10 Common City Ordinance Violations (Lincoln, NE) 1 Unless otherwise indicated, city ordinance violations are classified as misdemeanors with possible penalties of a $0 - $500 fine and/or up to 6 months incarceration ( ). 2 Consuming Alcohol in Vehicle on Public Street or Parking Area is an infraction. 3 To be used for enhancement, prior convictions for Inmate of a Disorderly House must have occurred in the ten years prior to the date of the current conviction. 4 To be used for enhancement, prior convictions for Maintaining a Disorderly House must have occurred in the ten years prior to the date of the current conviction. 5 For defendant s 18 years of age and below, there are additional possible penalties. In addition to the regular penalties: 1st offense judge may impound defendant s license (or prevent defendant from obtaining one) for 30 days AND require defendant to attend alcohol education class. 2nd offense judge may impound defendant s license (or prevent defendant from obtaining one) for 90 days, hours of community service AND require defendant to attend alcohol education class. 3rd offense judge may impound defendant s license (or prevent defendant from obtaining one) for 12 months, no less than 60 hours of community service, require defendant to attend alcohol education class AND undergo alcohol assessment. 6 Open Alcohol Container in Motor Vehicle is an infraction. 7 First offense is an infraction, while subsequent offenses are city misdemeanors. 8 For defendant s 18 years of age and below, there are additional possible penalties that mirror MIP penalties. 1st offense judge may impound defendant s license (or prevent defendant from obtaining one) for 30 days AND require defendant to attend drug education class. 2nd offense judge may impound defendant s license (or prevent defendant from obtaining one) for 90 days, hours of community service AND require defendant to attend drug education class. 3rd offense judge may impound defendant s license (or prevent defendant from obtaining one) for 12 months, no less than 60 hours of community service, require defendant to attend drug education class AND undergo drug assessment. 9 Essentially identical to the state statute, there is no express limitation on the age of prior convictions for enhancement purposes. That said, the city ordinance MJ provision only came into existence on December 4, Possession of Drug Paraphernalia is an infraction, regardless of whether it is charged as a first, second or third or subsequent offense. 11 To be used for enhancement, prior convictions for Possession of Drug Paraphernalia must have occurred within a two year period of the current offense. 12 Interestingly, this is a misdemeanor offense, though the maximum penalty is a $100 fine. 13 With the exception of Shoplifting, the respective theft ordinances limit the value of stolen items to less than $300.
