1 A 6..6 Committee of Inquiry into Emission Measurements in the Automotive Sector Additional written questions to Ms Elżbieta BIEŃKOWSKA Follow-up to the EMIS hearing of September 6 No Question During the EMIS hearing you stated that the JRC stands ready to support national authorities in their investigations related to the dieselgate scandal. However, when Valeria Sanzari, Procure della Repubblica at the Tribunal of Padova asked the JRC to run some tests on a Porsche vehicle under investigation in order to get reliable and neutral test results, the JRC refused to offer its services. Can you explain why the JRC decided not to follow up on the request made by the Italian judiciary? How is this in line with statements that you made earlier that you would allow JRC to help if a national authority would make such a request? The European Commission's Joint Research Centre (JRC) on 9 May6 received from the Italian public prosecutor, office of Padova, a request asking JRC to perform, as prosecutor's technical consultant, a number of car emissions tests for the new Porsche Cayenne 5 vehicle type, with the purpose to verify the presence or not of defeat devices, i.e. devices that can affect the results of type approval tests.. The JRC supports the development and implementation of European type-approval legislation through developing new testing methodologies and technological options for reducing vehicle emissions and for increasing their energy efficiency. However, the current legislative framework does not foresee that the Commission, and the JRC in particular, checks the conformity or type-approves vehicles entering the EU market, or looks for defeat devices as requested by the Italian Prosecutor. Market surveillance is the responsibility of the Member States. While the proposal for a revised type approval framework foresees a supervisory role for the Commission in market surveillance, the outcome of the ongoing legislative process cannot be pre-empted. The Commission concluded that it was inappropriate for the JRC to accept a specific request of a national judicial authority at this point in time, in particular from a prosecutor's office that aims to establish a liability of a car manufacturer. In contrast, upon request of Type-Approval Authority of an EU Member State, the JRC can verify test results by performing testing at its laboratory.

2 No Question The above basis has been explained to the Prosecutor in the reply letter sent on 4 July 6. In recent months, the JRC did some on-road PEMS tests on multiple Euro 6 vehicles from different manufacturers. The results of these tests have so far not been made public and have not been transmitted to the European Parliament. During the hearing, you promised that the data of these tests would be made available to the EMIS committee. When will the test results be made available to the EMIS committee in a non-anonymized way?. During the visit of the EMIS delegation to Ispra, ongoing tests with cars in the lab and on road with PEMS have been mentioned. On the question if these data could be made available, JRC responded at the time that it was still ongoing work. The tests are part of the tasks within an Administrative Arrangement signed with DG GROW. In annex you find the detailed test results from 4 cars (Audi A, Skoda Yeti, Citroen Cactus, Ford Fiesta) as performed by the JRC.
