13 *Gross vehicle weight rating (GVWR) means the value specified by the manufacturer as the loaded weight of a single motor vehicle. **Gross combination weight rating (GCWR) means the value specified by the manufacturer as the loaded weight of a combination (articulated) motor vehicle. In the absence of a value specified by the manufacturer, GCWR will be determined by adding the GVWR of the power unit and the total weight of the towed unit and any load thereon.
14 CMV Defini5on for non- CDL Commercial motor vehicle means any self- propelled or towed motor vehicle used on a highway in interstate commerce to transport passengers or property when the vehicle (a) Has a gross vehicle weight rating or gross combination weight rating, or gross vehicle weight or gross combination weight, of 4,536 kg (10,001 pounds) or more, whichever is greater; or (b) Is designed or used to transport more than 8 passengers (including the driver) for compensation; or (c) Is designed or used to transport more than 15 passengers, including the driver, and is not used to transport passengers for compensation; or (d) Is of any size and is used in the transportation of hazardous materials as defined in this section
15 CMV Defini5on for CDL Commercial motor vehicle (CMV) means a motor vehicle or combination of motor vehicles used in commerce to transport passengers or property if the motor vehicle- (a) Has a gross combination weight rating of 11,794 kilograms or more (26,001 pounds or more) inclusive of a towed unit(s) with a gross vehicle weight rating of more than 4,536 kilograms (10,000 pounds); or (b) Has a gross vehicle weight rating of 11,794 or more kilograms (26,001 pounds or more); or (c) Is designed to transport 16 or more passengers, including the driver; or (d) Is of any size and is used in the transportation of hazardous materials as defined in this section.
16 Farm Exemp5on (Varies by State) Farm to market agricultural transportation means the operation of a commercial motor vehicle controlled and operated by a farmer who: Is a private motor carrier of property; Is using the commercial motor vehicle to transport agricultural products from a farm owned by the farmer, or to transport farm machinery or farm supplies to or from a farm owned by the farmer; and Is not using the commercial motor vehicle to transport hazardous materials of a type or quantity that require the commercial motor vehicle to be placarded in accordance with of this subtitle.

27 Supervisors Training Supervisors of drivers are required to be trained in 60 minutes of alcohol misuse training and 60 minutes of controlled substance abuse training. Training is one time and documentation of training and materials must be kept. Can be a video.
28 Driver Training Drivers must be issued information that: Discusses effects of drugs and alcohol and how it effects their life Discusses the testing procedures Discusses who is to be tested Advises who is available to answer questions as it relates to the controlled substance and alcohol testing at your workplace.
29 Random Tes5ng Employers required to test at published rates. All covered drivers shall have an equal chance of being tested during each testing session and the random method shall be scientifically valid.
30 Post Accident Tes5ng Post accident means after motor vehicle collision and not a worker s comp injury. Have procedure in place so that supervisors know what is expected and of course the drivers are aware.

32 Post Accident Tes5ng Alcohol should be gathered in first two hours after accident, if not, then continue to attempt to get test but document why there is a delay, cease after 8 hours Controlled substance test must be completed within 32 hours of accident.

34 Return to Work Tes5ng What if I want to fire the employee rather than send them to counseling? The regulations do not require that you pay for any treatment, you are however required to provide them with a list of Substance Abuse Professionals for their assistance! (names, addresses and telephone numbers)
35 Follow- up Tes5ng At least 6 SAP directed follow- up tests within 12 months of the return to duty. The employer decides the dates of the test when notified by the SAP Can decide for more tests and additional time period for collecting of those tests.

Employers must: Maintain and retain accurate time records for a period of 6 months showing the time the duty period began, ended, and total hours on duty each day in place of RODS.
58 Recap of hours Recap of hours are used by the driver to determine what hours they have available to drive. It is not required by FMCSReg s to be filled out but lack of recap makes enforcement officers suspicious and they dig further.
