1 ITEM 48 CITY MANAGER S REPORT AUGUST CITY COUNCIL MEETING ITEM ADJUSTMENT TO ALLIED WASTE SOLID WASTE COLLECTION RATES FOR FY RECOMMENDATION Adopt Resolution to Authorize an Increase of Allied Waste Collection Rates for Fiscal Year Based on the Consumer Price Index SUMMARY Lathrop Municipal Code Section and Section 26 of the original agreement between the City of Lathrop and Allied Waste Corporation Allied Waste dba Republic Services Company provide that residential and commercial collection rates shall be reviewed annually and adjusted effective July 15f Determination of any appropriate adjustments to the maximum permitted rate will be based on the Consumer Price Index for All Urban Consumers CPI U for San Francisco Oakland San Jose California area On July staff received a request from Allied Waste to adjust their commercial and residential rates by 23 effective September The proposed rate increase is based on the annual CPI U percentage change overthe last year ending April BACKGROUND At the June 2 Z014 City Council Meeting Council approved Amendment No 2 to the original Agreement dated October between the City of Lathrop and Allied Waste to provide the necessary services for the collection transportation and disposal of solid waste generated within the City limit and for compliance with the source reduction and recycling elements of the City s waste management plan Lathrop Municipal Code Section and Section 26 of the original Agreement provide that residential and commercial collection rates shall be reviewed annually and adjusted effective July 1 Determination of any appropriate adjustments to the maximum permitted rate will be based on the Consumer Price Index for All Urban Consumers CPI U for the San Francisco Oakland San Jose California area not to exceed 40

4 CITY MANAGER S REPORT PAGE 4 AUGUST CITY COUNCIL MEETING ALLIED WASTE SERVICES CPI ADJUSTMENT FOR FY COUNCIL GOALS ADVANCED BY THIS AGENDA ITEM This agenda item promotes Public Safetv by maintaining contract requirements for solid waste management within the City of Lathrop FISCAL IMPACT No fiscal impact at this time However pursuant to Section 27 of the original agreement between the City of Lathrop and Allied Waste and LMC Ordinance Allied Waste shall remit to the City of Lathrop a Franchise Fee of seven 7 percent and a A6939 Recycling Fee of three 3 percent of the gross revenue collected within ten 10 days following the completion of each calendar month ATTACHMENT A Resolution No 15 B Rate Adjustment Request from Allied Waste letter dated July

6 RESOLUTION NO 15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LATHROP AUTHORIZING AN INCREASE OF THE ALLIED WASTE COLLECTION RATES BASED ON THE CONSUMER PRICE INDEX FOR THE SAN FRANCISCO OAKLAND SAN JOSE AREA FOR FISCAL YEAR WHEREAS on June City Council Meeting Council approved Amendment No 2 to the original Agreement dated as of October between the City of Lathrop and Allied Waste to provide residential and commercial solid waste removal and WHEREAS Lathrop Municipal Code Section and Section 26 of the original Agreement provide that residential and commercial collection rates shall be reviewed annually and adjusted effective uly 1 and determination of any appropriate adjustments to the maximum permitted rate will be based on the Consumer Price Index for All Urban Consumers CPI U for the San Francisco Oakland San Jose California area not to exceed 4 and WHEREAS the last rate increase approved by City Council was for fiscal year effective August where commercial and residential rates were increased by 278 and by 036 per household for additional annual curbside residential collection and WHEREAS on July staff received a request from Allied Waste to adjust their commercial and residential rates effective September 1 based on the CPI U ending April and WHEREAS the change in the CPI U for the period of April through April was23 and WHEREAS pursuant to Section 27 of the original agreement between the City of Lathrop and Allied Waste and LMC Ordinance Allied Waste shall remit to the City of Lathrop a Franchise Fee of seven 7 percent and a AB939 Recycling Fee of three 3 percent of the gross revenue collected within ten 10 days following the completion of each calendar month NOW THEREFORE BE IT RESOLVED that to the extent that the solid waste hauler gives notice pursuant to paragraph 26 of the Agreement and pursuant to Lathrop Municipal Code Section C the City s franchised solid waste hauler shall not be permitted to charge fees any higher than specified for each customer type listed
