations specified in, or established pursuant to, any applicable rule or regulation contained in 25 Pa. Code, Subpart C, Article III (relating to air resources). 7. Testing For any storage tank constructed, reconstructed or modified after May 18, 1978, which uses an external floating roof, the permittee shall conduct testing of the seals in accordance with 40 CFR a. Tests shall be conducted on the primary seals within 60 days of initial tank filling and every 5 years thereafter. Tests on the secondary seals shall be conducted annually. The Department and the EPA administrator shall be notified of the testing. If, at any time, the Department has cause to believe that air contaminant emissions from the source covered by this general plan approval and operating permit may be in excess of the limitations specified in, or established pursuant to, any applicable rule or regulation contained in Article III of the Rules and Regulations of the Department of Environmental Protection, the permittee shall be required to conduct whatever tests are deemed necessary by the Department to determine the actual emission rate(s). Such testing shall be conducted in accordance with the provisions of Chapter 139 of the Rules and Regulations of the Department of Environmental Protection, where applicable, and in accordance with any restrictions or limitations established by the Department at such times as it notifies the permittee that testing is required. The Department shall be notified at least 30 days in advance of any testing required under this permit. The EPA Administrator shall be notified at least 30 days in advance of any tests for tanks regulated under the Federal New Source Performance Standards, 40 CFR Part 60, Subpart Ka

3 8. Monitoring For all storage tanks with floating roofs, the permittee shall annually inspect the roof for compliance with the following: a. There shall be no visible holes, tears or other openings in the seals or seal fabric. b. All openings, except stub or emergency drains, shall be covered and sealed except when in use. c. All automatic bleeder or rim vents shall remain closed except when the roof is floated onto or off its leg supports. d. All emergency drains on external floating roofs shall be provided with a slotted membrane fabric which covers at least 90 percent of the area opening. e. All external floating roofs shall be visually inspected annually for secondary seal gap. f. The secondary seal gap of external floating roof tanks equipped with a vapor mounted primary seal shall be measured annually. 9. Recordkeeping For all storage tanks with floating roofs, the permittee shall keep a record of the following: a. the types of volatile organic liquids stored in the tank, b. the maximum true vapor pressure of the liquids stored, and; c. the results of all inspections required under Condition 8. The permittee shall keep the records required under Condition 8 for a period of 2 years and shall make those records available to the Department upon request. 10. Reporting 40 CFR Section 60.4 requires submission of copies of all requests, reports, applications, submittals and other communications to both the EPA and the Department. The EPA submittals shall be forwarded to: Director Air Toxics and Radiation Division US EPA Region III 841 Chestnut Street Philadelphia PA Any notification required as a result of any condition contained herein should be directed to the regional office of the Department of Environmental Protection responsible for the county where the storage tank(s) covered by this Storage Tank General Permit is located. The permittee shall immediately notify the Department of any malfunction of the source or any associated air cleaning device(s) which result in, or may possibly be resulting in, the emission of air contaminants in excess of the limitations specified in, or established pursuant to, any applicable rule or regulation contained in Article III of the Rules and Regulations of the Department of Environmental Protection

4 The permittee shall notify the Department and EPA, as appropriate, of changes in the products stored in a tank and describe how the change affects applicable requirements and how those applicable requirements are being met. In accordance with 25 Pa. Code (c), this notice shall be provided 7 days prior to a change that involves no equipment changes or 15 days prior to a change that involves equipment changes. 11. General Permits at Title V Facilities Any storage tank located at a "Title V facility" as defined in 25 Pa. Code 121.1, shall comply with the requirements of 25 Pa. Code (relating to general operating permits at Title V facilities). 12. Permit Shield Unless precluded by the Clean Air Act or regulations promulgated thereunder, the permit shield provision contained in 25 Pa. Code (relating to permit shield) shall apply to storage tanks operating under this Storage Tank General Permit. 13. Term of Permit This Storage Tank General Permit is valid for a fixed term of five years from the date of issuance to the applicant. 14. Permit and Administrative Fees The Storage Tank General Permit establishes the following application and permit renewal fees: a. Two hundred fifty dollars during the calendar years. b. Three hundred dollars during the calendar years. c. Three hundred seventy-five dollars beginning in the 2005 calendar year. 15. Expiration and Renewal of Permit The permittee's right to operate under this Storage Tank General Permit terminates five years following the date approval is granted for use of this permit unless a timely and complete renewal application is submitted to the Department 30 days prior to the permit termination date. Upon receipt of a complete and timely application for renewal, storage tanks may continue to operate subject to final action by the Department on the renewal application. This protection shall cease to exist if, subsequent to a completeness determination, the applicant fails to submit any additional information required by the Department to process the renewal application by the deadline specified in writing by the Department. Application for renewal of the Storage Tank General Permit shall be made on the same forms described in Condition 3, and include the appropriate renewal fee listed in Condition Applicable Laws Nothing in this Storage Tank General Permit relieves the permittee from its obligation to comply with all applicable Federal, state and local laws and regulations. This Storage Tank General Permit does not prohibit changes in the products stored in a particular tank provided that the tank meets all applicable requirements for the storage of the alternate product and the change is reported in accordance with the last paragraph of condition

5 17. Prohibited Use Any stationary air contamination source that is subject to the requirements of 25 Pa. Code Chapter 127, Subchapter D (relating to prevention of significant deterioration) and 25 Pa. Code Chapter 127, Subchapter E (relating to new source review) may not operate under this Storage Tank General Permit. 18. Transfer of Ownership or Operation The permittee may not transfer the Storage Tank General Permit except as provided in 25 Pa. Code (relating to transfer of operating permits). 19. Regulatory Conflicts Wherever a conflict occurs between this general plan approval and operating permit and any of the regulations listed below, the permittee shall, in all cases, meet the more stringent requirement: a. 25 Pa. Code and b. 40 CFR Part 60, Subparts K, Ka and Kb c. 40 CFR Part 63, Subparts F, G and CC SPECIAL CONDITIONS 20. Plan Approval for Storage Tanks Constructed, Reconstructed or Last Modified After March 30, 1996 This Storage Tank General Permit shall authorize the construction of qualifying volatile organic liquid storage tanks. 21. Construction Requirements for Tanks with Capacities Equal to or Less than 40,000 Gallons and Constructed, Reconstructed or Last Modified Prior to July 23, 1984 Tanks which store volatile organic liquids as defined in 40 CFR b with a storage vapor pressure of 1.5 psia or greater shall be constructed with a relief valve set to release at no less than 0.7 psig of pressure or 0.3 psig of vacuum. 22. Construction Requirements for Tanks with Capacities Greater than 75 Cubic Meters (19,812 Gallons) and Equal to or Less than 151 Cubic Meters (39,889 Gallons) and Constructed, Reconstructed or Last Modified On or After July 23, 1984 These storage tanks which store organic liquids at vapor pressures greater than 4 psia and lower than 11.1 psia shall be constructed with one of the following control systems which meet the requirements of 40 CFR b: a. A fixed roof with an internal floating roof with a liquid seal, mechanical seal or a double set of seals. b. An external floating roof equipped with a double set of seals. The primary seal shall be either a mechanical seal or a liquid mounted seal

6 c. A closed vent with a control device, which has received prior approval by the Department, capable of reducing volatile organic compound (VOC) emissions by 95 percent or more. 23. Construction Requirements for Tanks with Capacities Equal to or Greater than 40,000 Gallons and Constructed, Reconstructed or Last Modified Prior to July 23, 1984 These storage tanks which store organic liquids at vapor pressures greater than 1.5 psia and lower than 11.1 psia, shall include one of the following control systems which meet the requirements of 25 Pa. Code : a. A fixed roof with an internal floating roof equipped with a primary seal. b. An external floating roof with a double set of seals. c. A closed vent system with a control device, which has received prior approval by the Department, capable of reducing volatile organic compound (VOC) emissions by 80 percent or more. 24. Construction Requirements for Tanks with Capacities Equal to or Greater than 40,000 Gallons Storing Petroleum Liquids and Constructed, Reconstructed or Last Modified After May 18, 1978, and Prior to July 23, 1984 These storage tanks which store organic liquids at vapor pressures greater than 1.5 psia and lower than 11.1 psia, shall include one of the following control systems which meet the requirements of 40 CFR a: a. A fixed roof with an internal floating roof. b. An external floating roof. c. A closed vent system with a control device, which has received prior approval by the Department, capable of reducing volatile organic compound (VOC) emissions by 95 percent or more. 25. Construction Requirements for Tanks with Capacities Equal to or Greater than 151 Cubic Meters (39,889 Gallons) and Constructed, Reconstructed or Last Modified On or After July 23, 1984 These storage tanks which store organic liquids at vapor pressures greater than 0.75 psia and lower than 11.1 psia, shall include one of the following control systems which meet the requirements of 40 CFR b: a. A fixed roof with an internal floating roof equipped with a liquid seal, a mechanical seal or a double set of seals. b. An external floating roof equipped with a double set of seals. The primary seal shall be either a mechanical seal or a liquid mounted seal. c. A closed vent system with a control device, which has received prior approval by the Department, capable of reducing volatile organic compound (VOC) emissions by 95 percent or more

Operating Requirements for Tanks with Capacities Greater than 40 Cubic Meters (10,556 Gallons) Which Were Constructed, Reconstructed or Last Modified On or After July 23, 1984 The storage tank shall also operate in accordance with the following conditions: a. The storage tank is subject to the emission limitations of the New Source Performance Standard, 40 CFR Part 60, Subpart Kb. b. The storage tank shall be tested in conformance with the requirements of 40 CFR b. c. The storage tank owner or operator shall keep records of tank usage, descriptions, certifications, tests, inspections and repairs in conformance with 40 CFR b. d. The storage tank owner or operator shall monitor storage tank operations in conformance with 40 CFR b. e. In accordance with Condition 10, all reports and notifications required under 40 CFR b(a)(5); b(b)(5); b(c)(1); b(a)(3); (b)(1), (2) & (4); b(d)(1) & (3); and b(d) shall be provided to the Department and to the EPA. 27. National Emission Standards for Hazardous Air Pollutants This condition applies to any storage tank located in a facility regulated by 40 CFR Part 63 Subparts F and G [relating to Maximum Achievable Control Technology standards for the synthetic organic chemical manufacturing industry (SOCMI)]. a. Existing tanks, as described in the following, shall comply with the provisions of 40 CFR Part 63, Subparts F and G by April 22, 1997: i. Tanks with a capacity of 75 cubic meters (19,812 gallons) and less than 151 cubic meters (39,889 gallons) storing organic hazardous air pollutants with vapor pressures of less than 11.1 psia (76.6 kpa) and equal to or larger than 1.9 psia (13.1 kpa). Tanks with a capacity of 151 cubic meters (39,889 gallons) or greater storing organic hazardous air pollutants with vapor pressures of less than 11.1 psia (76.6 kpa) and equal to or larger than 0.75 psia (5.2 kpa). b. New tanks, as described in the following, shall comply with the provisions of 40 CFR Part 63, Subparts F and G upon construction: i. Tanks with a capacity of 38 cubic meters (10,038 gallons) and less than 151 cubic meters (39,889 gallons) storing organic hazardous air pollutants with vapor pressures of less than 11.1 psia (76.6 kpa) and equal to or larger than 1.9 psia (13.1 kpa). Tanks with a capacity of 151 cubic meters (39,889 gallons) or greater storing organic hazardous air pollutants with vapor pressures of less than 11.1 psia (76.6 kpa) and equal to or larger than 0.1 psia (0.7 kpa). c. This general plan approval and operating permit shall not be used for any tank which is larger or has as higher vapor pressure than those listed in 26 a. and b

Fixed roof tanks shall use an internal floating roof with a liquid seal, mechanical seal or a double set of seals in conformance with 40 CFR If a vapor mounted seal is in place as of December 31, 1992, the tank shall be equipped with either a liquid seal, mechanical seal or a double set of seals the next time the tank is emptied or degassed but in no event later than April 22, e External floating roof tanks shall be equipped with a double set of seals in conformance with 40 CFR The primary seal shall be either a mechanical seal or a liquid mounted seal. Any existing tank shall be equipped with the previously described seals the next time the tank is emptied or degassed but in no event later than April 22, f. Any tank may use a closed vent with a control device which has received prior approval by the Department and is capable of reducing volatile organic compound (VOC) emissions by 95 percent or more and conforms to the requirements of 40 CFR g. Inspection, reporting and recordkeeping shall be done in conformance with 40 CFR Part 63, Subpart G. 28. National Emission Standards for Hazardous Air Pollutants This condition applies to any storage tank located in a facility regulated by 40 CFR Part 63 Subparts G and CC (relating to Maximum Achievable Control Technology standards for petroleum refineries). a. Existing tanks, as described below, shall comply with the provisions of 40 CFR Part 63, Subparts CC and G by August 18, 2005: i. Tanks with a capacity of 75 cubic meters (19,812 gallons) and less than 151 cubic meters (39,889 gallons) storing organic hazardous air pollutants with vapor pressures of less than 11.1 psia (76.6 kpa) and equal to or larger than 1.9 psia (13.1 kpa). Tanks with a capacity of 151 cubic meters (39,889 gallons) or greater storing organic hazardous air pollutants with vapor pressures of less than 11.1 psia (76.6 kpa) and equal to or larger than 0.75 psia (5.2 kpa). b. New tanks or tank modified after July 14, 1994, shall comply with the provisions of 40 CFR Part 63, Subparts F and G upon construction. Furthermore, new tanks, as described in the following are subject to Subparts G and CC: i. Tanks with a capacity of 38 cubic meters (10,038 gallons) and less than 151 cubic meters (39,889 gallons) storing organic hazardous air pollutants with vapor pressures of less than 11.1 psia (76.6 kpa) and equal to or larger than 1.9 psia (13.1 kpa). Tanks with a capacity of 151 cubic meters (39,889 gallons) or greater storing organic hazardous air pollutants with vapor pressures of less than 11.1 psia (76.6 kpa) and equal to or larger than 0.1 psia (0.7 kpa). c. This Storage Tank General Permit shall not be used for any tank which is larger or has a higher vapor pressure than those listed in 27 a. and b

Fixed roof tanks shall use an internal floating roof with a liquid seal, mechanical seal or a double set of seals in conformance with 40 CFR and If a vapor mounted seal is in place as of July 15, 1994, the tank shall be equipped with either a liquid seal, mechanical seal or a double set of seals the next time the tank is emptied or degassed but in no event later than August 18, e. External floating roof tanks shall be equipped with a double set of seals in conformance with 40 CFR and The primary seal shall be either a mechanical seal or a liquid mounted seal. Any existing tank shall be equipped with the previously described seals the next time the tank is emptied or degassed but in no event later than August 18, f. Any tank may use a closed vent with a control device which has received prior approval by the Department and is capable of reducing volatile organic compound (VOC) emissions by 95 percent or more and conforms to the requirements of 40 CFR and g. Inspection, reporting and recordkeeping shall be done in conformance with 40 CFR Part 63, Subpart CC. 29. National Emission Standards for Hazardous Air Pollutants This condition applies to any storage tank located in a facility regulated by 40 CFR Part 63 Subpart R (relating to Maximum Achievable Control Technology standards for gasoline distribution). a. Existing tanks larger or equal to 75 cubic meters (19,812 gallons) as described below, shall comply with the provisions of 40 CFR Part 63, Subpart R by December 15, 1997: i. Fixed roof tanks with floating internal roof shall be fitted with either, liquid filled seal, double seals or, a mechanical shoe seal. i iv. Tanks with external floating roof shall be fitted with primary (mechanical or liquid) and secondary seal. All tanks will be fitted with a closed vent system and control device to reduce inlet VOC emission by 95% or greater. Tanks may be allowed to be fitted with alternative means of emission limitation, if judged by the Administrator to achieve equivalent reduction as achieved by i, ii, and i v. Tanks with noncontact external floating roofs shall cover and seal openings in accordance with the requirements in 40 CFR b(a)(2)(ii). b. New tanks larger or equal to 75 cubic meters (19,812 gallons) as described in a. above, shall comply with the provisions of 40 CFR Part 63, Subpart R upon startup.
