1 SALES BULLETIN # 1146 Date: December 28, 2007 Subject: Residential Discontinued Product Policy Update for 2008 To: From: Residential Sales Representatives Ronn W Jefferson, Product Manager, Residential Products An updated summary of the policies and procedures relating to the residential product discontinuation that occurred December 1 st, 2006 (as outlined in SB1099, effective January 1, 2007) is attached. This update supersedes all prior announcements related to said discontinuation. Changes to the previous policy are effective January 1 st, 2008, and summarized as follows: All Tessera flush actuators are placed into Warranty Replacement Only status and are not available for sale through CFC/Geberit o Includes remote push button actuators o The one (1) year warranty period for Tessera flush actuators set to expire on December 31 st, 2007, is extended to LIFETIME, to accommodate the policy change Updated List Price Tessera repair parts for both and carrier systems Detailed policy information and updated list of parts and pricing are found in the attached document. 2 SB1146 Residential Product Discontinuation Policies and Procedures Update 2008 Residential Discontinuation Policies and Procedures (as from SB1099), with updated repair parts listing and warranty matrix for 2008 Sales Policy: The following items will remain active for ongoing purchase: All BWO products including Cascading Tub Fillers and parts are available For OEM customers: in-wall toilet carrier and actuators Repair parts for sale are available for the following items: o Cartridges for Chicago residential faucets o Selected items from the Geberit Tessera product line o For a detailed listing of repair items, see Appendix 1 Service Policy: After 2006, DEFECTIVE will remain the only approved warranty claim for discontinued items. The types of claims that are applicable to the discontinued items are: Manufacturing Defects Finish Defects The compensation for such claims is summarized as follows: CREDIT REFUNDS for defects issued: Chicago Residential faucets & faucet repair parts Geberit Kitchen and Lavatory accessories REPLACEMENT PARTS for defects issued: Faucet cartridges Tessera parts CFC will accept claims from our distribution channel only not end customers. In order for the distributor to get the CREDIT REFUND products, the following must be done: Contact your sales representative who will assess the product and field scrap it No FSRs allowed Submit claim via on-line RGA only RGAs use reason Residential Field Returns (code 280) Customer service approval required for RGA claims Chicago Faucet/Geberit 2008 Product Discontinuation Policies and Procedures (12/28/07) 1 of 6

3 Standard CFC policy for determining refund value of returns will apply If end customers do contact CFC directly regarding a claim, they should be referred to point of sale or appropriate (closest) sales channel for return of the defective product and corresponding compensation. Policy details for each product line are as follows (see also Appendix 2): BWOs o No change from published Geberit terms & conditions OEM in-wall systems o No change from published Geberit terms & conditions Geberit Tessera o Warranties and repair parts will continue to be serviced by Chicago Faucets on an on-going basis o The tank and carrier has a lifetime warranty o Actuators available in ForeverShine PVD Brushed Nickel, ForeverShine PVD Polished Brass, ForeverShine Polished Nickel, and Hard Coat Oil Rubbed Bronze have a lifetime finish warranty o Warranties of all types are extended to Lifetime on all Tessera actuators as listed in Appendix 1 o The flushing mechanism, which is composed of the flush and fill valves only, has a 10 year warranty; the final warranty expires on December 31, 2016 o A list of repair parts that will be available can be found in Appendix 1 Chicago Residential Faucets purchased January 1, 2002 December 1, 2006 o Service parts or replacements, with the exception of cartridges will not be available. Refunds for defective product will be made to the distributor o Lifetime warranty cartridges will remain available from Chicago Faucets o Faucets defined as any metal cast, forged, stamped or formed portion, not including moving parts or water restricting components, are warranted against manufacturer defects for the life of the product o The ForeverShine PVD Brushed Nickel, ForeverShine PVD Polished Brass, ForeverShine Polished Nickel, Hard Coat Oil Rubbed Bronze finishes have a lifetime warranty. All other finishes have a five year warranty which expires on December 31, 2011 Chicago Residential Faucets purchased prior to 2002 o Service parts or replacements, with the exception of cartridges will not be available. 4 o Faucets purchased prior to 2002 in Polished Chrome (CPR), Chrome with Brass Accents (CCB), Coated Polished Brass (CPB), and Polished Brass (PBF) have a five year finish warranty which expires on January 1, 2007 o No replacement will be made for these faucets due to finish defects Geberit Kitchen and lavatory accessories o Service parts or replacements will not be available. Refunds for defective product will be made to the distributor o Accessories are warranted for 1 year against manufacturer defects The final warranty will expire on December 31, 2007 The ForeverShine PVD Brushed Nickel, ForeverShine PVD Polished Brass, ForeverShine Polished Nickel, Hard Coat Oil Rubbed Bronze finishes have a lifetime warranty.
