1 New Machinery Directive Machinery Directive 2006/42/EC Member States to adopt and Publish 29 th June 2008 Directive applies in full 29 th December 2009 This Directive now looks at the lifecycle of the machine

3 ARTICLE 1 Scope This Directive applies to the following products: (a) machinery; (b) interchangeable equipment; (c) safety components; (d) lifting accessories; (e) chains, ropes and webbing; (as part of lifting machinery or lifting accessories) (f) removable mechanical transmission devices; (g) partly completed machinery.

4 Exemptions safety components intended to be used as spare parts to replace identical components and supplied by the manufacturer of the original machinery; machinery specially designed and constructed for research purposes for temporary use in laboratories;

9 Changes - New Inclusions The new directive applies to 2- and 3-wheeled vehicles outside the scope of 2002/24/EC e.g. vehicles for the disabled, to vehicles capable of reaching a maximum of up to 6 km/h and to minimotorbikes with combustion engine.

10 Changes - Penalties Member states should provide penalties, which should be effective and dissuasive.. On a summary conviction a fine not exceeding the statutory maximum and/or 3months imprisonment. ( 5, at present) On conviction of an indictment unlimited fine and/or 2 years imprisonment.

12 Changes to Definitions of Machinery that has to comply 1. An assembly fitted with or intended to be fitted with a drive system other than directly applied manual or animal effort, consisting of linked parts or components, at least one of which moves, and which are joined together for a specific application 2. Machinery referred to in 1 missing only the components to connect it on site or to sources of energy and motion. 3. Lifting apparatus whose only power source is directly applied manual effort.

An assembly of machines and / or partly completed machinery which, in order to achieve the same end are arranged and controlled to function as an integral whole. 5 Interchangeable equipment means a device which, after placing into service with machinery or tractor is assembled with that machinery or tractor by the operator himself in order to change its function.

15 Safety Component which serves to fulfil a safety function, which is independently placed on the market, the failure and/or malfunction of which endangers the safety of persons, and which is not necessary in order for the machinery to function, or for which normal components may be substituted in order for the machinery to function.

19 Definitions - Article 2 Definition J authorised representative means any natural and legal person in the Community who has received a written mandate from the manufacturer to perform on his behalf all or part of the obligations and formalities connected with this directive. (not in UK S.I.)

20 Annex 1 - General Principles The manufacturer or his Authorised Representative must carry out a Risk Assessment on the machinery in order to determine the health and Safety Requirements which apply to the machinery determine the limits of the machinery, which include the intended use and any reasonably foreseeable misuse thereof,

21 EN Definition Risk assessment is a series of logical steps to enable, in a systematic way, the examination of the hazards associated with machinery. Risk assessment is followed, whenever necessary, by risk reduction as described in clause 5 of BSEN :1992. When this process is repeated it gives the iterative process for eliminating hazards as far as possible and for implementing safety measures.

24 Changes to conformity assessment requirements Where the analysis of risk demonstrates that the Directive has no relevance in terms of health and safety the following procedure is applied. Affix the CE mark Retain the risk assessment for ten years and have it available for inspection if required. There is no requirement for a Declaration of Conformity or Technical File.

25 Changes to conformity assessment requirements Where the analysis of risk demonstrates that the Directive is relevant in terms of health and safety the following procedure is applied. The manufacturer must, after complying with the EHSR s Compile a Technical File Draw a Declaration of Conformity for each machine Affix the CE mark on each machine.

27 New EHSR s Ergonomics Operating Positions The operating position must be designed and constructed in such a way as to avoid any risk due to exhaust gases/ lack of oxygen Etc Seating Work stations constituting an integral part of the machine must be designed for the installation of seating Lightning Machinery which is designed for outdoor use and which may be subject to the direct effects of lightning must be fitted with a system for conducting the resultant electrical charge to earth.

28 New EHSR s Manual Controls must be: Control systems must be designed and constructed, in a way that will prevent a hazardous situations arising has been removed and is now incorporated in Manual Controls must be: Clearly visible and identifiable; the use of pictograms is recommended. From each control position the operator must be able to ensure that there are no persons in the danger zone If necessary, means must be provided to ensure that the machinery can be controlled only from control positions located in one or more predetermined zones or locations.

29 Changes to EHSR s Stability Machinery and its components must be designed and constructed that they are stable enough for use without risk of overturning, falling or unexpected movement. This requirement also applies during transportation, assembly, dismantling, scrapping and any other action involving machinery.

30 Changes to EHSR s Guards and protection devices Must be securely held in place Guards must protect against the ejection or falling of materials and objects Fixed guards Must be fixed with systems that can be opened only with tools. Their fixing systems must remain attached to the guards when removed Where possible guards must be incapable of remaining in position without their fixings

31 Changes to EHSR s Instructions All machinery must be accompanied with instructions in an Official Community language or languages of the member state it is being placed on the market. The word original must appear on the language version Instructions A translation must be provide by the manufacturer or his Authorised representative or by the person bringing the machinery into that language area. These instructions must be marked with the word Translation

33 Changes to the Declaration of Conformity Name and address of the person who is authorised to compile the Technical File, who must be established in the European Community. Where appropriate a statement confirming declaration of conformity with other applicable directives The place and date of the declaration. There is no longer a separate declaration for safety components. Must be typewritten or handwritten in capital letters

34 Changes to the CE Marking The CE marking must be affixed in the immediate vicinity of the name of the manufacturer or his authorised representative and be applied using the same technique.
