It shall be unlawful for any person to operate a motor vehicle within the corporate limits of the Town of Greeneville in violation of the "Tennessee Registration and Licensing of Motor Vehicles law found at T.C.A et seq. It shall be unlawful for any person to operate a motor vehicle within the corporate limits of the Town of Greeneville in violation of the "Uniform Classified and Commercial Driver License Act" found at T.C.A et seq. The provisions of T.C.A and are hereby adopted by reference together with the following enumerated statutes, the violation of such within the corporate limits of the Town of Greeneville shall be an offense against the Town of Greeneville. 8 CHAPTER SPEED LIMITS SECTION In general At intersections In school zones and near playgrounds In congested areas In general. It shall be unlawful for any person to drive a motor vehicle upon any highway or street at a rate of speed in excess of thirty (30) miles per hour except where official signs have been posted indicating other speed limits in which cases the posted speed limit shall apply At intersections. It shall be unlawful for any person to operate or drive a motor vehicle through any intersection at a rate of speed in excess of fifteen (15) miles per hour unless such person is driving on a street regulated by traffic control signals or signs which require traffic to stop or yield on the intersecting streets In school zones and near playgrounds. It shall be unlawful for any person to operate or drive a motor vehicle at a speed in excess of fifteen (15) miles per hour when passing a school during recess or while children are going to or leaving school during its opening or closing hours In congested areas. It shall be unlawful for any person to operate or drive a motor vehicle through any congested area at a rate of speed in excess of any posted speed limit when such speed limit has been posted by authority of the municipality.

9 CHAPTER TURNING MOVEMENTS SECTION Generally U-turns Generally. No person operating a motor vehicle shall make any turning movement which might affect any pedestrian or the operation of any other vehicle without first ascertaining that such movement can be made in safety and signaling his intention in accordance with the requirements of the state law U-turns. U-turns are prohibited.

No driver shall enter any intersection or marked cross walk unless there is sufficient space on the other side of such intersection or cross walk to accommodate the vehicle he is operating without obstructing the passage of traffic in or on the intersecting street or cross walk. This provision shall be effective notwithstanding any traffic-control signal indication to proceed Following emergency vehicles. No driver of any vehicle shall follow any authorized emergency vehicle apparently traveling in response to an emergency call closer than five hundred (500) feet or drive or park such vehicle within the block where fire apparatus has stopped in answer to a fire alarm.

11 Running over fire hoses, etc. It shall be unlawful for any person to drive over any hose lines or other equipment of the fire department except in obedience to the direction of a fireman or policeman Driving on streets closed for repairs, etc. Except for necessary access to property abutting thereon, no motor vehicle shall be driven upon any street that is barricaded or closed for repairs or other lawful purpose Yellow lines. On streets with a yellow line placed to the-right of any lane line or center line such yellow line shall designate a no-passing zone, and no operator shall drive his vehicle or any part thereof across or to the left of such yellow line except when necessary to make a lawful left turn from such street Miscellaneous traffic-control signs, etc. It shall be unlawful for any pedestrian or the operator of any vehicle to violate or fail to comply with any traffic-control sign, signal, marking, or device placed or erected by the state or the municipality unless otherwise directed by a police officer. It shall be unlawful for any pedestrian or the operator of any vehicle to willfully violate or fail to comply with the reasonable directions of any police officer Unauthorized traffic-control signs, etc. No person shall place, maintain, or display upon or in view of any street, any unauthorized sign, signal, marking, or device which purports to be or is an imitation of or resembles an official traffic-control sign, signal, marking, or device or railroad sign or signal, or which attempts to control the movement of traffic or parking of vehicles, or which hides from view or interferes with the effectiveness of any official traffic-control sign, signal, marking, or device or any railroad sign or signal Presumption with respect to traffic-control signs, etc. When a traffic-control sign, signal, marking, or device has been placed, the presumption shall be that it is official and that it has been lawfully placed by the proper municipal authority Driving through funerals or other processions. Except when otherwise directed by a police officer no driver of a vehicle shall drive between the vehicles comprising a funeral or other authorized procession while they are in motion and when such vehicles are conspicuously designated Damaging pavements. No person shall operate upon any street of the municipality any vehicle, motor propelled or otherwise, which by reason

12 9-12 of its weight or the character of its wheels or track is likely to damage the surface or foundation of the street Riding on outside of vehicles. It shall be unlawful for any person to ride, or for the owner or operator of any motor vehicle being operated on a street, alley, or other public way or place to permit any person to ride on any portion of such vehicle not designed or intended for the use of passengers. This section shall not apply to persons engaged in the necessary discharge of lawful duties nor to persons riding in the load-carrying space of trucks Projections from the rear of vehicles. Whenever the load or any projecting portion of any vehicle shall extend beyond the rear of the bed or body thereof the operator shall display at the end of such load or projection, in such position as to be clearly visible from the rear of such vehicle, a red flag being not less than twelve (12) inches square. Between one-half (1/2) hour after sunset and one-half (1/2) hour before sunrise there shall be displayed in place of the flag a red light plainly visible under normal atmospheric conditions at least two hundred (200) feet from the rear of such vehicle Causing unnecessary noise. It shall be unlawful for any person to cause unnecessary noise by unnecessarily sounding the horn, "racing" the motor, or causing the "screeching" or "squealing" of the tires on any motor vehicle Truck traffic regulated. The street and traffic departments of the Town of Greeneville are empowered to designate and mark, under the supervision of the board of mayor and aldermen, truck routes and by-passes in, through, and around the Town of Greeneville. It shall be unlawful and illegal for any through truck traffic to use any of the public streets of Greeneville except those marked and designated as truck routes. When signs are erected giving notice hereof, no person shall operate any tractor trailer truck at any time upon any of the streets or parts of streets where such signs are posted pursuant to authority of the board of mayor and aldermen Leaving scene of accident. The driver of any vehicle involved in an accident resulting in injury to or death of any person or damage to any vehicle or property shall immediately stop his vehicle at the scene of such accident or as close thereto as possible without obstructing traffic more than is necessary. He shall forthwith give his name and address and the registration number of the vehicle he is driving and shall, upon request and if available, exhibit his operator's or chauffeur's license to the person struck, or the driver or occupant of, or person attending any vehicle collided with. He shall also render to any person injured in such accident reasonable assistance, including

13 9-13 the carrying, or the making of arrangements for the carrying, of such person to a physician, surgeon or hospital for medical or surgical treatment if it is apparent that such treatment is necessary or if such carrying is requested by the injured person. The driver of any vehicle which collides with any vehicle which is unattended shall immediately stop and shall then and there either locate and notify the operator or owner of such vehicle of the name and address of the driver and owner of the vehicle striking the unattended vehicle or shall leave in a conspicuous place in the vehicle struck a written notice giving the name and address of the driver and of the owner of the vehicle doing the striking and a statement of the circumstances thereof Riding horses on streets and sidewalks. (1) The riding of horses on the sidewalks of the Town of Greeneville is prohibited. (2) Horses may be ridden on the streets of the Town of Greeneville only as close to the right curb as possible and not more than two abreast. (3) The riding of horses at night is prohibited unless a proper light is carried so that the animal and rider may be visible for a distance of 300 feet to the rear of the animal. (4) The above regulations set forth in subsections (2) and (3) do not apply for a parade or if special permission is obtained from the police department for the waiver of such rule Cruising. (1) No persons shall drive or permit a motor vehicle under his care, custody, or control to be driven past a traffic control point more than three times within one-hour period from 7:00 p.m. to 1:00 a.m., Monday through Sunday, including all holidays, in or around a no-cruising area so as to contribute to traffic congestion, obstruction of streets, sidewalks, or parking lots, impediment of access to shopping centers or other buildings open to the public or interference with the use of property or conduct of business in the area adjacent thereto. (2) A traffic control point as used in this section means any point or points within that no-cruising area established by the police department for the purpose of monitoring cruising. (3) Upon designation of any portion of any public street or public right of way as a "no-cruising" area, the chief of police or his designee is authorized to cause signs to be posted at appropriate points within said area, said signs to designate the area as a "no-cruising" area and providing the applicable time period during which this section shall be enforced. (4) Designated no cruising area. The board of mayor and aldermen shall designate those areas of the Town of Greeneville as deemed appropriate to be

14 9-14 "no-cruising" areas. It is hereby declared that that area bounded by the southern right of way of the 11-E By-Pass and Justice Avenue on the north, thence Tusculum Blvd. and East Bernard Avenue on the east, Church Street to its intersection with Main Street to its intersection with the southern right of way of 11-E By-Pass is designated as a "no cruising" area. (5) This section shall not apply to official emergency, fire or police vehicles, licensed taxi-cabs for hire, business vehicles being driven for business purposes, buses, and residents of the designated area traveling to a specific designation. (6) Any person violating the provisions of this section may be fined fifty dollars ($50.00) for each offense.

No person shall leave any motor vehicle unattended on any street without first setting the brakes thereon, stopping the motor, removing the ignition key, and turning the front wheels of such vehicle toward the nearest curb or gutter of the street. Except as hereinafter provided, every vehicle parked upon a street within this municipality shall be so parked that its right wheels are approximately parallel to and within eighteen (18) inches of the right edge or curb of the street. On one-way streets where the municipality has not placed signs prohibiting the same, vehicles may be permitted to park on the left side of the street and in such cases the left wheels shall be required to be within eighteen (18) inches of the left edge or curb of the street. Notwithstanding anything else in this code to the contrary, no person shall park or leave a vehicle parked on any public street or alley within the fire limits where signs giving notice hereof have been posted between the hours of 12:00 midnight and 4:00 a.m. or on any public street, alley, or publicly owned or leased parking lot, for more than forty-eight (48) consecutive hours without the prior approval of the chief of police. Furthermore, no person shall wash, grease, or work on any vehicle, except to make repairs necessitated by an emergency, while such vehicle is parked on a public street.

16 Angle parking. On those streets which have been signed or marked by the municipality for angle parking no person shall park or stand a vehicle other than at the angle indicated by such signs or markings. No person shall angle park any vehicle which has a trailer attached thereto or which has a length in excess of twenty-four (24) feet Occupancy of more than one space. No person shall park a vehicle in any designated parking space so that any part of such vehicle occupies more than one such space or protrudes beyond the official markings on the street or curb designating such space unless the vehicle is too large to be parked within a single designated space Where prohibited. No person shall park a vehicle in violation of any sign placed or erected by the municipality, nor: (1) On a sidewalk. (2) In front of a public or private driveway. (3) Within an intersection or within fifteen (15) thereof. (4) Within fifteen (15) feet of a fire hydrant. (5) Within a pedestrian cross walk. (6) Within fifty (50) feet of a railroad crossing. (7) Within twenty (20) feet of the driveway entrance to any fire station, and on the side of the street opposite the entrance to any fire station within seventy-five (75) feet of the entrance. (8) Alongside or opposite any street excavation or obstruction when other traffic would be obstructed. (9) On the roadway side of any vehicle stopped or parked at the edge or curb of a street. (10) Upon any bridge. (11) Alongside any curb painted yellow or red by the municipality Loading and unloading zones. No person shall park a vehicle for any purpose or period of time other than for the expeditious loading or unloading of passengers or merchandise in any place marked by the municipality as a loading and unloading zone Regulation of town parking. In the absence of an official sign to the contrary which has been installed by the municipality, between the hours of 8:00 a.m. and 6:00 p.m., on all days except Sundays and holidays declared by the governing body, parking shall be regulated on all city streets and all parking facilities owned or leased by the municipality or the town parking authority. Regulation shall be effected by signs indicating available parking areas, time limit signs, parking meters, and such other means of regulation as

17 9-17 the municipality may adopt by ordinance hereafter. The presumption shall be that all installed signs, time limits, and parking meters were lawfully installed by the municipality Lawful parking in regulated spaces. Any space regulated by the municipality or its parking authority on any street or any parking facility owned or leased by the municipality or its parking authority may be lawfully occupied by a vehicle only after proper payment has been made to the municipality or the parking authority by payment in advance of the lease fee or after the proper coin has been deposited in a parking meter, and the said meter has been activated or placed in operation in accordance with the instructions printed therein. Free parking spaces regulated by the city may be occupied only in accordance with the time limits for that space Unlawful parking in regulated spaces. It shall be unlawful for the owner or operator of any vehicle to park or allow his vehicle to be parked in a parking space regulated by the municipality for more than maximum period of time allowed by signs regulating that space or the maximum amount of time which can be purchased at one time at the parking meter. It shall be unlawful for the owner or operator of any vehicle to move that vehicle from regulated space to regulated space on the same block so as to defeat the purpose of the time limit regulations enacted by the municipality. Insertion of additional coin or coins in a meter to purchase additional time over the maximum allowed is unlawful. No owner or operator of any vehicle shall park or allow his vehicle to be parked in a regulated space after the time limit has expired on the regulating signs or when the parking meter regulating that space indicated no parking time allowed, whether such indication is the result of a failure to deposit a coin or to operate the lever or other actuating device on the meter, or the result of the automatic operation of the meter following the expiration of the lawful parking time subsequent to depositing a coin therein at the time the vehicle was parked Unlawful to occupy more than one regulated space. It shall be unlawful for the owner or operator of any vehicle to park or allow his vehicle to be parked across any line or marking designating a parking space regulated by the municipality or otherwise so that such vehicle is not entirely within the designated parking meter space, provided, however, that the vehicles which are too large to park within one space may be permitted to occupy two adjoining spaces provided the maximum time on time regulated spaces is not exceeded or provided proper coins have been placed in both meters Unlawful to deface or tamper with regulating signs, instructions, or meters. It shall be unlawful for any unauthorized person to remove, tamper

18 9-18 with, deface, willfully break, destroy, open or impair the usefulness of any regulating sign, instructions or parking meters Unlawful to deposit slugs in meters. It shall be unlawful for any person to deposit in a parking meter any slug or other substitute for a coin of the United States Presumption with respect to illegal parking. When any unoccupied vehicle is found parked in violation of any provision of this chapter there shall be a prima facie presumption that the registered owner of the vehicle is responsible for such illegal parking Disabled parking. Tennessee Code Annotated, , excluding however subsections (d) and (e), is hereby adopted by reference and violation of the same within the corporate limits of the Town of Greeneville is hereby designated and declared to be an offense against the Town of Greeneville Municipal parking authority. In order to guide and coordinate parking in the present and future development of the town there is hereby created a municipal parking authority to be organized and exist as follows: (1) Name. The name shall be the Greeneville Parking Authority. (2) Membership. It shall consist of five (5) members, one (1) of whom shall be the mayor of the town, with the remaining members to be appointed by the board of mayor and aldermen for a term of two (2) years, except that in making the initial appointments, two (2) shall be appointed for terms of one (1) year each and two (2) shall be appointed for terms of two (2) years each. (3) Organization, rules, staff and finances. (a) The authority shall elect a chairman from among its membership to be elected for a one (1) year period. (b) The authority shall adopt such rules and regulations which may be reasonable to carry out the objective of this section. (c) The authority is granted the power to employ necessary personnel to carry out said objectives. (d) The expenditures of the authority shall be within the amounts appropriated by the board of mayor and aldermen. All purchases and payments shall be made under the supervision of the recorder as purchasing agent and treasurer. (4) Powers and duties. The authority shall have the power and it shall be its duty to coordinate parking in the town, to make recommendations to the board of mayor and aldermen concerning parking, the acquisition of additional space, and the use of existing facilities under lease by the town or which may be acquired under a leasehold arrangement.

When a police officer or other authorized municipal official halts a traffic violator other than for the purpose of giving a warning, and does not take such person into custody under arrest, he shall take the name, address, and operator's license number of said person, the license number of the motor vehicle involved, and such other pertinent information as may be necessary, and shall issue to him a written traffic citation containing a notice to answer to the charge against him in the city court at a specified time. The officer or other authorized municipal official, upon receiving the written promise of the alleged violator to answer as specified in the citation, shall release such person from custody. It shall be unlawful for any alleged violator to give false or misleading information as to his name or address Failure to obey citation. It shall be unlawful for any person to violate his written promise to appear in court after giving aid promise to an officer upon the issuance of a traffic citation, regardless of the disposition of the charge for which the citation was originally issued. Violation of this section shall be punished as contempt of court and a show cause order shall issue upon application of a police officer or other authorized municipal official. The

20 9-20 judicial officer of the town may issue such orders and executions as are appropriate under the circumstances of each individual case Illegal parking. (1) Whenever any motor vehicle without a driver is found parked or stopped in violation of any of the restrictions imposed by this code, the officer or other authorized municipal official finding such vehicle shall take its license number and may take any other information displayed on the vehicle which may identify its user, and shall conspicuously affix to such vehicle a citation for the driver and/or owner to answer for the violation at a place specified in the citation. For all parking violations, with the exception of violation of handicapped parking and violation of fire lane parking, the offender may summarily waive his right to a judicial hearing, and have the charges disposed of in court but the fines shall be nineteen dollars ($19.00) if paid prior to court date. After court date a ten dollar ($10.00) late penalty will be assessed. Upon a hearing the fine shall not be less that nineteen dollars ($19.00), nor more than fifty dollars ($50.00). If the offense is a fire lane violation the offender may have the charge against him/her disposed of by paying to the Town of Greeneville a fine of twenty-four dollars ($24.00), provided he waives his/her right to a judicial hearing. After the time of the judicial hearing a ten dollar ($10.00) late penalty will be assessed. Upon a hearing the fine assessed shall not be less than twenty-four dollars ($24.00) nor more than fifty dollars ($50.00). (2) Unauthorized parking in spaces designated for disabled. (a) Any person, except a person who meets the requirements for the issuance of a distinguished placard or license plate, a disabled veteran's license plate, or who meets the requirements of Tennessee Code Annotated, (d), who parks in any parking space designated with the wheelchair disabled sign, shall be punishable by a municipal fine of fifty dollars ($50.00). (b) Any person not meeting the requirements of Tennessee Code Annotated, who uses a handicapped placard to obtain parking shall forfeit use and possession of such placard. (3) State litigation privilege taxes and place of payment. In addition to any fine, late penalty and court costs, the offender shall pay all applicable state litigation privilege taxes. Payment of all fines, together with late penalties, costs and state litigation privilege taxes shall be made at the Greeneville Police Department Impoundment of vehicles. Members of the police department are hereby authorized, when reasonably necessary to prevent obstruction of traffic, or in obedience to an order of the judicial authority of the municipality, to

21 9-19 remove from the streets and impound any vehicle whose operator is arrested, or any vehicle which is illegally parked, abandoned, or otherwise parked so as to constitute an obstruction or hazard to normal traffic Towing and storage charges. In the enforcement and execution of the provisions of this chapter, the chief of police shall charge and collect the standard charges prevailing in the Town of Greeneville for towing and storage of motor vehicles Disposal of "abandoned motor vehicles." "Abandoned motor vehicles" as defined by chapter 250, Public Acts of Tennessee for 1967, shall be impounded and disposed of by the police department in accordance with the provisions of said chapter 250, Public Acts of Tennessee for Penalties - towing policy. For the purpose of protection of public safety, insuring the public welfare, maintenance of orderly traffic flow, and regulation of municipal parking, the city adopts a towing policy by ordinance which is in words as follows: Vehicles will be towed from all parking spaces regulated by the municipality if the vehicle is parked or left unattended in violation of municipal ordinances, or in violation of Tennessee state laws pertaining to motor vehicles, or if said vehicle constitutes a traffic/pedestrian hazard. The owner/registrant of the vehicle will be responsible for any fines and/or towing fees assessed against the vehicle. Vehicles may be towed for the following: (1) Blocking a fire hydrant. (2) Blocking the roadway, walkway, driveway, access way. (3) Parked in an emergency vehicle lane. (4) Stolen, abandoned, or unregistered vehicle (i.e. no tags, switched tags, etc.) (5) Pursuant to city court orders, enforcing overdue fines. (6) Blocking a regulated or leased space, preventing access to that space by one legally entitled thereto Enactment of the "Williamsport Plan." There is hereby established a plan for parking to be known as the "Williamsport Plan" which as established shall be as follows: (a) The effected areas shall be all parking areas on Main Street between Spencer Street and McKee Street; and all parking areas on Depot Street between College Street and Irish Street, as well as any other lots under

22 9-22 municipal control which the municipality or the Greeneville Parking Authority may designate. (b) All parking meters shall be bagged and not used during the term of this plan. There shall be signs, information, and notification erected on all available spaces as determined by the authority, the city planner, and the recorder to the effect that each available space is for free parking, two-hour maximum. (c) A violation of the two-hour maximum time limit shall result in a violation and a citation issued therefor by a municipal parking attendant, or authorized municipal employee. (d) The amount of the citation will be nineteen dollars ($19.00). There will be a maximum of two (2) citations per vehicle per day for overtime parking. The fine and court costs, including all state litigation taxes, shall be paid in the manner set forth in herein. (e) Instructions in training of the municipal parking attendant shall be in accordance with the procedures established by the Town of Greeneville, Tennessee Approval of agreement between Town of Greeneville and Greeneville Parking Authority. The attached agreement between the Town of Greeneville and the Greeneville Parking Authority, wherein the authority agrees to designate certain of its employees as municipal parking attendants to perform all duties necessary to carry out the parking provisions of the traffic ordinances, is hereby approved Limitation of fine. The maximum municipal penalty for violation of any statute herein above adopted by reference shall be a civil fine not in excess of fifty dollars ($50.00) Duplication, conflicts, etc. To the extent any of the above adopted statutes conflict or duplicate with the other provisions of this title 9, the adopted statutes shall prevail.
