Should supplied fuel not meet required specifications, charterers shall arrange for discharging of such fuel and, upon owner's request, for tank cleaning, both at charterers' expense and time. BIMCO Bunker Fuel Sulphur Content Clause for Time Charter Parties 2004 to apply. Charterers also warrant that any bunker suppliers, bunker craft operators and bunker surveyors used by the Charterers to supply such fuels shall comply in accordance with regulation 14 and 18 in MARPOL Annex VI, including the guidelines in respect of sampling and the provision of bunker delivery notes. If vessel will be redelivered in a SECA area, Charterers warrant that the vessel will be redelivered with sufficient low sulphur bunkers to reach a port or place where suitable low sulphur bunkers may be supplied. Charterers to buy and arrange bunkers only from qualified suppliers/ from majors and carry out their own quality checks as deemed necessary for their control. Charterers warrant that whenever bunker is ordered for the vessel, the order explicitly not to put a lien on the vessel and explicitly request "The Products must not include waste chemicals, waste lubricants harmful substances or other non-fuel components" Sludge removal, if any, always to be for Charterer's account / time. Vessel wil participate in the DNV fuel quality testing programmed. Samples will be taken during each bunkering. No burning of fuel without Master having Page 3 of 5
