3 TIGER Drylac Powder Coatings All powder coatings in this list are available from stock in 20 kg cartons or as a 2,5 kg minipack (not available in Series 40 and Series 017 NCS colors). Prior to processing the appropriate Product Data Sheets and Technical Information Sheets and in case of metallic effect powder coatings also the Data Sheet no. 36 of the Austrian Chemicals and Technoloy Research Institute each in their latest version as well as any and all notes given in this list must be consulted. Please observe pigment related color differences of bright colors between architectural applications (TIGER Drylac Series 29 and Series 17) and other exterior applications (TIGER Drylac Series 59 and Series 47) - use the same product line throughout the entire coating job. Two-coat-systems: for the first coat use just the half of the curing time of the corresponding Product Data Sheet (provided that no other information is given there). The following top-coating is to cure as stated on the corresponding Product Data Sheet (full curing time). Please observe also the Technical Information Sheet no (latest version) for the cleaning of powdercoated surface. As part of our product information program each of our Product Data Sheets and Technical Information Sheets are periodically updated in accordance with present technological standards, so that the latest version shall always prevail. 35 Terms of Delivery and Payment 1. General: Unless otherwise agreed upon in writing, the making of offers, the conclusion of sales contracts, as well as the delivery of products by TIGERWERK shall be made exclusively according to the present Terms of Delivery and Payment, any general terms of business or other variant terms of the CUSTOMER notwithstanding. 2. Offers, Orders: Offers made by TIGERWERK are not binding, especially with regard to the quoted prices, amounts, delivery times and the general availability of the products. Orders of the CUSTOMER will be binding on TIGERWERK only after issuance of a written order confirmation or upon actual delivery. 3. Delivery, Ship Date: With orders amounting to Euro 109,-- (excl. VAT) deliveries within Austria are made on a freight prepaid basis, smaller orders are subject to a freight charge of Euro 5,45 (excl. VAT). lf requested by the CUSTOMER, delivery may also be made by train or mail at the risk and expense of the CUSTOMER. Notice of discrepancy concerning the amount and weight of the products shall be made by the CUSTOMER immediately upon receipt of the products, otherwise they will not be accepted. Ship date information we indicate is based on extensive experience, but not binding. No liability will be accepted for non-compliance with given delivery dates. 4. Returnable Packaging: Only packaging material that is explicitly marked as returnable will be taken back by TIGERWERK. Such packaging shall be returned at no cost to TIGERWERK by the CUSTOMER within three months. In case of return after the expiration of such term, no credit will be given. 5. Retention of Title, Assignment: TIGERWERK retains title to all products delivered until full settlement of the sales price and any and all connected claims. By processing the delivered products the CUSTOMER will not acquire property rights in the goods produced partly or entirely by such processing. In case of the continued use of - processed or unprocessed - products that are subject to such retention of title, the CUSTOMER shall assign any and all claims it may have against the transferee (e.g. against the buyer or any other customer) to TIGERWERK in advance. The CUSTOMER has to notify his contractual partner about the assignment without delay. In case the right to retain title lapses for whatever reason, TIGERWERK and CUSTOMER hereby agree that, by means of the processing, title to the products shall pass over to TIGERWERK, which accepts the transfer. The CUSTOMER remains bailee of the products for no consideration. 6. Conditions of Payment, Default: Payment shall be made: a) either within 8 days as of invoice, less a 2 percent discount; or b) within 30 days as of the invoice date, net cash; In the event TIGERWERK bottles products at the request of third parties, payment shall be made net cash upon receipt of the invoice. In case of payment by way of bills of exchange, bank discount charges and collection fees shall be borne by the CUSTOMERS and shall be payable immediately in cash. Late payments shall be subject to interest on arrears in the amount of 1 percent a month. Any reminder charges, collection charges and lawyer s fees in an adequate amount shall be borne by the CUSTOMER. lf a CUSTOMER defaults in the payment of one or more deliveries,tigerwerk shall be entitled to suspend any further deliveries until effected payment or to withdraw from existing contracts with the CUSTOMER. Any notice of defect etc. shall not release the CUSTOMER from its obligation to comply with the terms of payment as set forth above. 7. Warranty, Damages: TIGERWERK warrants that products delivered by it do not have any flaws or defects regarding material or workmanship. page 34
