10 Managing Driver Fatigue and Behaviour DELIVERING SAFE, EFFICIENT, SUSTAINABLE LOGISTICS
11 Driver Fatigue EU Regulation 561/2006 the drivers hour (tachograph) rules for vehicles over 3.5t or 8 passenger seats Transport Act 1968 the British and NI domestic hours for vehicles below 3.5t or exempt EU rules The Road Transport (Working Time) Regulations 2005 regulates total working time for drivers subject to EU rules The Working Time Regulations 1998 control total working time for most other workers
12 Driver Fatigue Common aim of these regulations is to reduce risk arising from fatigue Key requirements for operators to consider are: Ensure drivers understand the rules Properly schedule work to comply Do not encourage breaches Keep records of hours worked and driven Take all reasonable steps to ensure compliance
13 Driver Competence DRIVER LICENSING Regular licence checks Entitlement does not mean competent i.e. Cat C1 pre 1997 Drivers who passed driving tests in other countries Minimum health standard DRIVER CPC Offence to cause or permit driver to drive without Monitor periodic training completed and validity PROVISION AND USE OF WORK EQUIPMENT REGULATIONS (PUWER) Vehicle is often overlooked Vehicle subject to road traffic legislation but it may also be classed as work equipment

18 Safe Driving MOBILE PHONES AND IN-CAB EQUIPMENT Tougher penalties for use of mobile phones Employers must have comprehensive policies in place covering phones and in-cab equipment. Policies should extend to cover hand free phones, satnav equipment, in-cab computers, radio and cd players etc If the drivers control of the vehicle is effected by the use of these items or similar equipment whilst driving then the driver can be charged with failure to have proper control of the vehicle.

24 Driver training All drivers should be fully trained on how your defect reporting system works Measure the effectiveness of this training via assessment Issue written instructions to drivers which should be signed acknowledging they understand Retain all records of training and declarations
25 Walk around checks by drivers Must be carried out by all drivers on taking over the use of any and every vehicle Particular care when there is a change to type of vehicle/trailer operated or where 3 rd party vehicles/trailers are used Adequate facilities and light is provided to carry out checks such as provision of torches or illuminated sites
26 Defect reporting All drivers should be issued with defect report pads Report pads should be serial numbered to aid monitoring Drivers must complete, sign and date each form, even if no defects found known as nil defect reporting Drivers should confirm check is carried out by handing in a completed defect report before vehicle leaves depot Retain for at least 36 months
27 Defect rectification A nominated person must be at each site who decides whether a vehicle can be used on the road or not Person must have appropriate skills and experience or access to others who have the skills and experience If defect requires immediate rectification then vehicle must be taken off the road If the defect can be deferred then it should be noted on defect sheet noting date of repair Driver must always keep a copy in vehicle and at least one copy kept in office or workshop
