QUESTION(S) FOR COUNCIL: Does the Council wish to adopt Ordinance 1648, An Ordinance Amending West Linn Municipal Code Chapter 6 Relating to Vehicles and Parking, Updating Adoption of the Oregon Vehicle Code and Repealing Provisions Duplicative of or Contradictory to State Law? BACKGROUND & DISCUSSION Chapter 6, Vehicles and Traffic, includes the City s uniform traffic regulations, parking provisions, some crimes, as well as other provisions. The Municipal Court Judge, Rhett Bernstein, identified some beneficial changes to the parking citations. Some of the Judge s concerns resulted in the identification of WLMC provisions regarding parking that could be revised or eliminated to conform with state law and a request to include a Local DUII Conviction Fee of $45 in the Miscellaneous Fees and Charges also before the Council. The Council authorized staff to review and draft changes to Chapter 6, to eliminate redundancies and conflicts with the Oregon Revised Statutes and within the West Linn Municipal Code on June 6, These revisions will be beneficial to West Linn police officers because it will simplify the citation process for traffic violations and parking violations. Each of the provisions proposed for repeal in Ordinance 1648 has a corresponding provision in state law or in another section of the WLMC that makes it unnecessary. A table is below to demonstrate the redundancies. Ordinance 1648 accomplishes the directive to eliminate contradictory and repetitive provisions, and it adopts the latest version of the Oregon Vehicle Code and the Manual on Uniform Traffic Control Devices for Streets and Highways. In addition, the proposed ordinance does the following: Separates multiple violations and exemptions in one paragraph into separate paragraphs (See 6.070, Unlawful Riding); Modernizes language and corrects errors in paragraphs that were being amended (See 6.020, Duties of City Manager: eliminates thereto ); Repeals vague provisions that make enforcement difficult or unlikely (See 6.080(2)(a) replacing courteous and safe operation with helmet requirement and (2)(b) requiring audible signal); and Updates section headings to reflect remaining content (See 6.100). COUNCIL OPTIONS 1. Adopt Ordinance 1648, including revisions, if any, proposed by the Council tonight. 2. Direct staff to make modifications to Ordinance 1648 and bring it back for Council action at its next regularly scheduled meeting. 3. Vote to postpone adoption of Ordinance Potential Motion: 1 & 2. Move to approve First Reading, and if unanimous, move to approve Second Reading and adopt the ordinance. Council: Move to approve First Reading of Ordinance 1648, An Ordinance Amending West Linn Municipal Code Chapter 6 Relating to Vehicles and Parking, Updating Adoption of the Oregon Vehicle Code and Repealing Provisions Duplicative of or Contradictory to State Law, and set the matter for Second Reading. 3 ORDINANCE NO AN ORDINANCE AMENDING WEST LINN MUNICIPAL CODE CHAPTER 6 RELATING TO VEHICLES AND PARKING, UPDATING ADOPTION OF THE OREGON VEHICLE CODE AND REPEALING PROVISIONS DUPLICATIVE OR CONTRADICTORY TO STATE LAW Annotated to show deletions and additions to the code sections being modified. Deletions are bold lined through and additions are bold underlined. WHEREAS, Chapter II, Section 4, of the West Linn City Charter provides: Powers of the City. The City shall have all powers which the Constitution, statutes and common law of the United States and of this State now or hereafter expressly or implied grant or allow the City, as fully as though this Charter specifically enumerated each of those powers; WHEREAS, the City wishes to update Chapter 6 to repeal provisions that are contradictory or duplicative of the Oregon Vehicle Code; and NOW, THEREFORE, THE CITY OF WEST LINN ORDAINS AS FOLLOWS: SECTION 1. Amendment. Sections [Applicability of State Traffic Laws] through [Definitions] are amended to read: Applicability of State Traffic Laws. A violation of the Oregon Revised Statutes Vehicle Code, Chapters 153 and 801 through 823, inclusive, as now constituted in 2015, is an offense against the City Definitions. In addition to those definitions contained in the State laws enumerated in Section 6.005, the following words or phrases, except where the context clearly indicates a different meaning, shall mean: Bicycle. A nonmotorized vehicle designated to be ridden, propelled by human power, and having one or more wheels the diameter of which are in excess of 10 inches or having two or more wheels where any one wheel has a diameter in excess of 15 inches. Bus stop. A space on the edge of a roadway designated by sign for use by buses loading or unloading passengers. Loading zone. A space on the edge of a roadway designated by sign for the purpose of loading or unloading passengers or materials during specified hours or specified days. Motor vehicle. Every vehicle that is self-propelled, including tractors, fork lift trucks, motorcycles, road building equipment, street cleaning equipment, and any other ORD # Page 1 of

4 vehicle capable of moving under its own power, notwithstanding that the vehicle may be exempt from licensing under the motor vehicle laws of Oregon. Park or parking. The condition of: (a) A motor vehicle that is stopped while occupied by its operator with the engine turned off; (b) A motor vehicle that is stopped while unoccupied by its operator whether or not the engine is turned off. Pedestrian. A person on the public right-of way except: (a) (b) The operator or passenger of a motor vehicle or bicycle; A person leading, driving, or riding an animal or animal drawn conveyance. Stand or standing. The stopping of a motor vehicle while occupied by its operator with the engine running except stopping in obedience to the instructions of a traffic officer or traffic control device or for other traffic. Stop. Complete cessation of movement. Street and other property open to public travel shall have the following meanings: (a) Street. The terms highway, road, and street, when used in this ordinance or in the Oregon Revised Statutes chapters incorporated herein, shall be considered synonymous, unless the context precludes such construction. Street, as defined in this ordinance and the Oregon Revised Statutes chapters incorporated by reference herein, includes alleys, sidewalks, and parking areas and access ways owned or maintained by the City. (b) Other Property Open to Public Travel. Property whether publicly or privately owned and whether publicly or privately maintained, upon which the public operates motor vehicles either by express or implied invitation other than streets as defined in this section. Other property open to public travel shall include but not be limited to parking lots, service station lots, shopping center and supermarket parking lots, and other access ways and parking areas open to general vehicular traffic, whether or not periodically closed to public use. Taxicab stand. A space on the edge of a roadway designated by sign for use by taxicabs. Traffic control device. A device to direct vehicular or pedestrian traffic, including but not limited to a sign, signaling mechanism, barricade, button, or street or curb marking installed by the City or other authority. Traffic lane. That area of the roadway used for the movement of a single line of traffic. ORD #1648 Page 2 of 10

5 Vehicle. As used in subsequent sections of this section includes bicycles. SECTION 2. Amendment. Section [Duties of the City Manager] is amended to read: Duties of the City Manager. The City Manager shall exercise the following duties: (1) Implement the ordinances, resolutions and motions of the Council and his own orders by installing traffic control devices. The City Manager may authorize the placement of traffic control devices. Such installation shall be based on the standards contained in the Manual on Uniform Traffic Control Devices for Streets and Highways, U.S. Department of Transportation, Federal Highway Administration , to and include the Oregon supplements thereto concerning standard practices and interpretations and additional traffic signs as they are now constituted in SECTION 3. Amendment. Sections [Unlawful Riding] through [Sled and Skateboard Prohibition] are amended to read: Unlawful Riding. (1) No operator shall permit a passenger and no passenger shall to ride on a vehicle upon a street except on a portion of the vehicle designed or intended for the use of passengers. This provision shall not apply to an employee engaged in the necessary discharge of a duty, or to a person riding within a truck body in space intended for merchandise. (2) No passenger shall ride on a vehicle upon a street except on a portion of the vehicle designed or intended for the use of passengers. (2) (3) No person shall board or alight from a vehicle while the vehicle is in motion upon a street. (4) An operator or passenger does not commit the offense described in subsections (1) and (2) if the: (a) Passenger is secured with a safety belt or safety harness in the open bed of a motor vehicle; (b) Passenger is seated on the floor of the open bed of a motor vehicle in which all available passenger seats are occupied; (c) Passenger is an employee engaged in the necessary discharge of a duty of his or her employment; or (d) Vehicle is being operated in an organized parade. 6 6.075 Clinging to Vehicles. No person riding upon a bicycle, motorcycle, coaster, roller skates, sled, or other device shall attach the device or himself to a moving vehicle upon a street. Nor shall t The operator of a vehicle upon a street shall not knowingly allow a person riding on a bicycle, motorcycle, coaster, roller skates, sled, or any of the above vehicles orother devices to attach himself, the vehicle, or the device to the operator s vehicle. Exceptions may be made to this section, upon authorization of tthe Chief of Police, may authorize an exception to this section for the purpose of conducting a parades or demonstration displays Sled and Skateboard Prohibition. (1) No person shall use the streets or bicycle lanes, paths or trails, or public sidewalks for traveling on skis, toboggans, sleds, soapbox racers, or similar devices. (2) No person shall use the streets or bicycle lanes, paths or trails, or public sidewalks for traveling on skateboards, roller skates (including inline skates), coasters (nonmotorized scooters) or similar devices except as described below: (a1) The courteous and safe operation of skateboards, roller skates, and coasters is permitted on residential sidewalks, bike trails and paths, and in City-designated skateboard parks. No person shall operate a skateboard on premises open to the public without wearing protective headgear of a type approved under ORS for bicycle helmets. Headgear is recommended on private property. Violation of this subsection is a specific fine violation with a presumptive fine of $25. (b2) The operator of a skateboard, roller skates, and/or coaster must yield the right-of-way to any pedestrian using the same sidewalk, trail, or path and/or designated crosswalk and all persons riding a skateboard, roller skates, or coaster must give an audible signal or sound a warning before overtaking or passing such pedestrian. (c3) No person shall operate skateboards, roller skates, or coasters before sunrise or after sunset without wearing a reflective device on the front and back of the rider. (d4) No skateboards, roller skates, or coasters shall be operated in a careless or reckless manner which endangers or would be likely to endanger the operator, any other person, or any property other than the operator s. (e5) Privately constructed and owned Sskateboard jumps, ramps, or any similar structure may only be used on private property and no part of the structure may extend to any part of a public sidewalk, public street, bike trail or path, or any other public right-of-way. (f6) The operator of a skateboard, roller skates, or coaster, shall not carry a package, bundle or article which prohibits the operator from having full control of the skateboard, roller skates, or coaster and unhindered vision. 7 (g7) Whenever a police officer has probable cause to believe a skateboard, roller skates, or coaster was or is being used in violation of this code, the skateboard, roller skates, or coaster may be seized as evidence and held until the disposition of any charges. SECTION 4. Amendment. Sections [Parking in a Single Space] through [Use of Loading Zone] are amended to read: Method of Parking in a Single Space. (1) No person shall stand or park a vehicle in a street other than parallel with the edge of the roadway, headed in the direction of lawful traffic movement, and with the curbside wheels of the vehicle within 12 inches of the edge of the curb, except where the street is marked or signed for angle parking. (2) Where parking space markings are placed on a street, no person shall stand or park a vehicle other than in the indicated direction and, unless the size or shape of the vehicle makes compliance impossible, within a single marked space. (3) The operator who first begins maneuvering his motor vehicle into a vacant parking space on a street shall have priority to park in that space, and no other vehicle operator shall attempt to deprive him or his priority or block his access. (4) Whenever the operator of a vehicle discovers that his vehicle is parked close to a building to which the fire department has been summoned, he shall immediately remove the vehicle from the area, unless otherwise directed by police or fire officers Prohibited Parking and Standing of Commercial Vehicles and Trailers. In addition to the state motor vehicle laws prohibiting parking, no person shall park or stand: (1) A vehicle upon a bridge, viaduct, or other elevated structure used as a street or within a street tunnel unless authorized; (2) A vehicle in any alley other than for the expeditious loading or unloading of persons or materials but in no case for a period in excess of 30 consecutive minutes; (13) A motor truck as defined by ORS , a truck tractor as defined by ORS , and/or a semi-trailer as defined in ORS , which semi-trailer is equipped with an on board refrigeration device, on a street between the hours of 9:00 p.m. and 7:00 a.m. of the following day in front or adjacent to a residence, hotel, or other sleeping accommodation; (4) A vehicle upon a parkway or freeway, except as authorized; (5) No trailer or semi-trailer with a bed or box in excess of five feet in width and eight feet in length shall be parked upon any residential public street for a period longer than four hours unless it is loading or unloading except with the express written permission ORD #1648 Page 5 of 10

8 of the chief of police or his designee. This prohibition shall not apply to trailers or semitrailers owned or operated by governmental units or public or private utility companies; (6) An unlicensed motor vehicle or trailer on any public street or right of way; (7) An unmounted camper on any public street or right-of way; (8) A vehicle in a designated fire lane Prohibited Parking. No operator shall park and no owner shall allow a vehicle to be parked upon a street for the principal purpose of: (1) Displaying the vehicle for sale; (2) Repairing or servicing the vehicle, except repairs necessitated by an emergency; (3) Displaying advertising from the vehicle; (4) Selling merchandise from the vehicle, except when authorized Use of Loading Zone or Alley. No person shall stand or park a vehicle for any purpose or length of time, other than for the expeditious loading or unloading of persons or materials, in an alley or a place designated as a loading zone when the hours applicable to that loading zone are in effect. In no case when the hours applicable to the alley or loading zone are in effect shall the stop for loading and unloading of materials exceed the time limits posted. If no time limits are posted, then the use of the alley or loading zone shall not exceed 30 minutes. SECTION 5. Amendment. Section [Action by Police Officer] is amended to read: Action by Police Officer. Whenever a police officer finds a motor vehicle unattended with the ignition key in the vehicle in violation of section ORS , the police officer is authorized to remove the key from vehicle and deliver the key to the person in charge of the police station. SECTION 6. Amendment. Sections [Bicycle Operating Rules] through [Pedestrians Use of Sidewalks] are amended to read: Bicycle Operating Rules. In addition to observing all other applicable provisions of this ordinance and state law, a rider of a bicycle upon a street shall not: (1) Not rride upon a sidewalk within a business district; (2) Yield the right of way to pedestrians on sidewalks; ORD #1648 Page 6 of 10

9 (3) On a two way street, rride to the extreme right on a two way street, except when preparing for a left turn. On a one way street, ride to the extreme curbside of the traffic lane and with the direction of travel designated for that lane. If the curb lane is designated for left turn or right turn only, and the operator is not intending to turn, he shall operate in the through lane; (4) Not carry a package, bundle, or article which prohibits him from having full control of the bicycle and unhindered vision (5) Not rride abreast of another bicycle or in any manner other than single file, except on designated bicycle paths; (6) Not ooperate a bicycle in a careless or reckless manner which endangers or would be likely to endanger himself, another, or any property. Racing or trick riding shall be included in this offense; (7) Not lleave a bicycle, except in a bicycle rack. If no rack is provided, he shall leave the bicycle so as not to obstruct any roadway, sidewalk, driveway, or building entrance. Nor shall he leave the bicycle in violation of the provisions relating to the parking of motor vehicles Impounding of Bicycles. (1) It is unlawful to leave a bicycle on public or private property without the consent of the person in charge or the property owner thereof. (2) A bicycle left on public property may be impounded by the police department. (3) In addition to any citation issued, a bicycle parked on public property or in violation of this ordinance may be immediately impounded by the police department. (4) If a bicycle impounded under this ordinance is licensed, or there is some other means of determining the owner its ownership exist, the police shall make reasonable efforts to notify the owner. (5) A bicycle impounded under this ordinance which remains unclaimed shall be disposed of in accordance with the city s procedures for disposal of abandoned or lost personal property Pedestrians--Use of Sidewalks. A pedestrian shall not use a roadway for travel when a sidewalk is available. SECTION 7. Amendment. Section [Funeral Procession] is amended to read: Funeral Procession. (1) A permit shall not be required to conduct a funeral procession. (2) The procession shall proceed to the place of interment by the most direct route which is both legal and practicable. 10 (3) The procession shall be accompanied by adequate escort vehicles for traffic control purposes. (4) All motor vehicles in the procession shall be operated with their lights turned on. (5) No person shall unreasonably interfere with a funeral procession. (6) No person shall operate a vehicle that is not part of the procession between the vehicles of a funeral procession. SECTION 8. Amendment. Section [Citation on Illegally Parked Vehicle] is amended to read: Citation or Towing of on Illegally Parked Vehicle. Whenever a vehicle without an operator is found parked in violation of a restriction imposed by this ordinance, t The officer finding the an illegally parked vehicle shall take its license number and any other information displayed on the vehicle which may identify its owner., and shall conspicuously affix to the vehicle a traffic The citation shall require for the operator to answer to the charge against him or her or pay the penalty imposed at the location specified in the citation by within five days during the hours and at a the date and time place specified in the citation. (1) Citation. If no person is in charge of an illegally parked vehicle, and the vehicle s location is not hazardous, the police officer may place a citation in or on the vehicle in a conspicuous place. If the vehicle is occupied the citation shall be served upon the occupant. (2) Towing and Impounding. A vehicle may be towed and impounded as provided for in section if the vehicle is: a. Parked in a manner that obstructs traffic or constitutes a hazard; or b. Left on any street, avenue, public place, city-owned or city operated property indefinitely by reason of wreckage, damage, theft, abandonment or neglect. SECTION 9. Amendment. Section [Owner Responsibility] is amended to read: Owner Responsibility. The owner of a vehicle placed in parked in violation of a parking restriction shall be responsible for the offense, except where the unless the operator used of the vehicle was secured by the operator without the owner s consent. The owner shall have the burden of proving that he or she did not give the operator consent to use the vehicle. SECTION 10. Amendment. Section [Claiming Vehicles] is amended to read: Claiming Vehicles. ORD #1648 Page 8 of 10

11 When any vehicle has been towed, the owner or person entitled to possession thereof may obtain possession upon showing adequate evidence of a right to its possession, and paying the charges due for towing and storage to the towing company, and any towing fee to the City, as set by resolution. a fine in the amount of not less than $7.00 in any case where a vehicle was parked in a hazardous manner, and a fine in the amount of not less than $2.00 in all other cases. SECTION 11. Repeal. The following West Linn Municipal Code Sections are repealed in their entirety: , Obedience to and Alteration of Control Devices; , Rules of Road; , Emerging From Vehicle; , Damaging or Obstructing Public Ways; , Obstructing Streets; , Leaving Unattended Vehicle; , Standing or Parking of Buses and Taxicabs; , Restricted Use of Bus and Taxicab Stands; , Bicycle Equipment; , Careless Driving, through 6.205, Enforcement; , Failure to Comply with Traffic Citation; , Unlawful Parking Towing Authorized; , Placement of Citations; , Outstanding Warrants Impound or Arrest; , Illegal Stopping, Standing or Parking. Any municipal code provisions in conflict with the provisions contained in this Ordinance are also repealed. SECTION 12. Severability. The sections, subsections, paragraphs and clauses of this Ordinance are severable. The invalidity of one section, subsection, paragraph, or clause shall not affect the validity of the remaining sections, subsections, paragraphs and clauses. SECTION 13. Savings. Notwithstanding this amendment/repeal, the City ordinances in existence at the time any criminal or civil enforcement actions were commenced, shall remain valid and in full force and effect for purposes of all cases filed or commenced during the times said ordinance(s) or portions thereof were operative. This section simply clarifies the existing situation that nothing in this Ordinance affects the validity of prosecutions commenced and continued under the laws in effect at the time the matters were originally filed. SECTION 14. Codification. Provisions of this Ordinance shall be incorporated in the City Code and the word ordinance may be changed to code, article, section, chapter or another word, and the sections of this Ordinance may be renumbered, or re-lettered, provided however that any Whereas clauses and boilerplate provisions (i.e. Sections [12-15]) need not be codified and the City Recorder or his/her designee is authorized to correct any cross-references and any typographical errors. 12 SECTION 15. Effective Date. This ordinance shall take effect on the 30 th day after its passage.
