1 PROPOSED AMENDMENTS TO RESIDENTIAL PARKING STANDARDS To review the proposed amendments Approval of the amendments (5-3) Ogden City Planning is proposing several amendments and clarifications to the parking standards for residential areas. The changes provide definitions for several key terms, address standards for additional parking for non-conforming residential properties, clarify parking reductions near the Central Business District and transit stops, revise standards for surface materials, clarify standards for circular driveways, and revise parking standards for recreational vehicles. Specifically with regard to recreational vehicle parking, the ordinance provides clarification and allowance for gravel or crushed concrete parking surfaces for RV pads if the pad is set behind the front the house for single-family lots. The Ogden City Planning Division has been working to address some issues related to off-street parking on residential properties. The proposed changes provide clarification on some standards and propose new standards for others. The changes are meant to provide clearer language when applying the standards for residential parking as well as setting a clear standard for allowing gravel or crushed concrete parking pads for recreational vehicles. September 4, 2018 The Council reviewed the proposed amendment at the work session on September 4, The Council expressed a desire to continue its review at the September 18, 2018 work session. The current proposal deals with several different areas related to residential parking. The proposed amendments are summarized below: Ogden City Council Work Session: September 18,

2 Section 1 Definitions The proposed ordinance adds definitions to the terms Drive Approach/Approach and Driveway. The definitions clarify that the Drive Approach is on public property within the right-of-way and that the Driveway is the portion on private property. Section 2 Non-complying Residential Structures The changes in this section deal with adding a parking space to properties that have one off-street parking space or no off-street parking spaces and which are considered non-conforming. The ordinance clarifies some existing standards for the expansion of parking and adds language specifying driveway design. The proposed ordinance sets forth the following driveway design standards: The drive approach may be widened to match the width of the expanded driveway. This option must be done if no curb and gutter are present. The driveway may be tapered to match the width of the existing drive approach. This option is not available if no curb and gutter exist. Section 3 Multi-family Residential Parking Requirements near CBD and Transit Stops This section clarifies when a parking reduction may be applied to multifamily housing units near the Central Business District or a transit stop. The changes clarify that a reduction of 0.5 parking stalls per unit may be applied within one block, or 660 feet, of the CBD or a transit stop and that the measurement is based on legal public walking distance. Section 4 Parking Space & Driveway Surfaces This section sets the standards for the surfaces and materials that may be used for legal parking. These standards are referred to in several other sections of the ordinance. The standards are as follows: Any vehicle driveway or access way that leads from private property onto a public street shall be paved with the materials described in this subsection. Materials used for driveway and parking areas for manufacturing, commercial, or multi-family residential uses are limited to the following: o Concrete: Minimum 4 depth that covers the entire area used for access, maneuvering, and parking; Ogden City Council Work Session: September 18,

3 o Asphalt: Minimum 2 ½ depth that covers the entire area for access, maneuvering, and parking; or o Masonry or stone pavers rated for vehicle weight that covers the entire area used for access, maneuvering, and parking. Materials used for driveway and parking areas for any single-family or duplex use are limited to the following: o Concrete; o Asphalt; o Sod block; or o Masonry or stone pavers rated for vehicle weight. Driveways and parking spaces for single-family and duplex uses can be formed as a continuous pad or as drive strips of the same materials listed in the previous section and designed to accommodate the wheels of the vehicle. o Each drive strip should be between 16 and 24 inches wide. o The interior space between the drive strips may be filled with landscaping or gravel, but not dirt or road base. o Road-base, crushed concrete, gravel, or similar materials are not allowed for required parking pads, driveways, or drive strips. Materials used for driveways and parking areas in the Open Space zone are limited to the following: o Concrete: Minimum 4 depth that covers the entire area used for access, maneuvering, and parking; o Asphalt: Minimum 2 ½ depth that covers the entire area for access, maneuvering, and parking; o Masonry or stone pavers rated for vehicle weight; or o Permeable materials such as gravel, crushed concrete, or stone; provided that compacted soil or road-based alone are not considered allowable permeable surfaces. Parking spaces shall have appropriate bumper guards or curbs where necessary as determined by the site plan review, to protect adjoining property owners or persons using a sidewalk. Paved areas may not drain onto adjacent properties nor is the surface drainage allowable to cross the public sidewalk. Section 5 Circular Driveway Amendments This section deals with circular driveways on single-family and duplex lots. The ordinance proposes the following standards: Ogden City Council Work Session: September 18,

4 Circular driveways cannot be used to satisfy off-street parking requirements. The midpoint of the arch must be set back at least 20 feet. Driveway widths cannot be wider than 14 feet at the street connection. The area between the property line and the driveway must be landscaped. Total pavement area in the front yard cannot be more than 50% of the front yard setback. Section 6/7 Recreational Vehicle Parking This section relocates and rewords the standards for recreational vehicle parking on single-family dwelling lots. Some of the standards exist currently, some of the proposed standards are clarifications/modifications, and some are newly proposed. This section does not apply to additional parking for non-conforming lots. The general requirements state that dwelling unit must have at least one parking space in a private garage, that the RV may not be used for storage for anything other than what is customary, and that the RV may not be occupied as a dwelling. The RV parking must be located in one of the side yard setbacks or rear setback and must meet the following requirements: o The parking area must be at least 8 feet wide and at least 18 feet in length; o The space cannot be covered if located within a side yard; o All storm water must be directed to avoid drainage on adjacent property; o Parking cannot be located within the 20 foot side yard setback on a corner lot; and o Access to the parking area must be either: Widened drive approach to match the driveway width. This option must be done when no curb and gutter exist; or Tapered driveway to match the existing drive approach width. This may be done only when curb and gutter are present. The materials used for the RV parking must be those listed in the previous section, or may be gravel or crushed concrete if located behind the required front yard setback of the dwelling. 5 and driveway leading to the RV parking area must be constructed from the materials listed in the previous section and cannot be gravel or crushed concrete. The Planning Commission reviewed the proposed amendments at several work sessions and regular Commission meetings between February and May of this year. The Commission forwarded a recommendation of approval of the proposed changes to the Council with a vote of 5-3 at the May 2, 2018 meeting. The recommendation was based on the finding that the proposed parking amendments are consistent with the intent of the general plan and will be for the welfare of the community. Several Commissioners voted against the motion at the May 2 nd Commission meeting. The transmittal documents provide further detail on their individual objections; however, all indicated that they felt that gravel could be allowed within the front setback under certain circumstances. Mr. Steve Poorman spoke at the May 2 nd meeting indicating that he has a gravel driveway and that it is not impactful to his neighbors and feels that gravel should be allowed. 1. Transmittal 2.
