2 Concrete & Materials Placement has been providing concrete pumping services across the Carolinas since We are a full service concrete pumping company with experience handling every project size, from back yard patios to parking decks and high rises. Our large and diverse fleet consists of telebelts, large trailer line pumps, placing booms and a variety of pumps sizes, including a 63 meter which is the largest pump available in the Carolinas. CMP also offers small line city pumps and specialty pumps with low overhead openings. Our top priorities are customer satisfaction and job site safety and we are dedicated to meeting these expectations. All of our operators are certified by the American Concrete Pumping Associations (ACPA) and have OSHA 10 or 30 training. We are committed to maintaining a safety process where each employee is active in identifying, preventing, and correcting workplace safety issues. 39 Terms & Conditions General Conditions HOURLY CHARGES: Time on the job including 1 hour set up, pumping time, standby time and clean up time. MINIMUM CHARGE: 4 hours for AM placement, 2 hours for PM placement MOBILIZATION: $2.00 per mile $ minimum CANCELLATIONS: after 4 pm on previous workday are subject to a 4 hours charge. WEEKEND AND HOLIDAYS: Saturday (after 1:00 PM), all day Sunday, or Holiday pours will incur an overtime surcharge of $50.00/hour. SETUP: Contractor will provide a safe set up space and a designated clean up place. ASME B is the prevailing document for safety standards. PRIMING: Customer will provide priming materials or CMP will provide it for $ All pumps greater than 47 meter will require grout. MIX DESIGN: Contractor will provide a concrete mix designed to be pumped. Call for assistance if you have a question about a mix design. SLICK LINE: Boom Trucks requiring system will be charged $1.00 per foot and $250 each way for delivery and pick up. Slick line will always require contractor to provide grout. WRECKER AND RECOVERY: Contractor will pay for any wrecker fees on site if necessary. WASHOUT: Designated clean-out site will be provided by contractor. If no clean out site is available, then we may provide clean-up bag for $80.00 per bag. UNDERGROUND: If underground structures exist, then contractor will locate and mark these structures. Contractor accepts all responsibility for damages to underground structures and CMP equipment due to unsuitable soil conditions OVERHEAD: Conditions with overhead obstructions such as power lines will be disclosed prior to scheduled delivery of pump in order to maintain proper safety protocol. PROPERTY PROTECTION: Contractor will be responsible for protection of any vehicles or structures that are within 50 yards of any part of the concrete pump or CMP equipment. MECHANICAL ISSUES: CMP liability for a CMP mechanical issue will be limited to the amount of the invoice for the Daily Job Ticket. TRAVEL EXPENSES: If necessary the contractor is responsible for motel/hotel charges. DELAYS: CMP reserves the right to clean out or blow down concrete from the pump and associated system if delays occur and CMP operator deems there is a risk to the equipment. No back charge will be accepted by GC in this situation. SITE OR CONTRACTOR SPECIFIC TRAINING: Site specific orientations, drug tests, mandatory meetings, physicals, back ground checks, or safety classes will be at customer s expense. Hourly rate for Operators: $65.00 per hour port to port. 33 of 44 Quote Prices must be accepted within 30 days and are subject to change in 60 days from the date of this proposal.

40 40 of 44 Payment Terms PAYMENT: Applicant(s) agree that invoices are due upon receipt and that any invoice not paid in full within 10 days will accrue interest, which Applicant(s) agree to pay, at the rate of 1.5% per month, or the highest legal rate, whichever is greater, from the invoice date until the full balance and all accrued interest are paid in full. Applicant(s) agree that payment on accounts will be first applied to unpaid interest and then to the Applicant(s) account. WORK STOPPAGE: Applicant(s) agree that should they fail to pay any invoice within the time provided in these Terms and Conditions of Payment that CMP may, in addition to all other rights or remedies which it may have, unilaterally and without notice slow down or cease all construction work and remove its forces and/or material from the Project. Further, should CMP exercise its right to slow down, cease construction and/or remove its equipment, forces and materials from the Project as provided in this paragraph. Applicant(s) agree they will have no right to recover damages of any nature from CMP, its officers, employees, directors, affiliated companies and/or material suppliers resulting from such action(s). ATTORNEY FEES: Applicant(s) agree that if this account is turned over to an attorney for collection they will pay CMP s reasonable attorney s fees and costs of collection, including the costs associated with any lien, whether or not suit is filed. CHOICE OF LAW AND VENUE: The laws of North Carolina shall govern the construction of and enforceability of the terms and interpretation of the rights and duties of the parties as stated in these Terms and Conditions of Payment. The Applicant(s) agree and consent to be subject to the jurisdiction of the Superior Court for Mecklenburg County, State of North Carolina with respect to any action filed as a result of their failure to pay in accordance with these Terms and Conditions of Payment or as to any claims, causes of action, or other disputes arising out of any work performed by CMP or its affiliated companies. ENTIRE AGREEMENT: It is agreed and understood by the Applicant(s) that these Terms and Conditions of Payment supersede and replace all other understandings or agreements with respect to the matters contained herein. These Terms and Conditions of Payment may not be changed, modified or varied except in writing and signed by a Corporate Officer of CMP. Applicant(s) further agree that in the event of a conflict between these Terms and Conditions of Payment and the terms contained in any purchase order or other document produced or provided by Applicant(s), these Terms and Conditions of Payment shall govern. Delivery of these Terms and Conditions via , fax or mail will be deemed as acceptance once concrete pumping services have commenced.

41 ACPA Safety Rules For Workers Assigned To The Pump Crushing hazard. Never, ever position yourself between the ready mix truck and the pump! Stand to the side, where the driver can see you You must know how to stop the pump and boom. Have the operator show you the locations of the emergency stop switches Keep unauthorized personnel off of the pump. You should wear the same personal protective equipment (PPE) as the operator. Goggles, hard hat, ear protection, and rubber gloves Be careful when handling pipeline or any other heavy object. Learn how to lift without using your back. Get assistance if needed. Never stand on, sit on, or straddle a pipeline while it s in use, or whenever it is pressurized. Do not let the concrete level in the hopper become low! If air is sucked into the material cylinders, the pump will compress the air. Alert the operator of the problem. It is his job to know the procedures for safe removal of air from the pump and delivery system. When the operator is initially priming the delivery system, restarting after moving, restarting after adding or removing pipes or hoses, or any time that air has been introduced into the delivery system, stand a reasonable and prudent distance away from the tip hose or point of discharge. Do not get near the discharge until material runs steadily and there is no movement of the delivery system. Compressed air in the line can cause rubber hose to move violently creating hose whip. If you see foreign material that could create a blockage coming from the ready mix truck, alert the operator to stop the pump. Do not attempt to remove the material from the hopper or grate while the hydraulic system is ready to work. Electrocution hazard! If the pump or boom becomes energized with high voltage and you are in contact with any part of it, you are at risk of electrocution! You should monitor the movement of the boom and alert the operator if the boom comes within 17 feet of an electrical wire. Do not look into the end of a plugged hose or pipe! Do not kink the end hose. Kinking will cause the pump to create maximum concrete pressure. The pump may unkink the hose by force! Never try to support the tip hose with your back or shoulders. Let the hose hang from the boom. Never open a pressurized pipeline. The pump operator must release the pressure before you open the line. After removing pipe sections you must reassemble using gaskets and clamps. Pipelines assembled without gaskets will leak cement and water, which can cause a blockage. 35 of 44
