3 Coast Guard Regulatory Authority 1990 Nonindigenous Aquatic Nuisance Prevention and Control Act Prevent or reduce the introduction and control the spread of NIS via the discharge of ballast water from those vessels entering U.S. Waters 1996 National Invasive Species Act Extend Great lakes regime to the nation. BW Management practices directed: BWE Midocean; Retention; Alt BWE areas; USCG approved alternatives 3
4 Applicability & Exemptions Applicability: All non-recreational vessels, US & Foreign that are equipped w/ ballast tanks & operate in US Waters. (33CFR ) EXEMPTIONS: (33CFR ) Crude oil tankers engaged in coastwise trade (exempt from BWM Requirements, Recordkeeping & Reporting) 4
5 Applicability & Exemptions cont. Vessels that operate exclusively on voyages between ports or places within a single COTP Zone are exempt from BWM requirements and recordkeeping (MUST REPORT) Seagoing vessels that operate in more than a single COTP Zone, do not operate outside of the EEZ, and are less than or equal to 1,600 gross register tons or less than or equal to 3,000 gross tons exempt from BWM requirements only. (MUST RECORD-KEEP & REPORT) 5
6 Applicability & Exemptions cont. Non-seagoing vessels exempt from BWM reqs (MUST RECORD-KEEP & REPORT) Vessels that operate in more than a single COTP Zone and take on and discharge ballast water exclusively in a single COTP Zone exempt from BWM reqs (MUST RECORD-KEEP & REPORT). 6
7 Implementation dates Implementation Schedule: First regularly scheduled drydocking after a vessel s compliance date New Vessels (Dec 1, 2013 keel laying): On delivery Existing Vessels (BW capacity in cubic meters): <1,500: ,500-5,000: 2014 >5,000:
8 Extensions Vessels may be granted an extension on their compliance date in the event that, despite all efforts, compliance with one of the approved BWM methods, including installation of a CG type approved BWMS is not possible. Existing extension letters will remain valid until the extended compliance date specified in the extension letter. 8
9 Extensions cont. If granted, the length of extensions will be for the minimum time needed, as determined by the Coast Guard and based on the documentation provided for the vessel to comply with the Ballast Water Discharge standard. Determinations are made on a case by case basis. MSIB &
10 Options for Compliance 1. No BW Discharge Two Temporary Compliance Alternatives 2. Coast Guard Approved Ballast Water Management System 3. Discharge to Facility Onshore or to Another Vessel for Purpose of Treatment 4. Use only water from a U.S. Public Water System 1. Alternate Management System (AMS) Temporary Designation for up to 5 years 2. Receive an Extension to Vessel s Compliance Date - extension period will vary depending upon TA system availability 10
