1 Government of Bihar Forest & Environment Department --- NOTIFICATON Patna 15, Dated Whereas, the Governor of Bihar is of the opinion that the making of enquiry and record, contemplated under subsection (3) of the section 29 of the Indian Forest Act, 1927 (Act No. XVI of 1927) will occupy such length of time as in the meantime it may endanger the rights of the State Government. Now, therefore, in exercise of the powers conferred by the previse of the aforesaid sub section and by sub section (1) of section 29 of the said Act, the Governor of Bihar is pleased to declare that pending such enquiry and record, the provisions of chapter IV of the said Act be applicable to the lands where there is any tree or not, specified in the schedule I, II, III, & IV here to without abridging or affecting existing rights or the operations of the parent departments such as repairs broadening of roads, etc. By order of the Governor of Bihar (Gyan Prakash Dubey) Ashok/ Dy. 9 NOTIFICATION Patna, Dated... S.O. Whereas the land on both the sides of Canals having any tree or not have been notified as Protected Forest under section 29 of the Indian Forests Act 1927 vide Government notification no E Dated Now, therefore, in exercise of the power conferred by the section 30 of the Indian Forest Act, 1927 read with clause (a) of sub section (1) of section-80 of the said Act, the Governor of Bihar is pleased to (a) (b) Declare all the trees in the above protected Forest to be reserved from the date of this notification. Prohibit the quarrying of stone, or the burning of lime or charcoal, or the collection of subjection to any manufacturing process, or removal of, any Forest produce and the breaking up of land or clearing for cultivation of building, for herding cattle from the date of this notification. Provided that the above restrictions will not apply in the case of any bonafide operations of the parent department concerning the broadening of Road, plugging/ repair of breaches in them other similar bonafide activities for which the concerned parent department shall notify the competent officers for ordering such operation. will be duly notified to the concerned Divisional Officer. (c) Entrust the responsibility of the above mentioned Protected Forests for the purpose of afforestation on the available wasteland, Departmental felling of. other related activities for the proper maintenance and.. keep of the aforesaid Protected Forest to the Forest Department.
