(2) This Rgulation applis to scaling conductd to provid th Dpartmnt with an accounting of harvstd timbr. AR 195/2002 s1;41/2010 Scaling 2 A prson who scals timbr shall do so in accordanc with th procdurs stablishd by th Ministr. Scaling mthods 3(1) A prson who scals timbr shall dtrmin th volum of th timbr in cubic mtrs by using on of th following mthods: (a) by masuring th dimnsions of ach pic of timbr and applying (i) th Albrta Cubic Mtr Scal, or th formula usd to driv th Albrta Cubic Mtr Scal, st out in or (A) Schdul 1 if th timbr is conifrous, or (B) Schdul 2 if th timbr is dciduous, (ii) th following formula, whr authorizd or dirctd by th Ministr: V = (A 1 + A 2 ) x L 2 whr V is th volum of th pic of timbr; 2

(2) A prson who scals timbr using th mthods st out in subsction (1)(a) or (c) may mak dductions from th gross scald volum to account for dfcts containd in that timbr, in accordanc with th procdurs stablishd by th Ministr. Sampl scaling 4(1) Th authorization holdr for a scal sit at which timbr is mass scald shall nsur that loads of timbr ar slctd for sampl scaling in accordanc with scaling sampling plans approvd by th Ministr and th scaling sampling procdurs stablishd by th Ministr. (2) If a load of timbr is slctd for sampl scaling undr subsction (1), th authorization holdr (a) shall, within 30 days aftr th load of timbr was slctd, nsur that a prson holding a valid scalr s prmit and (i) scals th timbr using th scaling mthod st out in sction 3(1)(a) or (c), and (ii) rcords th information collctd by that prson in accordanc with sction 5(1)(a) or (c), (b) shall nsur that a form TM 35 and a form TM 44 ar compltd in accordanc with sction 5(1)(b). Rcording information 5(1) A prson scaling timbr using th mthod st out in 3

6 Sction 6 SCALING REGULATION AR 195/2002 (a) sction 3(1)(a) shall rcord th information collctd on form TM 32 in accordanc with th procdurs stablishd by th Ministr; (b) sction 3(1)(b) shall rcord th information collctd on form TM 35 and form TM 44, in accordanc with th procdurs stablishd by th Ministr; (c) sction 3(1)(c) shall rcord th information collctd in a mannr and form satisfactory to th dirctor. (2) Notwithstanding subsction (1), information that must b rcordd in a form undr subsction (1) may b rcordd in an lctronic format approvd by th Ministr. AR 195/2002 s5;41/2010 Submitting rcords to Ministr 6(1) Th authorization holdr for a scal sit shall nsur that th rcords rfrrd to in sction 5 ar providd to th Ministr within 21 days following (a) th nd of ach month within which timbr was scald at that sit, or (b) th nd of ach paymnt priod within which timbr was scald at that sit if th timbr dus for that timbr will b calculatd in accordanc with Schdul 4 of th Timbr Managmnt Rgulation. (2) If a scal sit rcivs an annual volum of mor than cubic mtrs of timbr, as dtrmind by th dirctor, th authorization holdr for that sit shall nsur that th rcords providd to th dirctor undr subsction (1) ar providd in an lctronic format approvd by th dirctor. AR 195/2002 s6;41/2010 Production of rcords 7 A prson who scals timbr shall produc th prson s scaling rcords and nots to a forst officr on dmand. Chck scaling 8(1) Th authorization holdr for a scal sit at which timbr is mass scald shall nsur that th 4 most rcntly scald sampl loads of timbr ar rtaind at th sit and mad accssibl for chck scaling. 4

7 Sction 9 SCALING REGULATION AR 195/2002 (2) Notwithstanding subsction (1), a forst officr may prmit an authorization holdr to rtain fwr than 4 sampl loads at th scal sit. (3) If dirctd to do so by a forst officr, th authorization holdr for a scal sit at which timbr is not mass scald shall nsur that scald timbr is rtaind as dirctd by th forst officr and mad accssibl for chck scaling. Prmit and authorization rquird 9(1) No prson may scal timbr using th mthod st out in sction 3(1)(a) or (c) unlss (a) that prson holds a valid scalr s prmit, and (b) th timbr is at a scal sit for which a scal sit authorization issud undr sction 12 is in ffct. (2) No prson may scal timbr using th mthod rfrrd to in sction 3(1)(b) unlss (a) th timbr is at a scal sit for which a scal sit authorization issud undr sction 12 is in ffct, and (b) th wighing quipmnt at that sit mts th standards stablishd by th Ministr. Scalr s prmit 10(1) Th Ministr may stablish classs of scalr s prmits and may spcify th scop of authority that may b xrcisd by th holdr of ach class of prmit. (2) An application for a scalr s prmit must b mad in th form spcifid by th Ministr and b accompanid by th rquird f. (3) Th dirctor may issu a scalr s prmit to an applicant who has (a) attaind th ag of 18 yars, (b) subjct to subsction (4), compltd an instruction cours approvd by th Ministr, (c) subjct to subsction (4), compltd an xamination st by th Ministr to a lvl satisfactory to th dirctor, and (d) mt any othr rquirmnts stablishd by th dirctor. 5

8 Sction 11 SCALING REGULATION AR 195/2002 (4) An applicant who satisfis th dirctor that h or sh holds a timbr scaling crtificat, or th quivalnt, issud outsid Albrta is not rquird to mt subsction (3)(b) and (c) if (a) h or sh has compltd a scal that is chck scald, and (b) th chck scal confirms his or hr proficincy in th scaling mthods usd in Albrta. AR 195/2002 s10;41/2010;99/2012 Trm of prmit 11(1) A scalr s prmit xpirs on th dat spcifid on th prmit. (2) Notwithstanding subsction (1), th dirctor may cancl or suspnd a scalr s prmit (a) if th holdr of th prmit contravns th Act or th rgulations undr th Act, or (b) if, in th dirctor s opinion, it is in th public intrst to cancl or suspnd th prmit. AR 195/2002 s11;41/2010 Scal sit authorization 12(1) Th ownr of a timbr opration may apply in writing to th dirctor for authorization to scal timbr at a sit undr th ownr s control. (2) If th dirctor is satisfid that a complt and accurat scal can b prformd at th sit, th dirctor may issu a scal sit authorization to th applicant and may attach conditions to th authorization. (3) Th dirctor may cancl or suspnd a scal sit authorization (a) if th authorization holdr contravns th Act or th rgulations undr th Act, (b) if th authorization holdr has faild to comply with a condition attachd to th authorization, or (c) if, in th dirctor s opinion, it is in th public intrst to cancl or suspnd th authorization.
