2 Off road Regulation Background First adopted in 2007 Intendedto to reduce pollution from over 150,000vehicles Compliance requirements vary by fleet size Fleet Size Category Small Medium Large Description Fleet <= 2,500 hp, or Municipality <= 2,500 hp, or Municipality fleet in low population county Captive attainment area fleet Fleet with 2,501 to 5,000 hp Fleet with more than 5,000 hp All state and federal government fleets Amended in December 2010 Reduce and delay requirements Who is Affected? Diesel and alternative diesel fueled vehicles that are: Off road Self propelled 25 hp or greater Drive engines only Operate within California 2

3 Current Requirements Report and Label Idling Idling Policy Sales Disclosure Equipment Identification Number (EIN) Reporting and Labeling All vehicles must be reported and labeled Reporting can be done by submitting hard copy forms, or online at: Labeling ARB assigns equipment identification number (EIN) to vehicle Fleets must label lblvehicles within 30 days of receiving ii EIN Label not issued by ARB; specifications available online 3

4 Idling limit = 5 minutes EXCEPTIONS: Off road Idling Queuing Maintenance Ensure safe operation Do work Responsibility of Renter Large & Medium fleets must have written policy Disclosure of Applicability (Sales Disclosure) Must include this language g in bill of sale, and keep records for 3 years (only required for in state transactions): When operated in California, any off road diesel vehicle may be subject to the California Air Resources Board In Use Off Road Diesel Vehicle Regulation. It therefore could be subject to retrofit or accelerated turnover requirements to reduce emissions of air pollutants. 5 Future Requirements Performance Requirements (requirements to reduced emissions) Restrictions on adding vehicles Amended in December 2010 Performance Requirements Fleet must be in compliance by January 1 st each compliance year First compliance date varies by fleet size: Large: Medium: Small: Each year fleet must either: Meet Fleet Average Target OR Meet Best Available Control Technology (BACT) requirements 5

6 Fleet Targets and BACT Fleet average targets Different for each fleet Based on fleet s NOx emissions BACT Fleet must retire, repower, designate low use, or retrofit certain % of horsepower Varies from 4.8% to 10% per year Restrictions on Adding Vehicles Ban on adding Tier 0s and unregistered Tier 1s Does not begin until recent amendments are certified by Secretary of State, and US EPA authorization granted unregistered means those Tier 1s not in DOORS by March 1, 2011 Ban on adding Tier 1s Begins 2013 for large and medium fleets, 2016 for small fleets Ban on adding Tier 2s Begins 2018 for large and medium fleets, 2023 for small fleets 6

8 Statewide Truck and Bus Regulation Commonly referred to as the On road regulation Originally adopted in December 2008 Applies to: diesel fueled trucks and buses > 14,000 GVWR, privately or federally owned privately and publicly owned school buses Compliance for Lighter Trucks Lighter trucks: 14,001 to 26,000 GVWR No reporting required PM filter by 2014, exempts truck until

9 Compliance for Heavier Trucks Heavier trucks: > 26,000 GVWR Two primary compliance paths Compliance by engine model year Phase in schedule Compliance by Engine Model Year No reporting required 9
