3 SECTION - I SCOPE OF WORK CUM TECHNICAL SPECIFICATION. The scope of work consists of but not limited to the- following scope of services: Providing Two (02) numbers of Light Commercial Vehicles (LCVs) for carrying CNG cascade for Radhanagar DBS, Four (04) numbers of Light Commercial Vehicles (LCVs) for carrying CNG cascade for Udaipur DBS, Four (04) numbers of Light Commercial Vehicles (LCVs) for carrying CNG cascade for Teliamura DBS and Four (04) numbers of Light Commercial Vehicles (LCVs) for carrying CNG cascade for Bishalgarh DBS & Four (04) numbers of Light Commercial Vehicles (LCVs) for carrying CNG cascade for Khowai DBS on rate contract for an initial contract period of two (02) years and further extendable on the discretion of TNGCL on the same rate, terms and conditions The total quantity of LCV s mentioned above is tentative and may vary during the tenure of the Contract with TNGCL. The Date of Commencement of Contract for each part may be variable on as and when required basis. The Contractor will be informed One Month in Advance the Starting Date of Commencement of the Contract. 1. The bidder shall give an undertaking on their letterhead and proof of their capability to deploy minimum 2(two) nos. LCV's (Diesel I CNG) within 2 weeks of Letter of Intent. LCV's should be of model not below year 2013 and in perfect running condition. Out of the awarded number, the contractor must have procured at least half of LCVs and the remaining LCVs can be arranged through long-term hire contract basis. The original documents of the vehicles have to be submitted to TNGCL for verification as and when these are asked for. Each LCV shall be provided with two ear thing connections and fitted with a spark arrestor on engine exhaust. The LCV shall have speed governor fitted and shall fulfil all necessary statutory requirements. TNGCL will require 6 LCVs (02 Nos. for Radhanagar and 04 Nos. for Udaipur) at the starting of contract and further need of LCV will be informed from time to time. The bidder shall have to ensure deployment of new LCV with in a period of 45 days from the date of communication. Any delay beyond 45 days in deployment of LCV will lead to a penalty Rs1000/- per day per LCV or part thereof. All vehicle should have commercial license from date of commencement of work. No vehicle is allowed to work without commercial license. The bidder shall submit schedule of deployment of vehicles within 10 days of award of contract / LOI with documentary proof of complying with the tender requirement. Non submission of satisfactory documents related to deployment plan shall lead to termination of contract at bidders risk & cost 2. The bidder shall submit a monthly summary sheet giving details of CNG purchased from TNGCL stations for operating CNG driven LCV, the summary sheets so produced shall be backed up with the TNGCL receipts. 3. LCVs offered by the contractor should be fit for cascade of TNGCL. Gross vehicle weight of the LCV should not exceed 12 tones. All three sides of the load carrying sections of the LCV are to be removable for easy accessibility of the cascades. The contractor may quote for both CNG run LCV's as well as HSD run LCV. However, while evaluation, No preference will be given to any Special Page 3 of 17

4 Type of Fuel run Vehicle and only the party quoting the lowest rate in total (whether CNG or Diesel) will be the L1 party. If quoted with CNG run vehicle, the CNG kit has to be OEM fitted only; retrofitted CNG vehicles would not be accepted. The bigger size of LCV will be difficult to turn and park in CNG stations hence overall dimensions of the LCV shall be just fit for the specified cascade. The Bidder shall have to get the vehicle approved by TNGCL for the purpose. 4. The contractor has to take delivery of CNG storage cascades from TNGCL store/other designated Location within Agartala or Udaipur or any other TNGCL CNG station as directed by TNGCL. The bidder shall have to securely mount the cascades on LCV chassis with nut and bolts as per the specifications given by TNGCL. Transporters shall ensure that mounting nuts and bolts does not become loose during normal operations. After taking over custody of cascades, up keeping and safety of cascades is the responsibility of the contractor. Any leakage/loose bolting/loose clamp in the cascade shall have to be immediately reported to TNGCL and further transportation of cascade shall have to be carried out only after rectifying the same. Any loss or damage to the itemssuch as valve/knob/fittings/valve handle/pressure gauge,cylinder/tube or any other component of cascade shall be rectified /repaired at the risk & cost of contractor. However, necessary Spares will be supplied by TNGCL. These cascades then transport CNG from Mother Stations to Daughter Stations. On expiry or termination of the contract, contractor shall unload and return cascades at any CNG Mother Station TNGCL Stores at Agartala. The bidder undertakes that his/its representative shall ensure proper feeding of CNG in cascade & the same is maintained properly in tile LCV and its nuts & bolts are duly fixed & tightened tailing which any loss/mishap shall be at his cost & risk. The contractor shall indemnify the losses to the TNGCL. 5. All materials required for securely mounting the cascades & Crane services required for loading & unloading of cascades have to be arranged by the contractor at his own cost. 6. Driver of the LCV shall make/remove the quick release coupling connection at the Daughter Stations and CNG Mother Stations, Operate the Cascade Manifold Valves, Check and record the cascade pressure at CNG Mother Stations and Daughter Stations. For doing these jobs in a safe manner, the drivers have to be trained in any CNG stations of TNGCL before actual deployment to drive the cascade mounted LCV's. It is the responsibility of the bidder to ensure that no untrained driver operates the system and driver does not carry any person / luggage etc. along with the cascade. 7. QUALIFICATION OF DRIVER: Driving License: The drivers MUST HAVE valid driving licenses issued by competent authority for driving goods carrying vehicle. The driver should have experience of carrying hazardous goods. Medical Fitness: The drivers must be medically fit and shall have a certificate issued from registered doctor. The certificate s h a l l be revalidated at least on annual basis and as per doctor's advice 8. DUTY HOURS : No drivers would be allowed to work more than 12 hours in a Page 4 of 17

5 day, any deviation in this regard may lead to Rs.500 per LCV per day or part thereof. Attendance sheet and weekly roster of drivers have to be submitted by the contractor to TNGCL. The duty hours shall fulfil requirements of statutory regulations 9. The Contractor shall bear the entire operational cost of the vehicle for transportation of CNG in cascades & loading and unloading of cascade. These shall include but not limited to the following: a) Salary and other statutory benefits for the driver & supervisors including their insurance b) Cost of tyres, fuels, brake oil and lubricating oil required for operation of the vehicles c) Maintenance and repair cost of the vehicles. d) Licenses, permits, road tax, insurance, incidental expenses and any other statutory levies. e) Any sort of repairing/maintenance job required in the Cascade/LCV/SS Tubes & Fittings. Spares is not in Scope of the Contractor. 10. The contractor shall operate their vehicles at their own risk entirely and TNGCL shall in no case be held responsible for any damage to the vehicles while on TNGCL s work. The contractor shall maintain the vehicles in sound mechanical condition at all the times. The contractor will rectify any defect notified by TNGCL immediately. 11. The contractor shall ensure the safe & correct delivery of CNG at the nominated destinations in the same condition in terms of quality and quantity as has been taken by the contractor at Mother Stations. Any infringement of the above will be deemed as unlawful and TNGCL will hold the contractor legally responsible for the same. Additionally TNGCL also reserves the right in such and event, to forthwith terminate the contract and/or to impose penalties on the contractor, as TNGCL may deem fit. 12. The contractor shall mobilize the transport services within 10(ten) days of the issue of LOI / Fax of Intent. 13. It is to be ensured by the contractor that the LCVs driver is equipped with mobile communication / GPS system at all point of time. In case the contractor fails to provide this facility a Rs. 500/- per day per vehicle or part thereof shall be applicable. 14. All vehicles fitted with proper seat belt have to be available along with drivers for 24 hours in a day for all days. 15. The mobilized fleet shall be fitted with spark/flame arrestor of a design approved by Chief Controller of Explosives and provided with wheel jack, tool kit, and spare wheel in good condition. TNGCL may depute their representative for inspection of condition of LCV and contractor has to maintain vehicles to the satisfaction of TNGCL. 16. The mobilized fleet shall be painted as per colour code and Page 5 of 17

6 description provided by TNGCL on addition to the statutory display requirement to carry CNG. The contractor shall be responsible for providing suitable signboards/display beards during LCV movement on load or in parked condition. Necessary Fire Extinguisher shall be fitted in the vehicle by the Contractor at his own Cost. Contractor shall also ensure refilling of the same as per norms. Each LCV to paint rear & side panels for display of company name and logo, in, combination to fulfill the requirements of display under rules 130 to 137 of Central Motor Vehicles Rules, 1989 and any other statutory regulation. 17. Painting of the color codes and all other statutory displays has to be done by the contractor at his own cost before deploying the vehicles for carrying CNG cascades. 18. Contractor shall securely mount the CNG cascade and make all necessary mounting arrangement including hiring of crane for lifting & handling of CNG cascade, supply of 'u' bolts and nuts for anchoring cascade frame to chassis and installation of necessary supporting stiffener at requisite positions. The complete job of mounting CNG cascade up to the satisfaction of bidders competent technical representative shall be completed within one day of issue of the cascade. 19. Technical specifications/dimension of CNG cascade to be mounted on the LCV are as follows :- Length x Width x Height: Less than 3.6 m x 2 m x 1.8 m Cascade weighs with CNG: A p p r o x. 6.0 ton each 20. Fire extinguisher (DCP/CO2) for each LCV will be arranged by C o n t r a c t o r and shall mount fire extinguishers on the LCVs as per the directions of Engineer-In- Charge. The cost of supply and fabrication of steel material for mounting the extinguishers, as per the directions of TNGCL F&A deptt. shall be borne by the contractor. The contractor will be responsible for p r o p e r r e f i l l i n g a n d c h e c k i n g o f t h e E xt i n g u i s h e r s a s p e r n o r m s. 21. Statutory payments of all taxes, duties, pathkar, octroi, service charges, parking charges etc. pertaining to LCVs shall be borne by the contractor 22. Contractor shall indemnify company for any action under Motor Vehicle Act. 23. Transport services shall be provided round the clock on designated routes and as per the schedule given by Engineer-In-Charge on all days. Transport services shall be governed as follows: (a) Disconnect the quick connect coupling of the cascade after proper de- pressurization of the hose, as soon as storage pressure falls to a level decided by the Engineer-In-Charge and transport the cascade to Mother /filling stations. (b) (c) Connect the cascade with the filling hose by connecting quick connect coupling available at mother station for refilling. Transport the filled the mobile cascades from mother/filling stations to daughter stations and connect to station tubing through quick connect Page 6 of 17

7 coupling. (d) Each LCV shall be provided with a logbook and the pressure level in the mobile cascade in each bank, time, station name etc. to be filled at commencement of each trip. Driver shall also record any leakage, burst disc failure during the trip. The logbook has to be signed by station manager/technician for each trip. (e) Daily filling & dispatch statement has to be prepared by the contractor and the same has to be submitted daily at the respective control rooms of TNGCL by 10 AM daily 24. The LCV drivers/attendants shall wear cotton uniform and safety shoes at the time of duty. Drivers have to maintain the discipline & decorum in the CNG stations. Drivers without proper uniform & shoes will not be allowed to carry on duties & penalty as applicable for absence from duty as mentioned at Clause 30 of Scope of Work shall be levied. 25. Contractor shall carry out all schedule maintenance of LCV and provide the copy of schedule maintenance record to Engineer-In-Charge. 26. In case of any scheduled/unscheduled maintenance/breakdown of LCV, the contractor has to consult the same with Engineer-in-Charge so that No Operational Loss occurs to TNGCL. Such as carrying out the Maintenance Work during Night hours/during Shutdown of Stations taken by TNGCL for other reasons. In case, the same could not be achieved, the Contractor has to arrange alternative arrangement at his own cost. This also includes taking the LCV for statutory requirements to the office of Transport Deptt. for the purpose of obtaining fitness certificate, all other statutory documents and loading unloading of cascades etc. 27. In case the LCV and or the driver remains off duty/absent for more than one day in a month (or for two days if accumulated) due to any reason penalty will be imposed as follows: (a) For non-availability of service due to any reason for more than one hour but less than three hours, Rs 1000 shall be deducted. (b) The absence of driver or LCV for three or more than three hours for any reason shall be treated as being absent for full day and a 1.5 times of the daily pro-rata hiring rate as indicated in the Schedule of Rate shall be levied. (c) The contractor shall obtain the Traffic Police clearance for 24-hour entry permit for plying CNG Cascades mounted LCVs on road. The contractor would be responsible for obtaining the 24 hour permission from DCP/SP (traffic). Any assistance/document required in this regard shall be provided by TNGCL. However, in case of non-availability of permit the additional cost of running of vehicles because of penalty by traffic authority shall have to be born by contractor and if find necessary TNGCL may begin payment from the date when contractor has obtained traffic police "24 hours Entry Permit". 28. The contractor shall be required to take Comprehensive Insurance Policy including third party insurance coverage for each vehicle taken from Page 7 of 17

8 a reputed Insurance Company and shall keep in force during the tenure of the contract. The bidder shall also take necessary insurance coverage for drivers and supervisors engaged in the work and shall provide relevant documents on demand. For all other company's materials i.e. cascades, fire extinguishers etc. TNGCL will arrange insurance at its own cost. in case of any damage caused by the act of the contractor to company s property on the vehicle is not recoverable from the insurance Company, the same will be recovered from the contractor. 29. The contractor is required to ply in between Agartala, Udaipur, Bishalgarh, Teliamura & Khowai. In that case, the additional road tax and toll tax to be paid would be borne by TNGCL ON CASE TO CASE BASIS. LCV provided under the transport services should be covered by ZONAL PERMIT and or other statutory permit at contractor's cost. 30. The contractor shall ensure that no person in the vehicle would smoke or no fire or other ingredients of ignition should be permitted in the vicinity of the vehicle. No other goods should be carried in the vehicle. The vehicle engaged for transportation of CNG shall not carry any persons or goods other than the crew of the vehicle. 31. The contractor shall be required to issue challan mentioned kms run for each trip and submit the same to TNGCL. The trip for the purpose shall be defined as one way one way distance from one CNG station to another CNG station. At the beginning of the contract, standard km chart for the distance between the stations would be jointly prepared and the same would be followed for calculating the kms traveled per Trip. The contractor to provide a GR for every trip along with the bill while clearing the monthly payments. 32. Monthly hiring charges should be quoted considering the cost of HSD and CNG on in Agartala retail outlet of TNGCL. This rate will be considered as base rate of HSD & CNG. If the fluctuation in HSD & CNG retail- selling rate is lower than 1 Rs. Per Kg ( per litre in case of HSD), escalation/de- escalation will be applied only when cumulative total of such fluctuations becomes one Rs. per KG ( per litre in case of HSD) or above from base rate in terms of increase or decrease. The calculation of escalation/de-escalation because of change is cost of HSD & CNG are as follows: (a) The calculation of escalation/de-escalation on account of cost of CNG over base rate, it would be considered that the LCV runs 5.5 KM per Kilogram of CNG consumption. The calculation of escalation/de-escalation on account of cost of CNG over base rate will be done as follows. Let increase of rate of CNG over base rate is Rs.1.00/Kg (from 1st of the month) Total Km run during the month: 1000 Km (including fixed 600 Km) Additional amount to be paid for escalation of cost of CNG: Rs If the escalation/de-escalation is more than Rs.1.00per kg (say Rs.X / kg, Page 8 of 17

9 X >Rs.1/-) & the vehicle runs for Y Kms during the month, the calculation will be as follow: Additional amount to be paid for escalation of cost of CNG (to be deducted in case of decrease of price) =Rs. X * Y *182.00/1000 The CNG escalation (or de-escalation) charges, if any would be paid (deducted along with the extra km bill) (b) The calculation of escalation/de-escalation on account of cost of HSD over base rate. It would be considered that the LCV runs 5.5 KM per litre of HSD consumption. The calculation of escalation/de-escalation on account of cost of HSD over base rate will be done as follows: Let increase of rate of HSD over base rate is Rs.1.00/ltr (from 1st of the month) Total Km run during the month: 1000 Km (including fixed 600 Km) Additional amount to be paid for escalation of cost of HSD: Rs If the escalation/de- escalation is more than Rs1.00 per Liter (say Rs.X per Liter, X>Rs. 1/) & the vehicle runs for Y Kms during the month, the calculation will be as follows: Additional amount to be paid for escalation of cost of HSD (to be deducted in case of decrease of price) =Rs. X* Y *182.00/1000 The HSD escalation (or de-escalation) charges, if any would be paid (deducted along with the extra km bill). 33. The contractor shall provide all statutory /legal facilities to its workmen/employee as per the relevant Act/Law/and rule including applicable rules and laws of the state. Contractor shall ensure the completion of the work in time bound manner failing which TNGCL shall have full liberty to impose penalty & terminate the contract. The Contractor or his authorized representativeshall interact with Engineer-In-Charge daily for smooth movement of the transport services 34. The contractor agrees to indemnify TNGCL to directly or indirectly any loss or injury caused to TNGCL employees/agents due to careless, negligent, inexperienced act or default of the contractor, his/her agents, representatives or employees. 35. Contractor has to ensure the safety of man and machine all the time. The contractor shall remain at all times liable to TNGCL for any loss or damage caused to any building, planed, machinery, employee /agent of TNGCL due to careless, negligent, inexperienced act or default of the contractor, his/their agents, representative or employees TNGCL shall be the sole judge as regards the quantum of loss or damage and it shall be Page 9 of 17

10 entitled to deduct from the amounts payable hereunder to the contractor, the cost of repairs of the amount of loss or damages. Any third party loss of life or property resulted due to negligence of driver or fault of the vehicle shall be the responsibility of the LCV contractor. 36. Regarding work completion, the decision of the Engineer-In-Charge will be final and binding. 37. The contractor shall allow weekly rest to his workmen and daily working hours will be fixed as per the relevant Act/Law/and Rule made there under. However, no work shall be left incomplete/unattended on any holiday/weekly rest. The Contractor or his authorized representative shall interact with Engineer-In- Charge daily for smooth movement of the transport services. 38. The Contractor will be liable for any loss or injury to TNGCL employees /agents due to careless negligent inexperienced act or default of the contractor his /her agent s representative or employees. 39. The Contractor shall make his own arrangements to provide all facilities like office accommodation and transport etc. to his workmen. TNGCL any commitment to provide the contractor or his employees with facilities such as office accommodation, canteen, tea, toilet, telephone etc. 40. Regarding work completion, the decision of the Engineer-In-Charge will be final and binding. 41. All personnel of the contractor entering on work premises shall be properly and neatly dressed and shall wear cotton uniform, safety shoes, badges, (identity card) while working on premises of the company including work sites. If the contractor does not provide shoes, Engineer-In-Charge has the right to withhold payment in full or part. Decision of Engineer-In-Charge regarding amount to be retained is binding on the contractor. However, the TEAM CARD shall always be available with the vehicle. 42. Contractor shall maintain all statutory records like attendance register, wage register, copies of PF & ESI return etc and TNGCL shall have right to inspect the same and ask for submitting the records. 43. Contractor shall maintain proper record of his working employee's attendance and payment made to them. 44. The contractor will strictly adhere to all the safety rules and regulations prevailing and applicable from time to time at the installations as directed by TNGCL 45. The contractor's representative/supervisor shall inform daily to the Shift-in- Charge in the Control rooms for filling & dispatch of LCVs. The contractor will strictly adhere to all the safety rules and regulations prevailing and applicable Page 10 of 17

11 from time to time at the installations as directed by TNGCL. 46. It will be the responsibility of the contractor to pay as per the minimum wages of the appropriate government rules applicable under the Minimum Wage Act TNGCL may repute its representative to ensure compliance of the clause 47. The rates quoted by the bidder must be inclusive of all the taxes, duties, and any other statutory levies on the vehicles, contractor's share of P.F. and insurance charges, contractor's profit, repair & maintenance cost of the LCVs, licenses, permits, works contract tax and any other expenditures etc 48. The services shall be provided in terms of shift pattern on the round the clock basis. The contractor is responsible to provide effective and efficient services in all shifts and assure that there is no disruption in the services for want of any resources. 49. All arrangements for communication from mother /filling stations to the drivers working on jobs under the contract shall be the responsibility of the contractor. The contractor has to provide mobile phones or radio handsets to his supervisors/drivers. 50. No LCV can be taken out of service on account or repair and maintenance or otherwise without providing the replacement. Howe ver, t he same can be planned with the EIC and can be done without any Operational Loss to TNGCL such as during night hours/during Station Shutdown for some other reasons etc. However, if the same is not p ossibl e, Spare Cascade shall be provided by TNGCL on request, the contractor shall do loading and fixing of the cascade on a separate LCV and their rates shall be inclusive of incidental charges on this account. 51. All the jobs mentioned under scope of services shall be carried out as per sound engineering practices. 52. TNGCL may ask the transporters to increase the no. of vehicles during the tenure of contract up to the maximum capacity of deploying vehicles as declared them by giving 45 Days advance notice. In case of failure, penalty as applicable for absence from duty shall be levied TNGCL reserves the right to order all diesel / CNG vehicle or mix deployment. 53. The contractor shall obtained contractor labour license under the contract labour (R&A) act. 54. The rates quoted / agreed by the bidder are Inclusive of all the statutory taxes, duties and levies. 55. The contractor s shall provide proof in respect of separate PF Code / N. of the concerned RPF Commissioner / Authority their bids shall be liable for rejection. 56. Experience: As per BEC (Bid Evaluation Criteria mentioned in Vol - I). 57. COMPLIANCE CLAUSE: Contractor undertakes to comply with all loss / rules / regulations applicable to his business and on enquiry of the same shall furnish information / Documents to TNGCL within 7 days for such enquiry with TNGCL. Contractor also indemnifies TNGCL for noncompliance / Page 11 of 17

12 violation made by its employees / representative. 58. Though the LCVs has initially been taken for Supplying Gas to the DBS mentioned above from Mother Stations located at Agartala, the same may be changed any time during the Contract as per requirement of TNGCL and the Contractor may be asked to carry Gas to any other DBS located in Tripura from any Mother Station in Tripura. The contractor should agree to the same without any extra cost to TNGCL. 59. Termination: a. Undue & unreasonable delay in work completion. b. Failure in compliance of any laws/rules/regulations applicable to his business. c. LCV not following designated route and stopping at locations not designated for the purpose. d. LCVs are not operating as per direction of EIC or as per Specification of the Tender. e. TNGCL have the right to Terminate the Contract anytime during the Contract period with an advance notice of not less than one month. Page 12 of 17
