In addition there was a written report from CEN Consultant addressing items 4, 8, 9 and 10, as well as a request to discuss EN under item 11, Any other business. 3 Liaisons 3.1 Liaison with European Boating Industry (EBI) A request from EBI for a liaison with WG 69 had been circulated in document CEN/BT WG 69 N 106. Mirna Cieniwicz presented herself and EBI. EBI is an international non-profit association registered under Belgian law gathering 19 national federations, all based in Europe. It was agreed to register a liaison status between EBI and WG 69 and with Ms Cieniwicz and Ms Sweeney as the representatives.

3 Page 2(8) 3.2 Liaison with Recreational Craft Sectoral Group (RSG) Ulrich Heinemann presented RSG and their reason decision to apply for a liaison with WG 69. It was noted that RSG had been established to assist in the uniform application and interpretation of the Recreational Craft Directive (RCD) by all Notified Bodies and others parties with valid interest. Among the objectives for RSG it was highlighted that RSG is an organisation to share experience and exchange views on the application of the conformity assessment procedures with the aim of contributing to a uniform understanding and application of requirements and procedures. RSG had been established to facilitate a coherent application of New Approach directives and was formed in 1995 (1st meeting was held on ). The RSG Group was mandated from the European Commission based on the Framework for Co-ordination and Co-Operation Certif 94/6 Rev 4a to deal with technical questions and implementation of the Recreational Craft Directive 94/25/EC (RCD) as amended. RSG is also registerd as a non-profit organisation located in Belgium (asbl-vzw). Usually biannual meetings are held and specific questions to the RCD in the form of a "Proposal for Enquiry" (PFE) are put forward to the group and resolved in the form of a "Recommendation for Use" (RFU). The RFU's are published in an annex to the RSG Guidelines or can be downloaded from this website.rsg Guidelines are updated annually and released for general guidance and application by Notified Bodies and manufactures. The latest edition of the RSG Guidelines is available form It was agreed to register a liaison status between RSG and WG 69 and with Mr Heinemann and the RSG secretary Mr Brodda as the representatives. 4 Future revision of the directive 94/25/EC Progress report A progress report had been received from Nigel Saw and was presented at the meeting, see document WG 69 N 111. The report was reviewed and it was noted that the revision mainly concerns alignment with the new legal framework. That means the directive will define the essential requirements in general terms without for examples references to specific standards. So no standard will be made mandatory but they will when approved as harmonized standards give an example of presumption of conformity on those essential requirements listed (Annex ZA to the standard). It was further noted that the proposal will require a waste water tank or a water treatment system. Also the exhaust emission requirements will be changed to align with EPA. There will also be a request for CE marking on engine exhaust values. Ulrich Heinemann pointed out the change concerning Modules aligned with the new module A1 (old Aa) which would provide for craft in Category C from 12 m to 24 m hull length to apply internal production control plus supervised tests, as opposed to the current B+ higher modules requirement of the current edition of the Directive. Mr Heinemann expressed the concern of the RSG that this could lead to a lowering of safety as such boats are large and complex and without any third party intervention in their assessment beyond stability assessment, there was a risk of builders not properly addressing the ER of the Directive. The draft for the modified directive was also discussed and it was noted that it is proposed to include limit values for noise emission but without any reference to the verification method. It was emphasized

4 Page 3(8) that in this case a limit value must be accompanied with the test method by which the limit values shall be verified to be met. If there will not be possible with a reference to ISO it was recommended that the EU committee for the RCD should once again review the need for a strict link between limit values and measuring method to be used. At least critical parameters such as distance between microphone and passing track must be specified. Based on concerns raised in document WG 69 N 111 on the requirements in the drfat for EN the request for CE-marking of hoses and tanks was questioned. Especially this was valid for hoses as being only one part of the component which concerning the leakage hazard needs to be dealt with as hose assembles which will include both the hose and its connections. It was proposed that hoses and also tanks should be deleted from the fist of components needed CE-marking. It is still the object that the new directive should be valid from mid 2012 and implemented latest then two years later, with transition periods for all products and additional periods for smaller outboard engines produced by SMEs It was also noted that the modified directive will be published under a new reference number which calls for an updating of all standards at least concerning Annex Z. 5 Revision of standards Transitional periods and cessation of presumption of conformity This item had been requested by ICOMIA based on that, until recently, the understanding had been that once a product is assessed under the RCD to a harmonised standard and provided there are no safety shortcomings the presumption of conformity remains even if a standard is revised. The question was introduced by Udo Kleinitz by the power point presentation in document WG 69 N 112. The question was discussed and the following noted: A revised standard can deal with requirements having impact on tooling and on a production line were there is a need for long transition period for implementation taking into account costs and technical resources; CENELEC uses 2 years transition period for their standards. Harmonized CEN standards will by default have a 6 months transitional period before the superseded standard ceases to provide presumption of conformity; CEN Member body can request longer implementation period than the normal 6 months (up to 3 years); There should be a need to judge needed transition period case by case and based on justification. There was a general expression for a more flexible implementation of new and revised standards and from that point of view the following alternatives were discussed:

5 Page 4(8) a) When the old standard is declared obsolescent it should continue to give presumption of conformity for existing designs, while the replacing standard should be applicable to new designs (CEN states European Standards cannot be declared obsolescent); b) There should be an assessment of ongoing revisions/due publications by CEN/European Commission (BT/WG69) to identify standards that will critically affect existing designs and give old version a significant extension in time for presumption of conformity; c) To implement an alternative default transitional period small craft standards for the presumption of conformity over 3 years. It was noted that there is a need for a differentiation of transitional period depending on subject, reasons and type of changes introduced and this should be explained and justified in the introduction to the standard. It was also noted that there is a need for a clarification document on procedure from EU on the possible use of replaced standards in parallel with the new version. It was agreed to address the EU committee for the RCD with a proposal for a clarification document. The European Commission asked BT/WG 69 to prepare a draft (Action Chairman, SIS, ICOMIA). Furthermore it was agreed to implement a default 6 month transitional period on published standards revisions, following assessment by BT/WG 69 this period can be extended to up to 3 years. 6 Progress report of the reporting secretariat of ISO/TC 188, In addition to the agenda items below, the secretary summarized the situation in ISO/TC 188 by presenting document TC 188 N WD 16315, Electrical propulsion systems It was noted that this item is dealt with in a joint working group (JWG 1) with IEC/TC 18. A first draft had been dealt with this week and shall now be circulated for review and approval to be submitted for the DIS enquiry. ISO :2001, Inflatable boats - Part 3: Boats with a maximum motor power rating of 15 kw and greater This standard will now be revised by WG 2 based on result of systematic review this year including as well as reasons listed by WG 2. ISO 7840:2004, Fire resistant fuel hoses ISO 8469:2006, Non-fire-resistant fuel hoses ISO 10088:2009, Permanently installed fuel systems and fixed fuel tank ISO 16147:2002, - Inboard diesel engines Engine-mounted fuel and electrical components These standards are all under revision by WG 5 for needed updating to deal with new commercial types of bio fuels. Drafts are expected to be ready to be sent before the end of 2011 to ISO/CS for the enquiry as DIS. ISO 21487:2006, Permanently installed petrol and diesel fuel tanks

6 Page 5(8) This is a new project under development by WG 5, approved last year and circulated for DIS enquiry up to The draft was approved and will now be updated by WG 5 based on received comments and sent to ISO/CS for final approval voting as FDIS. WI 25197, Electrical/electronic steering system This is a new project under development by WG 5, approved last year and circulated for DIS enquiry up to The draft was approved and has now been updated based on agreement on received comments and sent to ISO/CS for final approval voting as FDIS. DIS Electrical systems - Extra-low-voltage d.c. installations DIS Electrical systems - Alternating current installations Both drafts had been circulated for a second DIS enquiry and received comments are to be reviewed by WG 10 for updating of the drafts before submitting them to final approval voting. ISO 12133, Carbon monoxide detecting systems This draft has been submitted for FDIS voting to ISO 10239, Liquefied petroleum gas This standard has been agreed to be revised by WG 16. A draft should be available after their meeting this week. EN ISO serie, Stability and buoyancy assessment and categorization - Part 1: Non-sailing boats of 6 m length of hull and over Part 2: Sailing boats of 6 m length of hull and over Part 3: Boats less than 6 m length of hull All three parts have been approved and sent to ISO/CS for final approval voting as FDIS. EN ISO Hull construction/scantlings Part 7: Scantling determination of multihulls Part 9: Appendages and rig attachment A draft for Part 7 shall be received from WG 18 before end of this year for DIS enquiry. Part 9 has been approved and sent to ISO/CS for final approval voting as FDIS. ISO : Airborne sound emitted by powered recreational craft - Part 1: Pass-bymeasurement This standard was discussed by TC 188 at its last meeting and it was agreed to initiate an Amendment to the standard concerning the specification of the reference boats to be used in the tests, Sam Behrmann, Sweden, is project leader for a task force, consisting also of Ulrich Heinemann, Belgium, Franke Hoekstra, Netherlands and Tom Marhevko, USA. 7 Progress report on DIS 16180, Installation of navigation lights Voting results had been presented in document TC 188 N 1179 together with a modified draft in document WG 69 N 109. In addition there were also document WG 69 N 108 with an additional Annex concerning owner's manual and document WG 69 N 107 with comments from EBA (European Boating Association). The documents were reviewed and it was agreed to: include N 108 to the draft in N 109;

7 Page 6(8) request ISO/TC 188 through its WG 19 to formulate secretariat observations to the points raised by EBA in document WG 69 N 107; An update draft should then be prepared as soon as possible for submission to ISO/CS for formal approval voting as FDIS. 8 Progress report on possible performance requirements on LED navigation lights A summary of the work item was received from Nigel Saw, see document WG 69 N 111. The situation and possibilities were discussed and it was agreed that there is a need and an agreement to develop a standard for performance requirements for LED navigation lights for small craft. It was agreed to request ISO/TC 188 and its WG 19 to review and discuss the possibilities for a performance standard on LED navigation lights for small craft. A report, preferably with a draft and an estimated time schedule is foreseen to be ready in time for review and decision at next TC 188 meeting in June Consequences of deletion of work on ISO 9094, Fire protection The revision of exciting ISO and ISO started in The revision was done by WG 12 and resulted in a DIS enquiry which ended The draft was approved but with much comments and a revised version was submitted for a second DIS enquiry in the winter of This second DIS was then circulated for approval by The new draft was approved also this time with three negative votes, see document TC 188 N1174. The voting result was discussed by WG 12 at a meeting last June. Modifications were identified and an updated version was to be developed for FDIS voting. However at the following TC 188 meeting the result was questioned and the discussion led to an agreement to stop the work and cancel the work item, see TC 188 resolution 438. So the situation is now that we do have ISO :2003 and ISO :2002. The situation were commented by Nigel Saw, see document WG 69 N 111 from which it was concluded that the present standards does not fully cover the needs for the RCD. The possibilities were discussed and Ulrich Heinemann volunteered to prepare a draft for a combined standard limited to necessary updates to cover the requirements in the RCD. It was agreed that such a draft should be ready in time for review and decision at next TC 188 meeting in June Possible revision of ISO 14895, Liquid fuelled galley stoves A NWIP with a draft for revision of ISO have been received from BSI. The document had not yet been circulated waiting further advice concerning the financing of the project.

8 Page 7(8) A support had been expressed by Nigel Saw, see document WG 69 N 111, stating that the standard will be useful and support to the RCD both for manufacturer and installers covering also diesel fuelled stoves as well as heating units. Rolf Thesslin pointed out that a NWIP has been received and that it is also supported by a complete draft for the revision of ISO Since ISO was confirmed 2010 there was lack of support to include it in the work programme covered by the ICOMIA founding. The proposed NWIP will now be circulated for review and approval as a standard giving extended support to the essential requirements of the RCD. It was however noted that the item needed additional sponsoring before it could be accepted to be included in the active work programme. It was agreed that Nigel Saw will review the possibility for a financial support from UK stakeholders, of maximum 5000 Euro per year for two year. Rolf Thesslin as secretary of TC 188 will at the same time discuss with ICOMIA the possibility to include the item in the work programme to be covered by the next year budget. 11 Summary of the recommendations to BT and actions The meeting recommendations and actions were summarized as follows: a) Liaison Thierry Legrand will initiate the registration of EBI and RSG as liaison organizations to WG 69 and the addition of Ms Mirna Cieniewicz and Ms Rosemary Sweeney for EBI as well as Ulrich Heinemann and Joachim Brodda for RSG to the mailing list for WG 69. Ulrich Heinemann will provide Thierry Legrand with necessary background documentation. b) Transitional period for implementation of revised harmonised standards The secretary with help of Udo kleinitz will specify the concerns and need for longer transitional periods for implementing revised standards and a clarification document about procedure to be sent to Jean-Jacques Woeldgen. c) Standardization of navigation lights. The secretary will contact the convenor of ISO/TC 188/WG 19 concerning finalization of DIS and for a report and possible a proposal for a standard on performance requirements on LED navigation lights for small craft. d) Revision of ISO 9094, Fire protection Ulrich Heinemann will prepare a draft for an updated standard on fire protection to be discussed at next TC 188 meeting for possible replacement of ISO and -2. e) Revision of ISO 14895, Liquid fuelled galley stoves Nigel Saw will review and report on the possibility for financial support for the revision of ISO as proposed by UK. The secretary will review the possibility for including the project in the normal resources for next years work. The secretary will also circulate the NWIP with the notification that its financing will be solved before it can be activated.

9 Page 8(8) 12 Any other business 12.1 EN 15609, LPG equipment and accessories - LPG propulsion systems for boats, yachts and other craft - Installation requirements EN is a harmonized standard and now under revision. The work is done under the responsibility of CEN/TC 286, Liquefied petroleum gas equipment and accessories. The draft had been assessed by Nigel Saw and two points were raised concerning LPG fuel hoses and transportation of LPG gas cylinders. Based on that assessment some concerns had been raised as presented in document WG 69 N 111. The questions were reviewed and it was noted that: requirement for CE-marking of hoses when sold separately for use on small craft is not reasonably and differs from marking of such hoses for other similar applications; the question raised about implementing for cylinders the provision for transport of dangerous goods was outside the scope of the installation or performance standards. 13 Next meeting Next CEN BT/WG 69 meeting will be planned to be held in connection to next meeting of TC 188 which will be held in the week of in Netherlands.
